>> grief at the site after tragedy, ten year olds boy struck and killed by a police cruiser, as he crossed the street. witnesses say that boy was walk to go a friend's house for a sleep-over. now the police office here struck that child he was also taken to the hospital after the crash. >> thank you for joining us, everyone, it happened last night along delsea drive that's where "eyewitness news" reporter jan carabeo is standing by with more on this investigation. jan, good morning. >> ukee, erika good morning a lot of questions remain, were the police officers areas lights and sirens on at the time of the accident? what was the emergency call he was headed to? meantime, a autopsy on the ten year old victim will be conducted today as this investigation continues. as word spread, that a ten year old child had been killed crossing the street here in franklin township, family and friends came to the scene looking for answers.

>> the victim was a ten year old boy and the driver of the vehicle was a franklin township police officer, and the matter is currently under investigation. >> police say the accident happened just after 7:00 p.m. here on delsea drive near paul street. the ten year old boy and two of his friends were heading to a slumber party at the time. one of the child's friends had made it across the street safely. but, police say as the ten year old started to cross he was struck by franklin township police cruiser and died. investigators say that officer was responding to a call when the accident happened. it was the only person inside the crewser. >> we will release more details as we receive them. we would like to offer our deepest condolances to the family of that child. >> now, that officer was taken to the hospital for evaluation. no other children were hurt. again, full investigation is now underway. that will be headed out by the gloucester county prosecutor's office. live in franklin township this morning, jan carabeo cbs-3

"eyewitness news". >> jan, thank you. new this morning flying debris from an overnight garage fire in frankford injured two philadelphia police officers. "eyewitness news", at the scene, on the 1100 block of arrott street around 1:30 this morning, police say two people living in an apartment above the garage safely escaped. but, when firefighters and police arrived the garage was already fully engulfed with a station wagon inside. >> while extinguishing the fire, they heard allowed pop. and then a piece of metal from the rear bumper of the vehicle traveled about 100 feet at high rate of speed striking two police officers in their leg. >> both officers were treated for minor injuries. they are expected to be okay. fire investigators are looking into the cause of that fire. well, developing right now, australian planes assisting in the search for missing air asia jetliner have reportedly spotted objects in the sea where the plane is believed to have crashed.

as though the pattern will be pretty quiet one for the better part of the week. although you might be scratching your head, why say that? green on dollars radar right now. they is what is left of a frontal boundery dropping to the south. area of low pressure redeveloping along it, but it really appears as though it will produce nothing more than just a very glancing blow to the area, in the form of residual shower perhaps through the southern most counties here, in the delaware county. philadelphia is done with. >> this you can see with the passage of the front what it has done to the thermometer readings. it means it hasn't really quite registered just yet out in the dover and millville. chillier but not quite as cold as it is say up in reading or mount pocono, where you dropped off at least 10 degrees here since this same time yesterday. twenty-nine is how it relates to the thermometer readings, then, when you factor in that 24 hour departure. 40 degrees fat philadelphia international. but the winds becoming more north herly stay that way through the day. any time the breeze blows, although should be pretty modest it, will feel chillier.

in jersey, no problems on the north and southbound lanes of the 42 freeway, no problems if you are headed toward atlantic city or east or westbound on the expressway. otherwise, mass transit great alternate. new jersey transit and dart running on time with no delays. erika, back over to you. >> jessica, thank you. ship with 49 survivors of greek ferry fire has reached land. meantime, more than 200 passengers, and crew, are still trapped on board the ferry that caught fire yesterday, in rough seas, between italian all brain ya. italian navy says 250 others have been evacuated. most were air lifted by helicopter, two other merchant vessels. one person was killed, two more were hurt. eyewitnesses said they heard explosions, but the cause that far fire is under investigation. divers come up empty in their latest search for missing student shane montgomery. the garden state under water recovery unit spent several hours searching the schuylkill expressway in manayunk yesterday. but they did not find any signs of shane. the same group of divers found montgomery's keys last week.

