our traffic and weather together, beginning with katie, good morning. >> yes, that's absolutely the case for us out there. folks, we still even have winter weather advisory posted because every really just the aftermath. so we've got to talk about that icy conditions out there and it will be slick and everybody's below freezing, so talking temperatures for sure this morning. jess? >> thanks, katie. yes, starting things offer here on the 42 freeway where everything is moving along just fine. no reports of icy conditions here, but doesn't mean it is not there. there are reports of icy conditions in other places, and i'll tell you all about where they are coming up in just a bit. erika, ukee, back to you. >> more on breaking news, police say irradic driver was actually shooting victim fleeing gunfire in southwest philadelphia overnight. >> "eyewitness news" reporter justin finch joins us now from outside the 12th district police headquarters, where the victim stopped for help. justin, good morning. >> congress the scene active at 556 and wood laugh see the police station and the silver chevy mal boo right there in front. that's the victim's car

perhaps you will see the bullet holes in the windows there, that is the car the victim rolled, looking for help. and he. >> about 1:30 this morning that driver arrived to the station here he was driving irradically with its headlights off. a sergeant going into work noticed him and told the victim rather the victim told him that he had been shot. we know the victim is just 22 years old and he says he was driving on the six a hundred block of paschall nearby when he heard gunshots, and realized that he had also been shot and then he rushed here, to the station looking for help. well, that sergeant got him into a police cruiser, and drove him to penn hospital for treatment. and along the way he tried to tell that officer what happened. >> halfway between this location, 65th and woodland and the hospital, the victim, who was talking then just became unconscious. and he's presently still unconscious. he's undergoing surgery.

and he's in very critical condition. >> and we now that driver was returned immediately into surgery, again, he is in very critical condition this morning, and now that witness there was a witness who also told police they heard shots as well, and that's that they saw dark colored or perhaps black late model dodge charger, leaving the scene police are talking to that witness, as well as the sergeant in this case. if you saw or heard anything, you are urged to call police at this time. we are live in southwest philadelphia, justin finch cbs-3, "eyewitness news". >> justin, we will check back with you, thank youment lincoln drive in east falls has reopened to traffic after fast freeze complicated problems with a backed up drain. philadelphia police say the drain could not handle, runoff from yesterday's rain and snow. now, water back up on to the road and became ice. penndot has about 50 trucks salting any icy areas out there right now. well investigators say a falling tree caused a fatal accident in delaware county.

radnor township police say a man was heading south on sprawl road last night when the tree crushed part of his car's roof. the driver was killed. investigators also say the car then crashed into another vehicle, northbound, on sprawl road. the occupants of that other vehicle were not injured. our time 5:33. >> yep, we want the latest on our forecast, katie really the cold out there do you have worry about with the slick spots f it is cold, it is ice? >> really is not if, and/or butts. it is ice. because everybody has seen these temperatures just bottom out completely. so everyone is below freezing,. >> and you know first-hand, last night? >> yes luckily, i had my car handle that i was able to grab on, to but yes almost took a tumble myself. personal story to back it up, you snow. >> we've all been there. >> storm scan three just be careful. thankfully what we can say is that even though the wind was how long through the day or night, it did help to actually evaporate quite a bit of the moisture. now, that doesn't mean it is all gone, here on storm scan3

all of the moisture gone at least falling from the sky. but you will still find those icy spots out there. and, again that wind really did do a good number on good portion that far moisture, now, as we move forward in this forecast, it will be beautiful looking day. but you can't take it at face value. we do actually still have winter weather advisories posted for the lingering ice. no additional precipitation for this, giles. we just have to deal with those very, very cold temperatures leading to the left over slick spots. that goes for the whole region. outside we go here to the live neighborhood network outside pa palmyra cove nature park, we couldn't make out the center city skyline just too much to handle. but it is cold. it is still breezy. at least you've got better visibility this morning. so big trade off i guess. meanwhile, here's how it feels. when you factor in that breeze, it is definitely more modest than it was yesterday. but enough that it will send those feels-like values on a tumble. so feeling more like single digits maybe the teens at best, but specially in the poconos, that's dangerously cold where you're well below zero in terms of the apparent

