with murder in the 2013 death of his elderly father. investigators say that the son failed to provide around the clock care which ultimately led to his father's death. our alexandria hoff is live in west chester with more on some shocking allegations tonight, alex? >> reporter: thank you chris. according to prosecutors victim was 50-pound lighter after two years in his son's care. they say he suffered a more painful death because he did not go to the doctor or any of his required prescriptions. world war two veteran eduardo brian, junior was laid to rest next to his late wife september 8th, 2013. >> this is a case of life lived with honor but a death that had in dignity in it. >> reporter: according to court document o'brien was 90 when doctors deemed him in need of 24 hour acute care. his son eduardo brian the third told investigators he returned his father to new jersey where his father lived alone. during a welfare check his son

was told he needed to get his father care. >> son's response was not to go out and get medical care, the the son's response was to take his father, out of new jersey, where he knew he was under scrutiny, and take him over to the son's residents in west white land township chester county. >> reporter: that is where he stayed for nearly two years until his son called police and said his father had died. >> he was covered in bed sores, he was covered with few man waste. he had died from neglect. >> i got the to see his dad a few times but past that i don't, it is a shock. >> reporter: did you know that the father was being cared for. >> yes, i definitely did. >> reporter: neighbor was echoed in the statement provided bio brian's attorney who told us in 2011 and 91 year-old father asked and to spare him death by nursing home and had agreed, but district attorney tom hogan notes that during that time $30,000 was taken out of the

father's account and put into his son's. now, the district attorney tells me that as a veteran there were numerous options for low cost care right here in the community but this but the attorney for o'brien says that his client's father was exactly where he wanted to be and that the care was very good. reporting live from chester county alexandria hoff for cbs-3 "eyewitness news". >> alex, thank you. maryland's governor said baltimore has turn a corner as the city prepares for a second night of curfew. we will look at the the latest. authorities have made 35 arrests since the curfew was imposed tuesday night. pennsylvania is sending 300 state troop tours baltimore in the coming days to help with peace keeping efforts. and the orioles faced the white socks in a empty camden yard this afternoon. fans were not admitted because of safety concerns. this was the first ever major league baseball game closed to the public. cbs news correspondent craig boswell tells us that baltimore is slowly getting

back to normal what do we want. >> justice. >> reporter: demonstrators in baltimore held a peaceful protest in support of the freddie gray who died from than a unexplained spinal injury in police custody. after days of unrest, there is still a heavy police presence on the streets but many residents are going about their business. >> violence is not the way. it is unreal how this just happened. >> reporter: schools reopened and baltimore orioles returned to action but in the interest of safety, no fans were allowed in the stadium. the governor hopes violence is over but says that the national guard state troopers and police will continue to keep watch. >> is there still some raw emotions out there still some frustration and we're just going to make sure that we can continue to maintain peace in the city. >> police are expected to hand over results of the investigation in the death of freddie gray on friday to the state attorney general. many here want an official explanation. >> we still don't know why freddie gray was arrested. we still don't know this.

>> reporter: baltimore symphony tried to do its part to relieve tension in the city. the orchestra gave a free outdoor concert at lunchtime. craig boswell for cbs-3 "eyewitness news". governor tom wolf says 300 pennsylvania state troopers will arrive to help authorities in baltimore this weekend. short time ago i asked governor his thoughts on the questions raised about maryland's decision to send national guard troops into baltimore. >> i will not second guess the the actions of somebody in a situation, i'm just not as familiar with. i don't know how i would have handled that particular situation. >> reporter: as we look the at that incident, do you think there are any lessons for other states around the country, pennsylvania included. >> i think we ought to do everything we can to make sure that as i said throughout my campaign, i want a level playing field. i want a society that works an economy that works with everybody, all pennsylvanians and i think we need to continue to work for that.

that is how democracy works. >> keep it right here on cbs-3 for latest on the response to the riots in baltimore. you can get information anytime at cbs philly.com. the the the mother of the brandon tait-brown has filed a wrongful death lawsuit in her son's death. tanya brown dickerson says philadelphia police officers lied about her son reaching for a gun. he was shot and killed by police during a traffic stop in mayfair in december. the suit names the city, and two philadelphia police officers as defendants. it seeks monetary damages and reforms within the department. >> i believe with all my heart that my son's rights were violated brutally and severely. i believe he was not given a chance and i want reform. i want laws changed. that is why i'm standing here. >> reporter: neither police nor officials from city hall have commented on this lawsuit. the d.a.'s office did investigate this and it result

"eyewitness news" reporter walt hunter is live with the details, walt? >> reporter: that conference was actually planned quite a while ago, but when it opened right here in center city this afternoon and when speakers began talking as you well imagine, the violence in baltimore moved to the top of the list of topics. behind the smiles of comradery as mayor michael nutter greeted mayors and leaders from 40 cities nationwide opening their conference here, a deepening sense of concern. >> what happened in baltimore unexplained death of the man in police custody escalating through protests and violence, could occur in any of their cities a at any moment. >> all of us as mayors understand that they are there for grace of god. >> until we address the the issues that might be contributing to people's frustration we will see more of this unfortunately. >> reporter: these leaders members of the cities united, launched four year ago by nutter and mayor of new