the west chester university senior disappeared more than month ago after leaving a bar in manayunk. student at charter school in northern liberties are scrambling to find another school. the walter d palmer leadership learning partner charter school is shutting down on wednesday. in may the pennsylvania supreme court ruled the school had to pay back a one and a half million dollars to the philadelphia school district. in october palmer high was shut down and a lottery cut hundreds of children from the palmer center. >> it hurt me a lot. like a great deal. like what am i supposed to do now? everything is closed. this is the holiday season still. what's the next step? >> this closing affect nearly 700 student from k through eighth grade. the philadelphia school district says it is ready to help student move to other schools. ukee? >> well, in sports time for the eagles players to clean out their lockers. they will be home for the playoffs despite winning ten games this season. beasley reese shows you the bright spots from the season

>> alert after two suspect fired at patrol car with a rifle, one person is no in you in custody police looking for another, they consider him armed around dangerous, no one has been hurt, lapd declares city-wide tactical alert. >> mayor new york de blasio and city police force after the funeral for one of their officers killed in the line of duty. on saturday during officer rafael ramos' funeral, as the mayor spoke hundreds of officers, you can see right here turned their backs on the mayor on the jumbo tron there. on cbs "face the nation", new york police commissioner, bill brat on, expressed his disappointment. >> that funeral was held to honor officer ramos and to bring politics to bring issues into that event i think was very inapropriate. and i do not support it.

but i do believe mayor de blasio should apologies to the new york city police department. i said it day one. and i think you would get this over with if he did it. >> many nypd officers recent mayor de blasio's comment after grand jury failed to indict an officer involved in eric garner's death. he said he was astonished by the decision, and also admitted to worrying that his by racial son could also be harmed at the hand of the police. sixty-three -- 6:13, what's in store for our monday? >> starting to see some changes, erika to a little bit of the roller coaster ride effect on our thermometer readings through the course of the week here. at the moment it, looks doesn't it look as though there is some wet weather like making b line for us? don't worry about it. this will be moving from west to east, you do have a frontal boundary, that's why we saw the clouds and the showers yesterday, but that's drifting to the south here. and as it continues to do so, yes, area of low pressure developing along it, so it makes it almost sort of buldge out.

delays it looks like it is headed toward us. other than maybe lingering shower kent, sus he can, cape may, cumberland, atlantic county, the rest of us evening out a day to feature clouds, some sunshine. 40 degrees at the airport generally into the mid or low i should say low 40's here from philly on south. further north the skies have cleared, colder air start today move in little more readily, so seeing it start off little chillier. in those locations, but you can see where the cold front i just showed you has yet to drop through. raleigh, still at 53, still flirting with 60 in charleston so it is just matter of time before some cooler air eventually works its way further and fourth south. meantime what it means for our forecast, it is back to reality, folks. 46 degrees technically still five above the average but certainly a lot closer to where we should. 31 degrees our expected low tonight with the clouds outside yet again. dry across the board by this point. now the trade off again is the chill. which is really more noticeable specially as we wrap up the year officially on wednesday night. for new years day thursday, 38 degrees at best, despite

the sunshine, then looking ahead to the weekend there is another rebounds on the thermometer coming our way possibly some rain, by sunday. jess, over to you. >> thank you katie. good morning 6:15, outside on the roosevelt boulevard things moving just fine so far. volume typical morning delay here, on the southbound lanes headed toward the schuylkill expressway. no problems if you are headed northbound. now over on 422 around trooper things moving great there as well. back up little bit here, see trooper road just up behind me there. headed eastbound toward the king of prussia area, everything moving along great there, as well. we do have car fire out in west goshen, the west chester pike near five points road. so you can expect police activity on the scene trying get that cleaned up and out of the way to make first days of passage for commuters. no problems on any of the bridges, the ben the walt, and the betsy ross, all doing well in the east and westbound directions. but, 422, 202 into observation, still seven minute trip. no problems on the blue route or 202 head headed northbound. >> a look at today's

