woman dead on a center city street. >> i'm jessica dean. >> i'm chris may. horrified tourists witnessed this accident today. it happened at 11th and arch in center city philadelphia. "eyewitness news" reporter diana rocco is is live at the scene with how witnesses describe exactly what they saw. diana? >> reporter: well, chris and jessica that 68-year-old victim and her husband were here visiting from texas. they were here for mother's day weekend and on their way back to their hotel when witnesses tell us tonight that that woman was distracteddistracted and she stepped into the street. that's when a duck boat struck and killed her. >> people was telling her to stop but sean paying attention. whatever she was into, she was night and it happened so fast. >> horror for a husband walking steps from his wife as she struck and killed by a duck boat boat. carrying 28 passengers. >> he heard his wife scream behind him then realized she had

been struck. >> reporter: it happened at 11th and arch streets just after 5:00 friday in front of the convention center one of center city's busiest intersections at the busiest time of day. a witness too shaken up to show her face talked to "eyewitness news". >> the duck boat was filled with people going by, talking they was going by like they usually do and sean paying attention and it just happened so quick. >> 68-year-old female was trapped underneath of the vehicle. medics pronounced her dead at 5:27 p.m. she has severe head trauma and also massive injuries to her body. >> reporter: chopper three overhead as the women is lying in the street. the duck boat had a green light and was heading west on arch street when the woman stepped in front of the boat. >> chaos. horrible incident. so terrible. >> reporter: police say the woman and her husband were tourists from texas on their way back to hilton garden inn where they were staying for mother's day weekend. the woman's husband is he is cored back into the hotel by police. he's still holding his wife's

purse. >> just horrible. my heart is breaking for this woman. i pray for her and console her family as best we can. >> reporter: it has been determined tonight that that 72-year-old driver of the tour boat is not at fault and charges will likely not be filed here. the ride the ducks organization has released a statement tonight saying their thoughts and prayers with the victim and her family and they have offered counseling to all the riders who were affected. we're live in center city tonight, diana rocco cbs3 "eyewitness news". >> terrible tragedy there diana, thank you very much. this is of course not the first deadly accident involveing a duck boat. back on july 7th of 2010, 2 hungarian students died when a barge being pushed by a tugboat capsized a duck boat on the delaware river. federal investigators say that the tugboat pilot was distracted by federal emergency and -- a family emergency rather and was on his cell phone just before that crash. a multi-million dollars settlement was reached in a

lawsuit over those deaths. a big break tonight in the investigation into a violent sex assault in philadelphia's fishtown neighborhood. the brother of the suspect is speaking out tonight urging him to surrender to police. "eyewitness news" reporter david spunt is live at the special victims unit with more on that. david? >> reporter: jessica detectives have been working here at svu for a week trying to locate this guy. meanwhile his older brother says even though his younger brother manuel cintrone is innocent, he says the best thing to do is just turn himself in. >> because my brother didn't do nothing like that. i know my brother didn't do that. >> reporter: but police say jose cintrone's younger brother manuel did abduct and sexually assault a 22-year-old woman in fishtown an hour after trying the same thing with another woman who got away. according to police sources victim told detectives 24-year-old manuel cintrone tried to attack her at 4:20 in the morning on friday may first. she told detectives she was walk walking down ruscomb street when

cintrone came up with a gun and said "let's go and don't do anything stupid or i'll shoot you in the head". the woman got away and called police. an hour later a 22-year-old was walking on east york street. she told police cintrone came up to her with a gun and said "do exactly what i say and i won't hurt you get into the van". police say this is the van scene in surveillance video. sources say the woman spent over an hour with cintrone where she was sexually assaulted. detectives say he dropped her off a few blocks away and backed up the van so she couldn't couldn't see his license plate. >> crazy. it's crazy the charges is serious you know what i mean? and i don't see my brother doing that. i really don't. >> reporter: after the woman called police, she gave a description of her attacker. and the police 67 looked like this. here it is next to cintrone's picture. we checked it. >> let them know. get your name cleared, you know, let them know you didn't do

nothing. that's it. >> reporter: we pulled manuel manuel's record in december 2011 he was charged with rape, sexual assault unlawful restraint and false imprisonment. one month later in january 2012 all of those charges were withdrawn for unknown reasons. if you have any information give police a call. we're live at svu tonight david spunt cbs3 "eyewitness news". david, thank you. one vote shy a judge declares a mistrial for the murder accused of of murders etan patz. we hear from that jury who wouldn't convict the man from maple shade. natasha brown on the decision that leaves one of the nation's most haunting missing children's cases unresolved. paid dough hernandez you know what you did. >> reporter: anger and frustration from the four women of the jury after 18 hours of deliberations a mistrial after one hold out juror who said he couldn't pedro hernandez guilty of killing etan patz beyond a reasonable doubt.

