"eyewitness news" reporter justin finch joins us from our satellite center to tell us

more justin. >> good morning we know frein facing 13 charges including first degree murder as well as two charges of terrorism. those latter two charges come from allegation that is were made against frein in his hearing with detectives shortly after his capture. we'll also find out today if those charges will holdup in court. now, according to court documents on the night of his capture, october 30th, frein acknowledged shooting those troopers, because he wanted to make a statement. and a change against the government, now that's what's led to those terror charges frein's legal team is questioning if the admission was gotten legally. but in the affidavit we've learn detective briefed frein on his right to remain silent, also if you wanted to get a lawyer. it appears though, that frein chose not to do so. now, frein was captured 48 days after he allegedly ambushed state barracks in pike county using a high powered rifle. he is accused of killing corporal brian dixon and wounding trooper alex douglas now, frein's team so far has

enters a not guilty plea on his behalf. he has been jailed since his capture, and today's hearing folks us chiefly on the prosecution in this case. they will have to make their case before a judge that a murder happened and that frein indeed was behind it, they are also seeking the death penalty in this case. we are live in the sat center, justin finch cbs-3 "eyewitness news". justin, thank you. right now it is 4:33, we want to get back to katie and hear more about our forecast. >> good morning happy monday to you. as we kick start a new week, a lot of kids head back to school, you are probably headed back to work, and certainly we expect to see some brighter skies than what the weekend brought. wasn't it a great excuse to make some grilled cheese and soup over the weekend? just so dreary outside. but, that whole system is now making its retreat. starting to clear out very nicely. the thing is it always comes with some other kind of trade off. the trade off this time is absolutely the windchill and the cold. that is going to follow in the wake of this system. soap here is storm scan. finally empty for a change,

haven't seen that in a couple of days. still few lingering clouds. see how that's starting to break apart. zoom it out one more time. winds in effect helping to spend some of these lake end lanced snow showers. won't see any left over snow showers, we just start to brighten up, see the chill settle in. huge change coming our way we see the temperatures dropping solid 20 plus degrees here from yesterday's high to this morning. and this morning at 37 degrees, that's the best it will be. now, the reason for that is because the colder air is taking over. so as the day goes on, thee temperatures are gradually declining. currently we feel more like we're in the mid 30's. there is pretty substantial winds out there. but it is not really that brutal windchill yet. give it time. as the day progresses, skies brighten up it, will look pretty outside. once you walk out the door you have to be ready for it with not just your sunglasses but nice heavy coat, and

certainly, jest, a i wouldn't wore bit nicest hairstyle today. because i have a feeling the winds will mist it up anyway. good morning. >> great, that's something i have to look forward tonight i have my brush and beignet bottle of hair spray right in my purse perfect. good morning currently having no problems out on most of the majors, ben franklin bridge, as you can see actually from the philly side all lanes open and moving along great. so headlights headed westbound on into the city currently dealing with no problems. over on 95, around girard, everything moving great. south and northbound lanes so in or out of the city should have no problems getting there, as well. we do have water main break with a road closure there out in west conshohocken, front street at crawford street. alternate as that becomes update in the our systems here, also ongoing construction out on route 422 still, east and westbound been there for little bit. that's between stowe and route 100, that's going to be one lane until early january. still having that youth there currently. but the rest of the travel time looking great, 422 from oaks into 202 about seven

"eyewitness news" on the 3,000 block of north lee street in fairhill. we're told all residents able to get out safely but home was a total lost. investigators are still working on how that fire started. police in philadelphia are looking for this woman right now. sixty year old woman disappeared after leaving a temple at the corner of cottman avenue and shisler street in rhawnhurst. police say she has altzheimer's and does not speak english. anyone with information please contact the philadelphia police department. happening today, former philadelphia sportscaster don tollefson goes on trial. he is charged with stealing more than $300,000 through various sports charity schemes. last month tollefson withdrew his guilty plea and he asked for a delay for the trial so that co-find an attorney to

rep him for free. a bucks contagia is allowing an attorney to have tollefson defends himself. shane montgomery's death has been ruled an accident. divers pulled shane's body from the schuylkill river after searching nearly 40 days. he vanished early thanksgiving morning after leaving kildare's irish pub in manayunk. family friends and total strangers worked tirelessly to bring him home. now, they too are grieving. >> the community real did i come together. it is tragic what happened. >> i thought it was neat that people showed they cared the search they had when they came to the church, over 500 people that came to help. i just think it is just awesome. >> thousands have taken to social media posting to this facebook page to offer comfort to the family in their time of need. a vuke for shane montgomery will be held at manayunk church where search teams gathered. saint john the baptist thursday night from 5:00 to

9:00 again friday morning before the funeral mass at 10:00 a.m. donations in his name may be sent to the garden state underwater recovery aoun knit milford, new jersey, or the friends of saint john the baptist. hundreds of people turn out for two separate rallies in delaware and chester counties to show their support for police. many gathered outside the old courthouse in west chester with signs cheering on the men and women in blue. a line of support also stretched for blocks, down baltimore pike in delaware county. a direct show of appreciation on the same day in nypd police officer was laid to rest. he and his partner ambushed and slain while sitting in their cruiser. >> every law enforcement agency is rep here. we all work together. >> people put their lives on the line. it is very important to come out and show your support. >> t-shirts which red all lives matter were also sold at yesterday's rallies. money raised will be sent to the families of the two officers assassinated in new york. >> coming up on "eyewitness news" this morning trial of accused boston bomber dzhokhar

happening today, jury selection begins in the boston marathon bombing trial. dzhokhar is accused of conspiring with his brother to detonate two pressure cooker bombs near the marathon finish line back in 2013. three people died, more than 260 were injured. if convicted, he could face the death penalty. >> new york detective wenjian liu burried after 10,000 mourners attended his funeral. wenjian liu and his partner rafael ramos shot to death in police police cruiser december 20th. dozen of philadelphia police officers showed support for the officer's family. >> it is important, as part of

>> boy, hard to believe but things just got worse for the struggling flyers. league fined them an undisclosed amount every monday i for violating the league's collective bargaining agreement. the team traveled to nashville during their christmas break on december 26th, which is a no-no, to be in compliance the flyers would have to have flown on december 27th the day of the game. >> used to be anchor, stewart scott has passed after long battle with cancer. the 49 year old passed away yesterday. scott joined espn in 1993 inject ago style and energy that changed the network and industry forever. he was first diagnosed with cancer in late 2007 and never stopped fighting. scott is survived by his two daughters, taylor and sydney. in a july speechh some you have may remember at the awards scott says what you die it does not mean you lose to cancer. you beat cancer by how you live why you live, and the manner in which you live. we'll be right bac

4:53, we want traffic and weather together. good morning jessica. >> good morning everyone out there. 4:53 and we're outside right now in new jersey checking things out where everything seems to be moving along great at creek road. northbound lanes where we start to see that volume really start to accumulate, later on in the morning hours but you can see everything moving along great. no problems in the southbound lables, as well, over on the schuylkill expressway, no problems eastern, so headed eastbound into the city, no problems on the westbound side headed toward the king of prussia area. either out in west conshohocken, problem there water main break use caution traveling through the area, extra time for local detours. transformer fire out in mansfield route 205 at