temperature. as the day progresses, yes full sunshine, looks like beautiful day. that's the key. looks like beautiful day. just be ready for it, you'll be just fine, as long as you avoid what looks like a wet puddle, and have the sunglasses ready to go. bundle up, too jess? >> definitely bundle up. @ agree with that, thanks, katie. good morning everybody we start things out in new jersey currently not getting reports of slippery conditions. but doesn't mean there couldn't be a black ice patch somewhere hiding out for you. so definitely give yourself extra time and use some caution, because we don't see any precipitation coming down steadily as of right now. but we do know that there are some slippery roadway spots there. so don't be fooled by that. forty-two, creek road, everything moving just fine, headed toward the center city area possibly headed into philadelphia there or to 295 just looking fine, so far. over on the boulevard right around fox street, you can see pretty much the same story here. north, south everything looking just fine, out in southwest philadelphia, though, there is police activity closing woodland avenue. at 65th street alternate to get around that for the time being to take greenway avenue

or paschall avenue. this is also affecting septa's route 11 trolley whisk rerouted onto elmwood for the time being. out in lower moreland, an accident, at byberry road, and huntington pike, out in trenton, still some emergency construction dealing with some potholes on route 31 southbound before engleside avenue, which is going to be out there with a lane shift until about 6:00 a.m. erika, back to you. >> jess, thank you. septa police are investigating a trolley brawl that was all caught on camera. a passenger record the the attack late saturday night. video appears to show group of young people male and female punching kicking and slapping a man and 17 year old girl. we're told the trolley operator called police, but that group got away before they arrived. investigators are working with the school district in hopes of identifying those teens. they could face simple assault charges. your time is 5:36n business news this morning which retailer is being de-listed from the stock exchange? >> also, what the government is planning for the internet. money watch's jill wagner

joins us from the stock exchange and more. >> good morning, ukee, erika fcc could be making big changes, the way it overseas high speed internet service. the agency reportedly wants to regulate it as a public utility. so this would actually and big win for net neutrality, which means companies wouldn't be able to pay internet service providers for faster connection. >> here on wall street, stocks opened higher this morning. there was a late surge in energy stocks yesterday. the dow gained 196 points, the nasdaq rose 416789 the new york stock exchange, though, planning the de-list radio shack. news that the retailer might not be able to find a long-term plan to stay afloat, well, that sent the stock price dramatically lower yesterday, and companies must be valued at $50 million to be listed on the stock exchange. the car service app uber could be nice facing some stiff competition, from one of its biggest investors. google. bloomberg is report that google now is developing its

plans to file lawsuit against the township. and she is speaking only to "eyewitness news" reporter david spunt. >> just his hugs and his kisses and always telling me he loved me. >> ten year oath matthew mccloskey's mother michelle harding says she'll never get over her son's death. he was hit and killed by a franklin township police officer three days after christmas on delsea drive around dinnertime. mccloskey and two friends were -- friends were crossing the street when he was hit. >> i miss him every single day, every morning every night. >> police say officer nicholas was on his way to a non-emergency call in the area. the area where mccloskey died was a 50-mile per hour zone. police say the officer was going 74, and was not using his emergency lights and siren when he hit and killed the ten year old. >> i mean, there was no reason why those light shouldn't have been on. >> following an investigation, gloucester county prosecutor's office decided not to charge him. their findings indicated he

was not required to have his emergency lights on for the non-emergency call. siting procedure. michelle harding says, that procedure is a problem. and that's why she is suing the department. >> use your lights 80 miles an hour in a residential area. >> harding insists her son would have never crossed the road if he saw emergency lights. and she is hoping her lawsuit will change police procedure. >> if anything comes out of this i need him to be a beacon of change to this -- so this doesn't happen to any other child. >> i reached out to the law firm representing the township and asked about the pending lawsuit. i was told there would be no comment, until they actually see a lawsuit. reporting from franklin township, david spunt cbs-3 "eyewitness news". 5:40 right now. still to come this morning, a different casino of police chase bridges traffic a stands still. you'll see the on the highway.