>> junk girl who inspired legislation known as hand a's law has pads. twenty-three month old hanna cost her battle with crab a disease over the weekend? natasha brown explains, dozens came out to honor and remember ann at candlelight vigil last night. >> tears, hugs, the most sincere condolances for family experiencing heart breaking loss of their child. little hanna just 23 months old, wasn't just any child. she changed lives and laws during her short journey. she was adored babe how couldn't move, eat communicate, because of extremely rare and degenerative disorder known as crab a. >> she has a huge support system. nobody is that lucky to have that many people love them. she has changed the world and we're so bless today have everybody here for us, because it is something that you can't

go through alone. >> hanna lost her battle with the disease just three days after christmas candles burned brightly at this vigil illuminating the somber faces of those who cared most about her. >> and she new we wanted christmas, and she stayed, and it was time, she was tired. >> hanna was diagnosed with crab a at four months olds her mother has fought diligently though have screens test for newborns add intoed pennsylvania law. it is known as hanna's law and in october governor corbett signed it into law, in the state. >> the awareness for crab a, if caught at birth hanna could have been walking right now, and not sitting in a morgue. she would be here with us. >> the more purposes we found for her life, it gave her and us more reason why she was here and why she was going to leave this earth earlier than we were. >> hanna's memory lives on in this gathering her short life filled with purpose, her name forever etched into a law that

will dot same this week, too. at the moment doesn't look all that fair, does it? we do have the retreat of frontal boundery, area of low pressure developing along it, so the southern most counties here in the delaware county likely will see just quick shower flew the late morning before it is all said and done, then temperatures are just going to stay into much more seasonable territory. currently at 40 at the airport, we should only get you to up about 46 today. that's still technically about five above the average. but it sure is colder than the last few days have been. 38 degrees by tomorrow, when we keep you at best into the 30's on wednesday to wrap up 2014, some very chilly air obviously, but it really is looking like a very quiet pattern right through the rest of the week, in fact, jess? >> thanks, and having a quiet commute so far as well. a lot of the majors and everything moving great so far. no real problems, and we start things off on the ben franklin bridge, from the philly side, starting to gather volume, everything moving headed into the city westbound, and all lanes are open, there as well. over on 95, around girard,

police look into exactly how this accident happened on sunday night. we take a look at the video see the accident scene as police remain therefore hours checking evidence. this deadly accident, happened just after 7:00 p.m. here on delsea drive near paul street in franklin township. police say a ten year old boy and two of his friends were actually head today slumber party at the time. one every his friends had made it across the street safely. but as the ten year old started to cross police say he was struck by a franklin township police cruiser and died. now, investigators say the officer was responding to a call when the accident happened. he was the only officer in the cruiser. that officer was taken to the hospital for evaluation, and no other children were hurt but, right now details are still limit bad how this accident happened. >> the gloucester county prosecutor's offers is currently conducting an investigation into a fatal motor vehicle accident that occurred earlier this evening in franklin township. the victim was a ten year old boy, and the driver of the vehicle was a franklin township police officer and the matter is currently under

investigation, we will release more details as we receive them. we would like to offer our deepest condolances to the family of that child. >> now franklin township meanwhile has released this statement that reads in part: first and for most our thoughts and prayers go out to the family, that tragically lost their son while this is a very difficult time for the young boy's family it is also very difficult for that police officer involved. it is our understanding that the officer was responding to an urgent call when this accident happened. we support the officer who was involved in this. he is very shaken up. again, a full investigation is underway. a lot of questions remain this morning, involving whether that police officer's sirens and lights were on at the time of the accident, and what that emergency call was that he was responding to. gloucester county prosecutor's office is headed out this investigation. reporting live in franklin township, jan carabeo cbs-3 "eyewitness news". >> jan, thank you. new this morning investigators are searching

