era's daddies devastated over the loss of his son. >> beside being his friend and a father. >> reporter: police say becker's friend ivan overhalter thought the gun he had was not loaded. he was with the becker in the third floor bedroom playing with the handgun. >> he took the the clip out. he thought that there were no more bullet but there was one still in the chamber. >> reporter: but the gun went off hitting becker once in the stomach at 3c thursday afternoon. his father shared with us some of the time word he shared with his son the night before he died. >> something we did every night when we went to bed, would i go in his room, i would say i love you. he said i love you dad. >> reporter: kensington went to kensington for creative arts and perform center high school and because of the snowstorm they were home from school on thursday and police say overhalter found a gun on the street near his home a couple of days prior. >> he had a lot of remorse and he was very upset that his friend got killed. >> reporter: when becker was rushed to hahnemann university hospital his dad had hopes that his son would be able to

pull through. >> when i came in and seen my girlfriend, like a mother to him for 15 years, hysterical, crying and the doctor in there and i knew he didn't make it. >> reporter: now, becker was pronounced dead at the hospital thursday evening, in the meantime the suspect remains locked up behind bars tonight. reporting live tonight from police headquarters in center city, todd quinones for cbs-3 "eyewitness news". >> todd, thank you. breaking news right now trial of the philadelphia priest accused of sex abuse ends with a hung jury. reverend andrew mccormack was charged in the 1997 assault of the ten year-old boy at brideberg rectory where he live. the jury deliberated for three days. mccormack has been on administrative leave from the philadelphia a archdiocese since 2011. also a car slams in the house in chester, delaware county. you can see that car being towed away. we're told three people were

injured, two adult and a child no word on the extent of those injuries though. we do know it had happened in the 1100 block of concord avenue. we're working to get more information. the search continues off the the coast of florida where a military helicopter crashed last night. human remains and pieces of the wreckage have washed a shore. that crash happened during a night training mission at eglin air force base. military officials say that helicopter went down on a remote beach between pensacola and destine. cbs news correspondent craig boswell has the latest on the search. >> reporter: searchers are looking for remains of the 11 service members after their black hawk helicopter crashed tuesday night during a training exercise off the florida coast. >> we've got ground crews that are going up and down the shoreline and they are looking for any signs of the accident. >> reporter: seven marines and four army national guard crew members were on board the black hawk the the national weather service had issued a dense fog advisory visibility was 2 miles or less at the

time of the crash. >> we're being somewhat hampered by the fog, so it is difficult and slow going, but we're persistent and we will keep at it. >> reporter: crash happened during a nighttime training exercise near eglin air force base. >> there were two helicopters that were on a mission, one of them, started to take off and then realized, i guess that the weather was a condition and came back. >> reporter: marines on board were camp lejeune in north carolina a the air crew was from a army national guard in hammond, lou san average the entire crew had several thousands hours of operation flying the black hawk. >> reporter: the pentagon is tolding the names of the victims in order to notify family members. craig boswell for cbs-3 "eyewitness news". well, philadelphia police are asking for your help as they look for suspects wanted in three commercial robberies from the 19th district. take a look at surveillance video of these suspects in action. police say that he they had jim's steaks on north 62nd

barely 50 minutes but it is hard to imagine 50 minutes that could possibly have been more crucial than these 50 minutes to the the personal life and professional life of attorney general kathleen kane. >> do you have any thoughts this morning as you come in here. >> unaudible. >> reporter: attorney general kathleen kane expressed optimism as she arrived for a pennsylvania supreme court hearing that could have a huge impact on her future. kane's attorney hoping to convince a five judge panel that a grand jury which recommended criminal charges a against her for allegedly leaking confidential document from another 2009 grand jury and the special prosecutor thomas carlu ceo who led that investigation were both improperly appointed. >> after all this investigation was b it was not motivated by anything other than the truth. >> reporter: he argued that the investigation leading to the recommendation of criminal charges of perjury, false

