♪ we begin with breaking news at 11:00. police sources tell "eyewitness news" a suspect is now charged in connection with a brutal attack on a woman in a philadelphia parking garage. good evening to you, i'm jessica dean. chris may is off tonight. >> this news coming in just minutes ago. the attack happened at a parking garage at 17th and callowhill

streets in broad daylight today. "eyewitness news" reporter david spunt is live outside special victims unit with breaking developments. david? >> reporter: jessica detectives here at the svu say this man is 32 years old. he's from the pittsburgh area. tonight he's charged with rape, robbery, attempted murder among other related charges. that victim recovering in a local hospital. detectives spent hours collecting evidence at this parking garage at 17th and callowhill. >> i have not had an issue in the three and half years i've lived here. i feel very safe. i'm very surprised. >> reporter: police say the suspect followed the woman sexually assaulted her then ran away. residents of one franklin tower used the garage every day. alexis tan and in obama lives in the building. >> i know my building has 24 hour security both inside the building and in the parking garage. >> reporter: police say the suspect somehow bypassed security and assaulted the woman on the second floor of the garage. several security cameras. police are combing through the footage. >> i feel so in shocked and very upset. i can't believe it. it's awful. >> reporter: even though police have a suspect behind bars right now they are still looking for any information detectives want to hear from you if you know something. they say you can remain anonymous. call them if you know something at svu. live tonight at special vick testimony unit. david spunt cbs3 eyewitness news news. >> all right, david thank you report roar health officials warn about new two new cases of hepatitis a in hamilton township. both patients ate food from the same restaurant where a work was infected in back in november. that was rosa passes restaurant and catering on south broad street. one of the people infected with hepatitis a works at the hair port salon on south broad street. the other work as part-time fitness instructor at the hamilton area wmca's jkr branch on white horse-mercerville road.

health officials say if you've been to any of those three businesses you should contact your doctor or the health department. hepatitis a a contagious liver disease in rare cases can cause death. it is a cold start to 2015 out there and the first weekend of the year looks to be a soggy one. meteorologist kathy orr is live on the cbs3 sky deck tracking a storm tonight. kathy? >> absolutely, jessica. happy new year. we are looking at a cold start to 2015 and the temperatures are falling but the winds still kicking up sustain at about 10 to 15 miles an hour with some higher gusts and that does make it feel much colder. right now in philadelphia, it is chilly the temperature is already fallen down to 33. it's 26 in allentown. 28 in reading and 30 in the pock notice but look what it feels like in the poconos it feels like 18. 19 in allentown. and 20s mainly everywhere else. tomorrow morning temperatures will be in the 30s. we'll wake tup a wind chill of 23 at 7am. 9am wind chill 25. and 11 a.m. it will feel like

it's 29. a storm is brewing in the south. you can see it through memphis through atlanta, that is moving toward the north and east. so this is what we expect. we are in for some weekend rain and some wind. we'll have a brief warmup and then it is back to blustery for january. we'll talk more about that in the seven day when i join you inside. >> all right, kathy thanks. the music the dancing the costumes it not new year's in philadelphia until you see the comics the fancies the string bands and bench and fancy brigades shaking their sequin. mummers are more than just parade though their tradition. but this year tradition came with some controversy. here's diana rocco. >> reporter: parade route may have started off different this year but the celebration always culminates on two street where the brigades have one last chance to perform and show off their costume. ♪ >> reporter: in south philadelphia style mummers are partying the night away on two street. but new year's day started early

for the 10 mummer brigades and thousands they came out to see them lining the parade route for fancies on display as they strut strutted threated feathers and costumes. >> happy new year! >> reporter: in it's 115th year the big change this year was to the parade route. previously parades have started in deep south philly and ended at city hall. this year that flipped. with brigades starting at city hall and marching south to washington street. >> what did we want? the parade back! >> what do we want? the parade. >> we support them. we do everything we can for them. and they took it away from us. >> reporter: 2 miles shorter but an tempt to draw more crowds crowds. >> my sister and my niece and my brother are all marching with the murray comics so we're all here to route them on and yell and hoot and holler haven't great time. >> i really like how they worked so hard on the costumes. they're really awesome. >> reporter: it's on to the convention center where the fancies put on their well core graphed and hard practiced shows