>> for me his confession was very bizarre. no matter how many times it happened. it got more and more bizarre and i feel that the initial confession there were lots of issues surrounding custody surrounding miranda rights. >> reporter: prosecutors say the maple shade, new jersey man who was arrested in 2012 confessed to strangling and killing six-year-old eight tan patz in new york in 1979. stan the patz his father spoke out for the first time since the trial started in january. >> etan was a beautiful out-going friendly curious little kid. he would have made a great adult. >> reporter: with the jury deadlocked prosecutors say they will retry this case. but defense attorneys for hernandez say they've had the wrong man the entire time. >> i would say that only a resolution if the correct man is held responsible and we firmly believe that pedro hernandez is not the right man. >> reporter: hernandez will remain locked up while the retrial process progresses.

prosecutors say they do plan to retrial this case. but will have a more definitive answer in june. live in the sat center tonight natasha brown cbs3 "eyewitness news". >> natasha, thank you very. u.s. attorney general loretta lynch launched into federal investigation into the baltimore police dem. the department of justice will look for patterns of discriminatory policing. things like the use of excessive force and improper arrest. this follows the in custody death of freddie gray which prompted violent protests in the city. siicers were charged last week in gray's death. new at 11:00 o'clock tonight, a special honor for the philadelphia police commissioner charles ramsay. his 46 years in law enforcement are recognized tonight by the national organization of black law enforcement executives. that group held its awards banquet tonight on penn's landing. mayor michael nutter was there

and praised the police commissioner and once again reiterateed his believe ramsay should stay on commissioner when the mayor leaves office. a small plain crash in atlanta kills all four people on board. that plane had just taken off from the airport before it crashed on to interstate 285. witnesses say the pilot was struggling to get the nose of that plane up and then it just dropped. the crash started intense fire on the busy georgia road but no one on the ground was hurt. another night of severe weather in the southern planes. check out this tornado video just in from hainesville, texas. other tornadoes were spotted in oklahoma and other parts of texas. wind gusts knocked down power lines near oklahoma city, and hail the size of golf and tennis balls was also spotted in other areas. a large brush fire in the wharton state forest is finally out tonight. crews were able to contain the fire in is a mom burlington county after it burned for more than 24 hours. that fire broke out near 206 in quakertown spanning 700 acres.

chopper three over the scene last night. you can see the large amount of smoke and flames. authorities aren't sure how this fire started but they say it was likely caused by humans. emotional day at temple university's graduation ceremony ceremony. >> the graduates there paid tribute to a classmate who was critically injured in a hit-and-run who could not walk with them today. the mother of rachel hall kathy was there and she accepted her daughter's degree on her behalf. you can see she received a standing ovation. rachel hall was critically injured last wednesday night while she rode her bike on the temple campus. >> i didn't know her but when i heard about her situation i felt really bad and i'm glad her mom came and i'm glad everyone stood up for her. >> she had the opportunity to have the support of all -- of everyone here. >> rachel is lacrosse player and is set to become a police officer in washington d.c. after graduation but again she's in critical condition tonight. the driver who reportedly confessed to hitting rachel,

