more serious injuries this morning. now there is officer was shot in the arm taken to the hospital. we're told he will recover. he will be okay. as far as the suspect in the shooting goes, he was taken to hahnemann university hospital. no update this morning on his condition. take a look at the video this shooting unfolded, just around 10:00 last night in west philadelphia, near the intersection of 52nd and master street. police say officer daniel kostick with the 19th police district assigned to bike patrol. he and his partners were first in the area of wilton street and girard avenue, checking on a man inside the van for possible narcotics violations, police say when they approached the suspect back up and made a u-turn. police officers followed him but eventually lost him. then officer kostick found the man near 52nd and master. police say they were having a discussion when the suspect says quote, i don't want to have to do this, and then opens fire. officer kostick shot in the arm, returned fire, suspect found injured in the 5,000 block of master street.

>> he is in good spirit. i asked him if i could say that, he said absolutely. he is here with his family right now. we are just very, very lucky he is very lung i given the circumstances, obviously we do not know what was on this guy's mind, to have someone say something like that is highly unusual and then to fire the police officer like that, it just makes you wonder. >> again commissioner deputy commissioner there talking about officer kostick how he is doing this morning. we are told he is in good spirits, again, he will recover. as far as the suspect goes in the case again at university hahnemann university hospital, we are not updated on his condition yet this morning, it is still a developing story just as soon as we get more information, we will bring it straight to you. for now reporting live outside police headquarters, jan carabeo, cbs-3, "eyewitness news". >> jan, thank if you. let's get to developing news right now. philadelphia police are investigating a deadly crash and the shooting of a delivery man. with the latest information justin, good morning. >> erika, good morning, police believe that man may have been trying to escape a gun attack, they say he lost control of his car near adams avenue, bingham street, crashing up the hill here, knocking down, also knocking down an electrical pole up there at the top of the hill. let's take to you video now police say the driver is a 49 year old man, he is likely chinese food delivery man who may have been making a delivery, on the 500 block of hill creek park. they say at some point in that delivery, he may have been approached by someone or some people, and shots were fired, at least, 12 shots were fired near that scene by a semiautomatic weapon from there, the driver is said to have made a run for it, speeding away, and losing control here on adams avenue. take a listen to what police have to say. >> we believe he was making a delivery to one of the properties and the hill creek homes. because we found 12 spent

shell casings in the 500 block every hill creek park. also found a broken window which we believe was the glass from the driver door window. that the victim was in. also broken glass found inside of the toyota corolla along with the victim, taken to einstein medical center where he was pronounced dead short time later. of course homicide detective are on this case at the hill creek park site as well as here on adams avenue, scene still being held several hours after that driver passed away in this crash. his name has not yet been released. also no word yet on suspect or motive. live here in crescentville justin finch cbs-3 "eyewitness news". >> justin, thank you. right now 5:33, we want to check in with katie. at least a brighter day flight. >> exactly. should be hint milder than yesterday was. so still going to be 11 degrees below average. but we do expect to see temperatures ease up a little bit. still stuck in the mid 50's,

however, and it is still courtesy of the persistent northwest push of chillier air, that is just getting funneled into the region. we take you outside, you can tell that, just by looking at the streaks of yep lake enhanced snow. most of which is having difficult time reaching the grounds at this point. but yes snow has been a theme across central and western pa for two days straight, for us thankfully it has not. but we are expect to go see these clouds currently in place, break and yield for more sunshine. that said, right now we still have a freeze warning in effect across basically the northwest half of our area, freeze watches basically everywhere else, say for philadelphia county, delco cape may county, then delaware state. everybody else is in some type of watch or warning though but temperatures even into tomorrow morning going to once again bottom out under clearing sky. so, just keep it in mine, especially since the wind has continued to blow, that you protect those sensitive plants and veg takes that you put all of the hard work into to guard it in the last couple of weeks. current wind speeds sustained breezy obviously out of the

25th anniversary of the hubble space telescope giving us dramatic new look at our universe. nasa scientists doctor mark clamp joins us now live from the goddard space flight center in maryland, good morning, how are you,er? >> good morning i'm fine, how are you? >> great watch are some of the biggest lessons most important lessons we have learned from hubble? >> so, hubble taught us a lot of housing about the universe. everything we observe with hubble, you know, teaches us something new. so we have learned that the expanding universe is actually satellite, unseen force of dark energy, we have been able to see back to about a billion years after the big bang. and closer to home we've been table see that pluto, for instance has five moons. so hubble spans whole range of discoveries across the universe. >> incredible. now do you think 25 years ago scientists had any idea all that they've learned from this telescope?

unfortunately we have an accident situation on the schuylkill expressway, and since we're so close to the start of where rush hour usually starts to develop i just don't have a good feeling about this. this is the schuylkill expressway westbound. as you make your way around the area of gladwynn, more so beyond gladwynn, as you head toward the stretch of conshohocken, but it is blocking the right-hand lane. only allowing one lane of traffic to get on by. definitely an active scene but again you want to stay with us, we'll definately see how this will affect rush hour when we come

testimony in the sentencing phase of the marathon bombing resumes monday when the defense makes its kay for life in press o prosecution rested its case yesterday against tsarnaev, accused in the bomb that claimed three lives and injured hundreds of people. the jury heard from those victims yesterday, in heart breaking and vivid detail. many of the victims suffer serious injuries, including the loss of limbs. we'll be right back.