festivities. new tonight a grieving mother joins mourners to had he been her 10-year-old killed and killed by a franklin police cruiser sunday night. friends and family lit candles for fifth grader matthew mccloskey at the fran lynn township sports complex in franklinville. >> he was funny. he was smart. he was always like ready to go places and stuff. >> we're comeing together to, you know to celebrate matthew's live. >> comforting my sister and comforting us and just so concerned and making sure we have everything we need and doing so much for us it's unbelievable. >> police officers were also there to pay their respects as well. the officer who drove the cruiser is on leave while authorities investigate. mccloskey's funeral set for tomorrow. a mother and her two children escape a house fire thanks to the quick thinking and strong hands of some camden

county police officers who refused to give up on this rescue. a jump from a window saved lives when this camden county home went up in flames. >> instinct just kick. initial reports a christmas tree caused the home to catch on fire leaving a woman her four-year-old son and seven-year-old daughter trapped inside. neighbors flagged down officer sean mcmahon and his partner. >> after our initial and tree the smoke was extremely thick and it was overwhelming. >> reporter: and that's when instinct told them what to do. linking arms like this with other officers who arrived at the scene they caught the children and their mother who jumped from the window. >> makes us extremely proud. we love to help out the community in any way. >> neighbors are grateful for the help in saving family. one man describes as good people people. >> that's good. my neighbors is all right. hopefully they get through the today. >> at last check the mother and children were listed in critical condition and that officer was treated for smoke inhalation and

released today. firefighters in burlington county new jersey, spent almost five hours battling this large warehouse fire. the flames broke out around 3:30 this morning on holman street in mt. holly. that warehouse was vacant. in one was hurt but the fire did force some neighbors out of their homes. the cause is now under investigation. investigators in delaware county are trying to figure out what started this house fire on new year's eve. take look at the scene on the fief hundred block of sylvan avenue in glenn olden borough. the fire started on the porch. it quickly spread. but fortunately no one was injured. just five hours after the fireworks philadelphia police responded to their first homicide of the year. a 19 year old man was shot in the head on the 5800 block of north phillips street in olney. he was pronounced dead at the scene. no word so far on a suspect or a motive. a woman says her son was shot and killed in chester while trying to break up a fight. officers responded to the scene on the 1400 block of company he

wasn't street in chester around 1:00 this morning. a firearm was reportedly recovered at the scene. the suspect or suspects are still on the loose. "eyewitness news" has exclusive video tonight of a crashed van that police say was stolen by a patient at lankenau medical center. authorities tell us the unidentified patient was still in a hospital gown and still had an iv in his arm when he tried to pull this off. police say the patient was airlifted to the hospital of the university of pennsylvania with serious injuries. we learned tonight that former new york governor marrow cuomo has died. his son chris cuomo says his father passed at home. he had been hospitalized to treat a heart condition. served three terms as governor from 1983 to 1995. his other son andrew is the current governor of new york. he was 82 years old. new jersey governor chris christie issued a statement reading in part "our country and

our region lost a giant today with the passing of governor mario cuomo. he was a strong he will low quantity leader who loved new york and its people. mary pat and i send our deepest cone dole lenses, ma mill at a governor andrew cuomo and the entire cuomo family ". >> pennsylvanians are paying higher gas tax start dag. the state's gas tax went up 10 cents per gallon on wholesale prices. prices at the pump are stelle relatively low. a gallon of pregnant costs an average of 2.54 in pennsylvania. in new jersey a little cheaper. 2.27 a gallon. drivers in delaware paying an average of 2.42. pennsylvania drivers now pay 70 cents a gallon in state and federal gas taxes and that is one of the highest rates in the nation. penndot says the taxes are needed for roadway improvements but not everyone is convinced higher taxes are a good idea. >> you can see the construction going on. you can see the improvements. smoother roads safer bridges

and that's what we're working towards. >> my opinion is, yeah, we don't need one. were got enough gas tax in pennsylvania. drive over to new jersey again the for 25 cents cheaper. >> this is the second of three gas tax installments. the five-year tax program is expected to raise $2.5 billion for infrastructure maintenance. in new jersey, the new year brings a new higher minimum wage. at midnight the hourly wage jumped from 8.25 to 8:38 an hour hour. the rate will rise each year in tandem with con assume mr. price index that measures inflation. in delaware, minimum wage goes up june 1st from 7.75 to 8.25. ugly christmas sweater may lands a vandal behind bars. we'll tell how you police are using fashion to help them solve a crime. plus a popular fast food chain may be the neck victim of a credit card data breach. we've got details straight ahead at 11:00. kathy? >> a storm is brewing in the south.