swearing obstruction, official suppression and criminal content was completely legal telling justices get because the attorney general doesn't like the results of an investigation, she wants to quash it. following 50 minutes of oral arguments by attorneys inside a fourth floor courtroom kane emerged from the court's office. >> i'm grateful that the court took the time to listen to this important case for me and pennsylvania. >> reporter: if the justices find that the special prosecutor and grand jury weren't legal it would be up to be montgomery county district attorney risa vetri furhman to make the final decision on whether any of the charges recommended by the the grand jury will, in fact, be mild against kane. >> are you concerned about the criminal charges and possibility of them. >> i will not have any further comment. >> reporter: it could be weeks, perhaps months, before that ruling comes in, coming up at 6:00 we will talk to a legal expert about some of the factors that may well go into that decision. we will see you at 6:00.

some developing news this afternoon a swat team responded to the miami beach mansion of the rapper lil wayne today after receiving a call that four people had been shot there but investigators now believe the incident was a prank swatting call, swatting involves making a hoax phone call to 911 to draw a response from swat team to a certain home. we are toll lil wayne was okay and not at that home at the time. new information about september's papal visit and world meeting of families. it has been designated a national security event, that means secret service, home land security and fbi will be deployed to philadelphia that

taken into custody. we are told that no one was injured. a truck driver was hurt after colliding with another truck on the new jersey turnpike. a chopper three was over the crash scene this morning near exit number five in mount laurel. we're told that driver did suffer minor injuries, what caused that crash is under investigation. and it is nice to see sunshine out here on the schuylkill expressway at only 5:16 and good thing about today you can roll your windows down stuck in traffic on the schuylkill expressway heading westbound in the king of prussia area we can see a slow go there over on the ben franklin bridge all lanes opened and definitely moving nicely n real volleys for the entire length of the bridge but just at the even of the mouth of the bridge heading westbound into philadelphia all lanes opened into new jersey, looking fine there as well. there is a police investigation out in el k the ton delaware on route 213 between frenchtown road and

the investigation. >> reporter: in this cbs two exclusive video one man pulls out a gun and shoots another man inside a downtown brooklyn subway station. we are freezing moment at the shot that the shot is fired. that is when we pick it up you can see other subway riders run frantically. sources tell cbs two is gunman is retired corrections officer. man shot in the video later died of his injuries. it happened around 6:45 tuesday night while the the boro hall you been way station was crowded with commuters. witnesses say gunman was arguing with the victim inside a number four trains. argument

"eyewitness news" new jersey reporter cleve bryan spoke today with some co-workers and

residents. >> that is crazy. >> crazy. >> reporter: surprise, confusion, and difficulties a appointment after atlantic city puts fire chief dennis brooks on administrative leave for alleged sexual a harassment of the city worker. accord together letter from the worker's attorney march 5th chief brooks entered the public safety building and security attendant asked him to remove any metal objects from his pockets. brooks then dropped his pants exposing his underwear and said i'm having a bad day. >> if you do that in the first place, that is just disrespectful to that female. yes, it is. >> it was distasteful act that she had to experience and in one should be forced to face something like that. >> reporter: brooks is on paid leave with an investigation underway. he had has been with the fire department for 36 years. co-workers didn't want to talk about brooks situation. >> i cannot comment on that. >> reporter: can't comment on that. >> sorry, unfortunately i can't. >> reporter: there is a lawsuit, workers attorney

asking for video surveillance of the incident and wants to see how the city handles brooks. >> it is always about respect and that is most important when you hold a high office, people are always looking to to you as leadership and leadership has to set the example. >> reporter: we were unable to reach chief brooks for comment and city hall says they cannot talk about an ongoing investigation. there is no time when or if chief brooks will be back at work. in atlantic city chief brian cbs-3 "eyewitness news". former university of oklahoma a fraternity member is apologizing for his part in a racist chant that was captured on video. as are the the parents of the second student. they issued their apologies after they were expelled from the university of oklahoma a. former sae member parker rice issued a statement saying that his actions were likely quote fueled by alcohol and he also said that the song was taught. parents of levi petit said their son made a horrible mistake and will live with the consequences forever.

