minute. >> but first lets get the the latest forecast from katie good morning. >> that is exactly right. it appears to see that we will be seeing flakes out there but it is more of a big old nuisance then anything. the as we start off by getting out to storm scan 3a tighter zoom to show you our area more localized. it is very obvious where you'll fine the snow, northwestern tear of our region northwestern berks, lancaster county a and lehigh northampton counties and mount pocono. if you are traveling and up that northeast extension you will start to see those flakes flying with time here but this is a a system that moves from northwest to south east. even though we may end up with a, a little bit too light of an accumulation or moisture source through southern tear of the area and too much mild air believe it or in the for that snow to have a chance to stick, we are all going to see the cold air take over here and further north you go yeah, this is going to be something that slows you down here as typical morning drive

"eyewitness news" reporter jan carabao joins us from the the cbs-3 mobile weather lab in allentown, tracking the weather up there, good morning. >> reporter: we are in downtown allentown right now and snow has started to fall ever so slightly now heading in to downtown allentown. the roads are a bit wet this morning. snow just started to fall about a half an hour ago or so. the so this is what you will see in this area. so the snow, of course, isn't sticking at all just making the road wet. the temperature in the cbs-3 mobile weather lobbies right around the freezing mark 31 degrees right now. these road are well treated. they are in the slick at all at this point but temperature is below freezing. we did a brake check a couple minutes ago going up and hill and we're not slippery at this point. heading out and about early in the morning in this area, so

fin their investigation into the the robbery tip that brought both of those men together, yesterday after noon. while out for a walk at cobbs creek park wednesday afternoon a 67 year-old man, came face-to-face with a a would be robber. >> here's somebody running behind him, and as he turns around he see a masked man with a gunpointed at him saying give it up, give me all you got the. >> reporter: armed with what turned out to be a fake gun, upper darby police say the the robber demanded the 60 something hand over his valuables or die. then a surprise twist the victim was armed too with a very real, 38 caliber handgun. he opened fire striking the the man he thought might take his life. >> it the is a shame somebody had to die but at the end of the the day the bad guy pulled a stick up and lost. >> reporter: victim has a concealed weapons permit and taken to the hospital complaining of the chest pain. the attacker believed to be a teen was dead of a single will

gunshot wound to the head. >> if he was really shook up, really upset and i told him point blank. i said you did what you had to do. as far as i'm concerned i dent see any criminal charges. >> reporter: criminal charges will be up to the d.a. to decide this morning. we are also awaiting the the official release of the names of the victim as well as would be robber in this case. that is due out some point this morning. we are also told that would be robber was found with several cell phones on him all likely stolen. we are live from upper darby this morning i'm justin finch for cbs-3 "eyewitness news". federal investigators are gathering more evidence from tuesday night's deadly crash between a commuter train and suv in new york. they will examine data recorders of the train and crossing gate to figure out why that suv was stopped on the tracks. "eyewitness news" reporter nicole brewer joins us with the latest on that. >> reporter: good morning to you,er contact there are so many questions surrounding this incident but investigators believe the suv

was boxed in on top of the tracks between lettered crossing gates when that crash occurred, killing six people. the the driver 49 year-old ellen brody, a mother of three, had been diverted from an accident when he stopped on the tracks and was hit by that train. the impact was so powerful it peeled away electrified third rail, setting the the suv and train on fire. it is worst accident in the the history of new york met the tremendous north serving as a reminder to obey signals and bandon your vehicle if it stalls or gets the stuck in the track. >> really you should run in the direction that train is coming from because he is running in the opposite direction that train will hit the car and propel that car towards you. >> reporter: when you are on that train where is the the most safe place to sit? experts say nothing is full proof but historically you should take an aisle seat over a window seat and generally speaking in the middle of the carries more safe then either of the end, ukee. >> nicole, thank you for that.

happening today the owners of the former revel casino in atlantic city are trying to keep the lights on. federal bankruptcy court judge may deciding whether the the power plant can stop providing electricity, heat and water to the building starting this evening. ac r energy is in a dispute with revel over unpaid fees and debt from the construction of the plant. a toms river father is heading to prison today after his four year-old son killed a neighbor. anthony senator's son found a rifle in his father's bedroom in 2013 and he used to it kill six year-old brandon holt. he cut a deal with the prosecutors that will send him to prison for three years. he also had to give up all of his guns. the the cbs-3 i team has learned two philadelphia police officers are expect to surround they are morning to face criminal charges. sources a say officers are expect to face assault charges for allegedly using excessive force while arresting a suspect. that man was persued by the the two officers before being

we have an update on a story that had a lot of people talking. lower merion's township police superintendent says officers act add pope eighthly when they detain men shoveling snow. this picture taken last week sparks debate over racial profiling, police say however two groups violated an ordinance requiring a permit to solicit door to door. investigators also say one man had a possible warrant. police made no arrests and issued no citations. >> the investigating officer had had reasonable suspicion to conduct an investigation stop of these five adult males for violation of a township code. >> lower merion gives you 30 hours to shovel your sidewalk. everybody was out shoveling sidewalks but they only stopped black men in the white community. that is racial profiling. >> lower merion officials are

a teenager is a accused of master minding a facebook extortion plot in the poconos. authorities in monroe county says the the suspect posed as a girl and trick dozens of boys into sharing nude pictures of themselves. the 14 year-old is a student at mount pocono west junior high school. now police say if the victim initially sent photos and then refused to send more the suspect would threaten to post the originals on line. >> it just makes you wonder what the other parent are doing in regards to monitoring their kid. >> this is first time i have ever encountered a child pretending to be a different child in order to access other victims. >> they offered gift card in exchange for nude photos. he is charged with theft by extortion, transmission of sexually explicit images and solicitation. bridgeton police are investigating a second home invasion in four days. police say two men forced their way on to wayne road tuesday night injuring a 74 year-old woman and then left

5:23. katie, we're talking snow but it is cold and wind you are highlighting this morning. >> absolutely, this will be a snow event that is just lackluster for snow lovers you will not see it on there and a lot of you through southern half of the area may not see anything. maybe a few flakes flying and that is it. you can see where we have snow falling at currently as we expect to do the best here, up through lehigh valley poconos, lancaster berks county but what do you need to know with that light snow it will reduce your visibility. we have seen signs throughout the region. coating to a inch up through