for the cause after garage fire that injured two philadelphia police officers. firefighters and police responded to the scene on the 1100 block of arrott street in frankford early this morning. authorities say flying debris from a car inside the garage hit those officers. they were treated for minor injuries. two people living above the garage escaped without getting hurt. developing right now indonesia vice president says they are working to verify reports that wreckage from missing air asia flight 8501 has been spotted. the airbus 320 vanished yesterday as it traveled from indonesia to singapore. cbs news correspondent michael bert has more on the plane's mysterious disappearance. >> reporter: australian search planes have spotted objects in the java sea where an air asia plane disappeared. investigators do not yet know if it is wreckage from flight 8501. with help pouring in from other nations including singapore, malaysia, australia

indonesian officials say it is likely the plane is at the bottom of the sea. the flight caring 162 people including 17 children took off for singapore sunday morning. shortly after, one of the pilots asked to change the route because of bad weather. the request was denied due to high traffic. cbs news aviation safety analyst mark says the airplane's data recorders will help reveal what happened next. >> we've got life if you will in the batteries for the next 30 days, maybe depending upon when these batteries were put in to this aircraft as long as even 09 days. >> reporter: indonesia promises safety review of air asia, something the ceo tony fernandez says is is a top priority. >> we have carried 220 million people to up this point. of course, there is going to be some reaction, but we are confident in our ability to fly people. >> reporter: relatives still wait for any news holding onto hope at a crisis center set up at the indonesian airport where the missing plane took

off. michael bert for cbs-3 "eyewitness news". let's get our traffic and weather together now. here's katie. >> good morning, high shall happy monday to you. still tracking the departure right now after cold front some clouds out there and some could see residual shower. the further south you are more likely it will be you find any additional raindrops. we take you out there, "skycam 3" looking clear for the moment over philadelphia, 40 degrees the current temperature, winds coming out of the north at 8 miles per hour, and here's what you you've got. sometimes you know, you find things that aren't actually verifying at the grounds level on storm scan. so while you do have some sort of glimpse of green showing up around philadelphia, it doesn't necessarily mean that they are actual raindrops falling from the sky. put things into motion, pull being every moisture pent up, into cape may that's generally where you have got the best shot to find a shower out there. as the day progresses, though, everybody can expect at least little sunshine, certainly some clouds, and we'll get the

temperatures into the mid 40's, for you. but again, it is upright quiet day all things considered, despite the package every colds front, we are quieting down it, looks like that's actually going toned up being our big story here, as the week progresses. not even just to wrap up the year, but also to kick off new one, the cold air returns but we are expecting some sunshine. jess, we send it over to you. >> thank you katie. good morning everybody 6:35, we are having quiet run so far, going out on the schuylkill expressway starting start to see little tiny bit of volume. still everything moving just great. right around 202 the westbound lanes are over up where the headlights are, eastbound headed toward the center city area moving along just fine there as well. now, out in new jersey, things starting to build in just a little bit in the northbound lanes on the 42 freeway so headed northbound toward 295 the surrounding area bridges headed to philly, you should have real now problem doing so. we can expect that to start to stack up just little bit. southbound lanes moving just fine. otherwise out in new jersey

shall, near route 55 northbound, an accident just popped up. near route 674. that's north near north vineland. so just use some caution when traveling on through there. we do have some debris in the road approaching norristown, use some caution. ukee, back over to you. >> jess thank you. eagles are cleaning out their lockers after a win over the new york giants. bittersweet ends to the year that showed so much promise at the start. mark sanchez through couple of touchdowns, including this one to rookie wide receiver jordan matthews. nicely done. in the third quarter the birds special teams came through big time again. james kacie blocks the giants punt, and it ended up with a tray burton scooping up the loose ball and going to the house. nate allen with big pick at the end of the game. eagles beat the giants 34-26. >> so great to get a win. i've been on the other ends, lose the last game, everybody is pointing fingers getting upset, all of that, that's no fun. that's not the way we wanted to go out. glad we accomplished what we