>> this years rose parade in pasadena california one of defendant in the events 126 year history. as crews set up for the parade heavy winds sent tents flying. over on catalina highland gusting winds caused boats two break free and two people were killed. the same weather system brought snow to parts of arizona and a storm is brewing for our area. it's expected to hit this weekend. meteorologist kathy orr has details on that coming up in just a few minutes. the first of many funerals was held thursday in the wake of sunday's air asia blaine crash. so far the bodies of nine people have been recovered. one victim of the crash was returned to her family thursday in a brief ceremony at a

hospital. searchers are racing against time and also weather as they search the java sea for victims. more than 150 people are still missing. new home videos shows the chaotic rescue efforts on the deck of the doomed norman atlantic ferry. the ship caught fire sunday on the aid degree yacht tick sea killing at leach 11 people. pass injuries said he took this video to highlight the lack of crew on board. suspect is caught on camera vandalizing cars and also destroying holiday decorations now police hope this choice of fashion will lead to a quick arrest. the vandal was wearing a christmas sweater it had two reindeer an star on the back. police say he hit at least 13 cars and homes and also had help from someone else. another possible data breach. this time it involves the popular fast food chain chick-fil-a. the company says it recently learned about some unusual accident activity involving payment cards at some of its restaurants. however chick-fil-a says customers will not be responsible for any fraudulent

charges. its investigators find any evidence avenue breach. >> pope francis take to the balcony to deliver his new year's message earning the faithful to fight indifference. >> the pontiff called for an end to human trafficking and slavery on this world day of peace. he said the new year is a good time to reflect on our own mortality. some local families saw their families expand early this new year. marquise came into the world just shorely after the fireworks fireworks. he was born at 12:39 a.m. at the hospital of the university of pennsylvania. his mom says she's happy to kick off the new year with her special little guy there. and sophia graceland dawson was born at 3:04 this morning at temple university hospital. mom and dad say the fact that she was born on new year's day is just one of the reasons this little girl is special. they also tell us they've been waiting 10 years for a baby of their own.

in weather we're talking about some cold temperatures that will stick around for at least part of the weekend and a storm that's brewing to the south. our "eyewitness weather" watchers are saying we're ringing in the new year with a chilly night with some blustery winds. take look at some of these temperatures. 29 through south jersey. 28 degrees in parts of pennsylvania. to the north and west of the city in perkasie 28 with moonlit skies much it's cold out there. let's take look in philadelphia. the temperature is 31. tanya reporting in some light winds as well for the moment, and we'll take you to delaware where the temperature is 28 degrees. john is saying in newark, 28. not much wind right now. winds are calm and the pressure is rising. ooh want to show i was few pictures we received a beautiful picture from philadelphia tanya brings this one to us tonight. the moon over philly. a waxing and how about this one from peter. he says, cure for a chilly night.

where our storm is warm enough for rain in dallas and houston and all of this is moving toward the northeast. so we stay on the warm side of the storm again. been the case most of this fall and early winter, and it looks like it's going to continue at least through this weekend. so a cold day today. during the day tomorrow temperatures seasonal in the 40s 40s. high clouds moving in. a warm front brings some rain saturday afternoon and it could start as a wintry mick through the lehigh valley and the poconos maybe a little snow in the poconos. and then warm air surges through the entire region. temperatures jump some 20 degrees. we're in the warm sector with some morning rain sunday temperatures in the 60s but once this front mess through, it's going to be a much different story next week. as far as the rain amounts for saturday afternoon, through sunday evening our american model and european models around 1 inch when you average it out so not a lot of rain. but it will disrupt things if you want to be outdoors over the weekend. overnight the low temperature 30. during the day tomorrow, 46 -- i