unusual protest today at the the university of oak a several campus statues had their mouths taped over with duct tape. some of those statues had the word unheard written over the tape. unheard is the name of the campus group that was among the first to receive video of sigma alpha epsilon and its racist chant. it is not clear if that group had anything to do with this protest. a michigan freeway remains shut down following this tanker fire. eyewitnesses say the tanker and two other vehicles crashed and immediately purse into flames. the crash happened this morning on i94 in dearborn several people say their nearby buildings shook. it took fire fighters about two hours to bring the fire under control, two people had to be taken to the hospital with minor injuries. cbs-3 is on the pothole patrol across the region and road crews are looking to smooth out your ride. philadelphia streets department very busy in the northeast, crews patched up two holes at corner of

foulkerod and ramona a avenue just off the boulevard. then another two down foulkerod. each cost $22 to fill. >> we probably had about maybe a 150 potholes a day. a lot of water is getting underneath the asphalt, freezing and popping it up. a a lot of times the the same problem happens every winter but with this winter we just never had any warm spell to do any evaporation. >> they are using electronic science to warn drivers of pothole repairs in south jersey and to reduce speed through work zones. you can join the cbs-3 pothole patrol by sending us photos and videos of potholes you see out there. there ara lot of them. share them on facebook twitter, instagram just use hash tag cbs-3 path hole patrol and we will get you answer about when repairs will begin. 5:37. we have a disable bus outside on the roosevelt boulevard right around neshaminy in the

southbound lanes. you can see there is police activity on the scene here as well. he seems to be pulling out of the way right now. the bus has been pushed off in the right-hand shoulder. just a few moments ago it was blocking out this right-hand lane a allowing one lane to get by there will be backup and delay, residual delays, due to that but fortunately all lanes get by right now. on i-95 around cottman avenue slow go in the southbound lanes heading in to center city. north bound doing just fine. a police investigation acted out in elkton, delaware room. 213 and frenchtown road and north williams road, that is blocking out all lanes there on 42 westbound. on ramp from route 29, there is an accident pushed in the shoulder. another accident on i-95 southbound in the shoulder a at route 141. disabled vehicle in new jersey on the northbound lanes, at rancocas woods blocking out the left-hand lane. we have good news for mass transit, septa, new jersey transit and patco speed line are running on time with no reported delays. chris and jessica, back over to you.

tech girls encourages young woman to pursue careers in tech nothing is teaming up with drexel university. "eyewitness news" reporter nicole brewer has more on their partnership. >> reporter: at drexel university this may look like your typical computer class but come a little closer and you will see these girls are gaming, test launching a game design curriculum for schools and students nationwide. >> our hope is to have more and more young girls and women and young women interested in going in the tech industry in, my case the gaming strit. >> reporter: that is what digital media professor doctor frankly, teamed up with tech girls a program giving middle abe high school age students hand on experience with technology. >> is there gaming, programming, robotics and so many other pieces of technology that are happening today. it is important part of future

right now at 6:00 o'clock a 17 year-old boy is now facing murder charges. police say the gun he was playing with went off and shot his friend. police say those two teenagers were hanging out during a snow storm when that tragedy happened. good evening i'm chris may. i'm jessica dean. tonight, the victim's father is talking to eyewitness naus about his son and moment that he received the painful news. the shooting happened inside a home on susquehanna avenue in kensington. "eyewitness news" reporter todd quinones is live at police headquarters with the this story, todd. >> reporter: and jessica police hearsay that the 17 year-old suspect will be charged as an adult. seventeen year old james becker loved basketball and all things sports related. he was shot here thursday afternoon inside of the third floor of his friend's house in kensington. at the time becker's own dad
