>> breaking now at 11 peaceful protestprotests turn heated. demonstrators and police clash in the wake of the death of fred did he gray. let's take live from chopper three over central detectives to night a couple hundred at times very vocal protesters gather the to make sure their voices are heard. things are peaceful now but they took a turn as protesters went face to face with police. good evening i'm jessica dean. >> i'm chris may. chopper thee was overhead tonight as though protesters surged toward a wall of officers all this happened at broad and 59 around 8:00 o'clock about four hours after the demonstration began. two people have been arrested so far. "eyewitness news" reporter david punter is live at police headquarters to bring us up to date. david? >> reporter: chris jessica here at police headquarters detectives and officers are ready for anything. they say at one point they expected the demonstrators to come here right now they actually have swat vehicle behind me just here just in case but at this point they say it's not been necessary.

it started started out peaceful in front of city hall. about 600 protesters chanted for justice as police officers stood quietly. listening. >> this is a really big deal. deeply rooted in my heritage and my family and i think it's very important that we should all be out here. >> reporter: after about an hour the group split into two. one went south on broad. eventually make its way through rittenhouse square. the group chanted white silence is white consent for windows as people ate diner in restaurants. later the two groups met near 15 many and callowhill protesters tried to walk on to the vine street expressway but police closed it. just a few minutes later tensions erupted as police blocked the crowd. we spot add lot of pushing and shoving and caught this arrest on camera. minutes later officers moved and the group kept marching. with the same message. >> police and every state need to learn they serve black people just like white people.

>> a message protesters told "eyewitness news" they want to pass down to future generations. >> i'm out here for my son. i'm here for my kids because they got to grow up in this community. >> reporter: as night fell the group continued marching through the city. we spotted the crowd marching up broad street at 10:00 o'clock almost six hours after the demonstration began. before those demonstrations began at city hall police officers were actually read the first amendment just to make sure they understood the ground rules the fact that these demonstrator doctors have the right to express their thoughts, feelings frustrations, anger whatever you want to indicate, and police say that they are ready any time people want to express themselves. we are live at police headquarters, david spunt cbs3 "eyewitness news". >> okay, dave, thank you very much. right now, baltimore police are enforceing a curfew for a third consecutive night in that city. community leaders there are using bull horns telling protesters to go home. the overnight curfew has helped quite the streets of baltimore

after violent unrest this week left nearly 100 officers injured and led to dozens of arrests. the baltimore city police department today delivered its report in the death of freddie gray to the maryland state prosecutor's office a day earlier than expected. this investigation is not public however we have learned some new information. the transport van gray was in inside on the day of his arrest made a previously unreported stop before it arrive at the police. >> stop by our wagon was at freed montgomery and moser. >> washington post claims another prisoner inside the van could hear gray banking against the wall of that van. the post sites the police document in the prisoner believed gray was intentionally trying to injure himself but that prisoner now says that's not the case. at the request of maryland's governor new jersey state police will assist with peacekeeping efforts baltimore a little longer than first thought. the 150 troopers and personnel

chip kelly we just seems to be the overriding theme in these fans are just looking forward to the rest of the draft. we're live here at lincoln financial field tonight natasha brown cbs3 "eyewitness news". >> natasha, good to see spirit up there tonight. what do you think of the eagles pick of this wide receiver? should they have tried harder to trade mariota. was it even possible? tell us what you think. new tonight police are investigate a deadly shooting in montgomery counsel township. officers responding to domestic dispute found a man dead inside of the home on 800 block of karen court around 6:45 tonight. police say a woman was found outside the home suffering from a gunshot wound. right now she's in critical condition at the hospital of the university of pennsylvania. and that shooting is under investigation. a temple student is fighting for her life after a hit-and-run on campus. police say an 18-year-old man has confessed to being behind the wheel of the car that hit rachel hall.

the 22-year-old was riding her bike home when she was hit by a silver mitubishi gallant near mark and diamond. the suspect's father contacted police. >> young man had a permit so he told us he was afraid and he panicked and left. he did come clean today and give us all the details of the crash. >> police have not released the name of the that driver he does face charges of leaving the scene of an accident. baby is rescued after being flock a hot car. >> a camden police officer discover the five month old crying and sweating in a cvs parking at fifth street and mickle boulevard and that's when the officer broke a window with her baton to get that baby out of the car. she's being hailed a hero for her quick thinking actions. >> the lune said it's hot outside. so the baby was not okay. >> when the child' mother exited cvs she told officers she had only been in there a short time but that mother was taken into custody and is charged with child endangerment.

