now, david. >> reporter: chris, detectives are talking to that 13 year-old and his parents to try to find out the how he brought drugs to school. three, eight years old also involved. we know this is right across the street and there are several of the signs in this area near the school drug free school zone. police say these kid could have died. >> they could have died from them drugs, you know that is crazy. >> reporter: grandmother valerie says she's angry a 13 year-old brought crack cocaine in an elementary school and angry that a eight year-old sniffed the drug according to police. >> very shocking yes, it is. just terrible. >> reporter: other parents rushed their kid out of the school when they heard the news. >> i think it is wrong. nobody should do that. nobody should do that take care of your kid. >> reporter: detective were on scene after an eight year-old went to the front office. >> the child did the right thing and spoke to an administrator, information the administrator that another student had it and then we were able to take action. >> reporter: police say they

found 16 packets inside a school bathroom specifically a toilet. >> crack cocaine was very addictive in nature. cocaine, these are young kid. >> reporter: lieutenant john walker with the philadelphia police say the the 13 year-old gave an eight year-old a packet and told him to hold on to it until after school and wow pay him $7. the student broad the drugs to two other, eight year-old, one of them sniffed the cocaine according to police. three, eight year-old and 13 year-old who brought the cocaine in the building went to the hospital as a precaution. >> i can't imagine how if it was my child od or was snorting or whatever they were doing with it. >> reporter: parent and dwayne evans said he is worried about what today's discovery means for the the future. >> we will be drug testing elementary school kid. the it is just sad. >> reporter: police say all four kid are supposed to be okay and expect to be okay. i should say no word on charges of the students or any of the parents. police continue their questioning, tonight. the we are live from southwest

philadelphia, david spunt for cbs-3 "eyewitness news". well, two philadelphia police officers fine themselves on the wrong side of the law both charged with assault after surveillance video allegedly captured them beating a man. the iteam broke this story last night and our investigative reporter walt hunter joins us live at philadelphia police headquarters with more walt. >> reporter: are officers awaiting arraignment after surrendering this morning but district attorney seth williams says it is a scary thing about this case is if it hadn't been for surveillance video that was uncovered by the girl friend of the alleged victim, none of the evidence found by the grand jury might ever have been found at all. >> what they did was totally inappropriate and improper and in violation of any policy training or anything period. >> reporter: police commissioner charles ramsey condemn at alleged actions of 25th district police officers kevin robinson and sean mcknight, now accused of

beating an innocent man, 23 year-old najee riveria have after he sped away on his motor scooter when they stopped him near sixth and lehigh in may 2013. >> they hit him in the head. he fell off his scooter. he was arriving in pain. they began beating him. >> reporter: in,ly riveria was arrested for assaulting the officer. but surveillance video from the block uncovered by riveria's girlfriend, led a grand jury to conclude that the officer did the attacking. >> it was wrong. even if he had been the devil himself they could not have done what they did to him when they stopped him. >> it is unfortunate that a well respected veteran of the philadelphia police kept is now facing criminal charges for simply doing his job. >> reporter: defense attorneys for the office are claim they have impeccable record and acted properly in this world when people flee and they try to keep themselves from getting a rested sometimes officers using for create injuries. it is them doing business.

>> reporter: now the the police commissioner who has had department experimenting with office are wearing body cameras said in this case body cameras were worn the evidence that took more than a year and a half to come to light, might have come to light, immediately. and, much of this would have been found out, much sooner. live at police headquarters i'm walt hunter, cbs-3 "eyewitness news". >> walt, thank you. sources tell "eyewitness news" that seven male fire fighters being investigated for on duty sex with the female member have been notified by top officials, that they violated department policy and will face disciplinary action. the iteam first broke this story. an attorney for the the female member who is not under investigation decline comment. fire fighters union has scheduled a press conference for tomorrow morning to talk about this investigation which was conduct by the philadelphia inspector general's office. sources say that the seven members cited for righting department policies now have the option of accepting

discipline or requesting administrative hearings. cold weather returns as an arctic blaze invade the region. "eyewitness news" in center city philadelphia where folks bundle up to to whatever they could to keep warm. that wind is making things feel a lot colder then it really is. meteorologist kathy orr is feeling that wind for herself outside on the cbs-3 skies deck with the big drop in temperatures kathy. >> those temperatures will be falling fast tonight chris. wind will relax overnight but with clear skies it is going to be frigid. we do actually have have a wind advisory, a wind chill advisory ine fact for poconos for those wind chills going well below zero. take a look at storm scan three we have clear skies and that will help these temperature fall current wind sustained in philadelphia at 23 miles an hour. we have 21 miles an hour sustain wind in wilmington, dover, millville and wildwood. that is a cold wind for us. the's are wild.

warrant, wednesday. they found ingredient and equipment to make that drug. all three now face several drug charges. new information tonight about this deadly shooting at cobbs creek park in upper darby. the victim for the back turning the tables and shooting a suspect dead. "eyewitness news" reporter cleve bryan has the the latest on the investigation. >> he didn't go out for a walk and say i will shoot somebody. >> reporter: michael chitwood says he has had several conversations with the 67 year-old man who turned the tables and killed an attempted robber, in cobbs creek park. >> he was very are remorseful and wish it hadn't have happened. i think myself and other detective told him you did nothing wrong. >> reporter: police say 18 year old tyler williams from west philadelphia tried to rob the victim using a metal pellet gun that looked like a semiautomatic pistol. after struggling with williams the 67 year-old took out his own 38 caliber and shot williams in the the hit. chitwood says the man has a concealed weapon permit and he

has no problem with more law abiding citizens doing the same. >> i think in this day and age you, as an individual should make that decision as long as you do it appropriately, if you want to do that i support that hundred percent. >> reporter: christine whose family lives next to cobbs creek park says wednesday's sit the ways makes a strong case for conceal weapons. >> i'm not against it, i'm for it. some people cannot defend themselves except for a gun. >> reporter: sixty-seven year-old victim did not want to speak on camera. he lives near cobbs creek park and still afraid for his safety. williams family decline to speak. in upper darby, cleve bryan, cbs-3 "eyewitness news". cleve, thank you. authorities made an arrest in the burglary spree in montgomery and delaware counties. megan gallwell ryan nelson kevin, were all arraigned today. investigators say they sold copper piping and other items from at least ten unoccupied homes. fires were also set in some of those homes. these suspects are now being held on a million-dollar bail

each. a philadelphia city councilman wants bars and other places serving alcohol to be required to have a exterior surveillance cameras in order to help authorities. councilman curtis jones, junior plans to introduce that legislation next thursday and in response to the the disappearance and death of west chester university student shane montgomery last november. jones says that karen montgomery montgomery's mom reached out to suggest that legislation, in order to help authorities if a patron goes missing. >> we want to try to look at how we can connect in a volume will try matter, but, in cases where, businesses have violations even mandate cameras outside of the business, so that people don't have to go through what miss montgomery went through. >> kildares irish pub that bar where montgomery was last seen alive did not have working cameras outside the night montgomery disappeared. kildares had no comment on the the new proposed legislation. other bars in manayunk like goat's beard have already