also lincoln drive open again. but salt teams are trying to make the road safer. water from clogged drains and low, low temperatures are making it attributing i ride to work this morning. new jersey governor chris christie heads home from london today after clarifying some remarks about the measles vaccine. yesterday, the governor said, all parents should have a say in whether their children are vaccinated. later released a statement saying in part there is no question all children should be vaccinated. 5:43, right now the latest on our roads and the werth, katie our weather watch remembers doing their job for us. >> they certainly r really what we want to check in on is the windchill for you here with this particular check in with the eyewitness weather watcher network. generally speaking, region wide everybody's below freezing, we know that much. but finding a loft teens on the map right now. let's go ahead take a look at some of the winds speeds coming in from the weather watchers. jason in middletown, he's got pretty persistent northwesterly breeze here, at 14 miles per hour, the list goes on, but you if you will notice, a lot lighter wind

than what we saw yesterday. ron russell sending in 5 miles per hour, mt. laurel where kerry is located she's got a four. definitely not as harsh but it is still noticeable breeze. that will will make it feel that much colder. back to the windchill value i mean, only feeling like single digits up in sailors berg, one of the golds star pocono reporters, keith sending in sub-zero windchill values. that's where it could be dangerously cold. single digits, not much better. so just be ready for. that will that's really the bick ticket item here to kicks things off wore which is lift over ice and the windchillment meanwhile we taking out to storm scan, looking off it the west, where we want to turn our focus, combination. next reinforcing shot of colds air. generally looks like it will cross through, even as early as tomorrow bring perhaps a light rounds of snow showers to the northern tier of our area but i would say thursday actually when we have better shot for some light snow. technically it will be from the same system, sort of another pulls of energy that comes n here is a look at the current winds speeds, around the region, northwest generally the wind flow for

us. between about ten to 15 miles per hour, we will see that stay somewhat persistent for the better part of the day. so despite sunshine, you can't go by the thermometer. certainly do have to bunts p up -- bundle up, little less harsh tomorrow, again, seeing snow shower to the north more snow showers more widespread fashion by thursday. jess? >> thank katie. yes, 5:45, we start things off on 95, right around girard avenue. where you can see start to go -- starting to pick up volume southbound lanes northbound lanes moving just fine though, so far over on the benjamin franklin bridge things looking good, speeds back up as well from the jersey side, headed westbound into the city, and all lanes are open with no problems. we do have some police activity though, out in southwest philadelphia. woodland avenue is completely closed at six a street. take greenway avenue or paschall avenue to get on by. it is also affecting route -- septa route 11 trolley rerouted onto elmwood between 73rd and 49th for the time being. out in pennington, right

day dream about being up on the podium, but being there because whenever they would cut to, and see all these people that would you love altogether, it was such an odd surreal thing. >> cooper was nominated for both producing american sniper and playing the lead role of chris kyle. this is the third straight year he's been nominated for best actor. >> well, oprah winfrey is making a return to television. she is teaming up with the director of the film selma for new drama series based on the book queen sugar. she will play a recurring role in the series which will air on the oprah winfrey network. production is expected to begin later this year. >> a detroit man who walks 21 miles a day to and from work is getting a whole lot of help this morning. fifty-six year old james robertson takes the bus part the way still winds up treking 7 miles to the factory in nearby rochester hills in about 14 miles home. robertson says he doesn't mind the commute. as he puts it, if someone wants to get somewhere, they have to go through something.

good morning. his condition took information him to get himself to this police station just behind us. he drove himself in that silver chevy mal due right there atwood lands and 65th here. perhaps you can see the bullet holes in the window on the drivers side of the car. that police officer did get that man to the hospital along the way he tried to tell him what happened before he passed out. >> heading into work at the 12 district, police ceasar gent saw this chevy malibu driving irradically with his headlight off. >> the victim said to the sergeant: i had just been shot. >> behind the wheel, a driver with gunshot wounds to his chest, and struggling to survive. >> 1:30 a.m., the victim described only as it two year old man told the sergeant he was driving a 65th and paschall right near the station, when he heard at least three gunshots. then realized, he had been hit. the damage still seen on his car. acting fast, the sergeant got