>> outlook remains bleak tonight for the south jersey homeowners force to do evacuation their home as their backyard falls into the delaware river. erosion wiped away a portion of the the o'dell family and their neighbor's backyard in florence township. they were all ordered to leave last week. but the o'dells say they're still simi trying to figure out who is responsible for fixing the problem. our new jersey reporter cleve bryan spoke with them today. >> reporter: what was it like coming back today. >> it wasn't easy. the not easy.

and spain. they paid the full 300 and $69 each for nothing. >> no trip existed. so this man took money from me knowing that he had canceled all the trips that we weren't flying out to barcelona. that we weren't getting on carnival cruise ship to sale the med did he rain yann. how disappointing would you be? >> reporter: is there a reason why you had to still those hard working people's money. hester plead guilty to theft admitting he stole more than $67,000 from the group. he was placed on probation and ordered to reimburse all of the victims with monthly payments. >> so these are his payments just to you? >> yes. >> is that right? >> yes. these are his payments. i received a total of $846 and some change. >> reporter: denise hall is still owed more than $2,500. but a year ago those checks stopped coming. >> his punishment was that you won't go to jail. you have to pay restitution. he hasn't paid res toy tying. >> reporter: hester said he

could no longer peso in february judge m christine allen jackson ordered him to list his gibbstown house and sale his mercedes-benz and gave him 30 days to do it but the i-team found the home which he claims is worth $260,000 was not listed with realtors. there was no for sale sign out front and hester even had two people renting rooms. as for that mercedes bense park right out front. >> that's crazy to me. >> the day he was due back in court earlier to month he'd upheld the judge's orders -- >> elliot hester? >> he didn't show. >> this process this is really sickening. we're going around and around in circles. >> victims are losing faith in the system. >> while the works pretty well fort criminal as far as the victim you lose. >> reporter: not only has hester been running from justice justice -- he's been running from the i-team, too. for days he evaded our cameras

and began parking blocks away where he didn't ex expect to fine us. let's have a civil conversation here. >> i'm not having civil conversation. >> why haven't you put your house up for sale? >> with that, hester got into the car he should have sold and shouldn't be driving. >> the i-team has learned hester' license has been suspend suspended since april of last year. we took our finding to the prosecution. >> he hasn't paid his restitution. he hasn't sold his house or his mercedes and he's driving on a suspend license. so what are you going to do about it? >> now that the judge has given him that chance and it is evident that he's not going to show up for court or pay the victims back, his last stop is now the door of the jail. so when he comes to court our office will strongly advocate that he needs to be sent to prison. >> reporter: well hester later said he missed that hearing two week ago because he was sick of the now he has another court date set for tomorrow. of course, i tomorrow will be and we'll let you know what

breezy that on shore flow will be very persistent during the day tomorrow. so expect a few more showers as well. for your friday talking about temperatures running about 10 degrees below average. northeast winds 15 to 20 miles an hour keeping a chill in the air and even a few scattered showers. the best chance to the north and west of philadelphia. after that, our storm system moves farther offshore we still have that northeasterly wind so a stray shower is not out of the question but temperatures do rise well into the 60s on saturday. so that's the better day. then it really improves sunday. feeling like the summer season more like june with mostly sunny skies and temperatures well into the 70s. so overnight tonight we're talking about clouds, breezy conditions that northeasterly wind persists it will be a cool seasonal night the low 48 degrees. during the day tomorrow, cloudy breezy a few scattered showers. that northeasterly wind kicks in 10 to 20. even gusting over 20 miles an hour the high temperature going for 61 degrees. as we go hour by hour, 8:00 a.m.

's a solid player. i've watched a lot of tape of agholor. he actually even though he's a bit smaller he reminds me style weiss of my good buddy mike quick. very graceful. he can cut on dime and almost prances into the end zone.

>> now merrill when you see this guy catch, do you think he replaces a desean jackson or does he -- did he sore like -- i know you said mike quick. but is he more like a um, you know like a jeremy maclin? >> yeah, i think he's very close to a jeremy maclin stylistic klee. maclin was very smooth. he had great speed. but not four-thee speed but fast enough. he's very similar to a maclin probably in size and the things that he does especially well. interestingly maclin came out of missouri he was a punt returner and that was never one of his real pluses here. but agholor is also a very gifted punt returner, and i think if they want to spell darrin sproles a little bit he may fit the bill in that regard, too. >> quickly merrill we did not get cuss mariota your thoughts

on the fact that he is in tennessee and apparently will stay in tennessee? >> beasley i never thought they were going to get marcus mariota mariota. i thought it was the most remote thing that could possibly happen. you simply cannot move from 20 down to two in a draft without giving the whole ranch. it would of too costly. chip praised the by saying it was like getting out of your car, looking at this very expensive house and realizing that there was no way you could afford it. he said it was never a serious thing. he contacted -- they contacted tennessee only yesterday but it never came close to being a deal deal. of course rumors central was out there and all kinds of sources were reporting that they were giving up about 14 players and number one draft choices through the year 2030 and somebody that was mike quick too too. >> merrill thank you very much. you are the best. of course, you know you can hear merrill call the eagles games on our sister station sports radio