>> shocking discovery made by spanish customs workers. they found an eight-year-old boy inside of a suitcase. an x-ray of that bag first revealed what officers believed to be a human silhouette and indeed it was. they say that a young woman smuggled that boy into spain from ivory coast. tonight she's facing charges. the child is okay. and is in the care of social services. update now to a story we first told you about last night mary lee the shark who showed up down the shore. the last few days she's been miles from the shore in brigantine and cape may. marine biologist marissa says shark attacks are about as likely as lightning strike. she thinks mary lee may be feed feeding on harbor seals in the area. >> these past few seasons we have had an influx of harbor seals on our shore lines in both atlantic county and cape may county. this could be one of the food sources that some of our larger sharks like to feed on. >> most likely answer is also

though the most obvious. sharks, of course, are all over the ocean. we're just paying more attention to this one mary lee. you can follow mary leon twitter. find out how by going to cbsphilly.com. well now to an incredible sight. helicopter just 40 feet over your head and it's your only ride to safety. our meteorologist kate bilo found out what this is like earlier in the week. she went out on the water with the coast guard to see how they perform a rescue at sea. >> reporter: off the shores of barnegat light in the atlantic ocean, coast guard men and women practice the art of survival. >> we do training situations like this all the time, because the real thing could happen right now. >> reporter: these swimming exercises take place every six months. guard members jump off 47-foot motor life boats. >> these 47s are self ride self bailing they can capsize and roll back over. if they don't come back up we end up in the water we all have to be able to use our pyrotechnics.

>> orange smoke pours out from the flares making it easier for crews to find them. now it's time for a rescue at sea much that's coast guard rescue swimmer david folic being lowered from the chopper. folic is no stranger to this. here he is rescuing a man from a fishing boat off lewes delaware in april. and he's getting me ready to be rescued by their helicopter mh65 dolphin. the chopper has to get 30 to 40 feet above the water. a trail line goes down first and here comes my ride. a 4-foot long steal basket capacity one adult. before my trip i get a quick lesson in basket safety. don't hang on. cross your arms in front of you. this is much easier said than done once this happens. the trip up to the chopper takes about 45 seconds. the coast guard in atlantic city

estimates it rescues people this way 20 times a year so practice is key. >> we do training missions like this all the time. so that the people from the boat crew know how to properly interact with the helicopter crew. so that if we need to hoist a survivor to get into the helicopter to get them to land as quickly as possible it's muscle memory reflect at that point. finally the basket is brought into the chopper. inside is is a pilot co-pilot and aviation maintenance technician. after a few minutes, i'm heading back down. >> that's adrenaline rush. >> the coast guard air station in atlantic city patrols the coast from connecticut to virginia conducting rescue missions involving everything from container ships to small sailboats and in all kinds of weather. >> when most people run away from mother nature we run out night. >> reporter: whether by sea or by air anything to complete these dangerous missions. >> you can see the coast guard up close yourself. there's a community festival happening at the training center

in cape may tomorrow. you can go on base, tour ships and see a live search and rescue demonstration. i don't think you can go up in the basket. they physical me that's something that 99% of the coast guard has never gotten to do. >> they were all jealous and i knew i was in the best possible hands. >> absolutely. >> when they're like don't hold on just cross your hands washington do you mean don't hold on? >> we're out in the middle of the ocean. it was crazy. >> incredible. >> incredible work they do, too. just nice to know you hope you never need it but if you do -- >> they were ideal condition that is you were in but like you said they do it all kinds of weather. they're incredibly courageous. >> yeah. they're talking about seas 25 to 30 feet and they're saying the seas are actually higher than the boat sometimes and they go out into these crazy storms and rescue people, and you know, these guys are really really brave. men and women of the coast guard i give them so many props after spending time with them the past couple of weeks. >> we are luke key to have them. >> you were very brave too. did you very well. >> thank you all i was a little nervous when that basket was shaking. hold on. >> i'm glad it's over but it w great. >> very well done.

grad you're in one piece. >> yes. >> let's take look at the weather for the weekend. mother's day race for the cure all kinds of things coming up. >> not too shaky this weekend. it will be a slam dunk looking at temperatures that are going to be very consistent over the weekend. highs in the 80s. but we are going to be seeing higher humidity something we haven't seen so far this spring. take a look outside where temperatures are fairly warm from the city to the shore. still in the 60s. live skycam3 is showing areas of fog in atlantic city and that's going to be an issue tonight and tomorrow morning. take look at storm scan3 because you can see our fog indicator. the forecast showing the fog already rolling in through south jersey and delaware. this is in real time. happening right now. we're looking at visibilities that be reduced come tonight and tomorrow morning. that's why there's a dense fog advisory in effect for south jersey and delaware for visibilities less than a quarter mile at times. please be aware of that if you're going out early tomorrow morning. right now in philadelphia 67. 60 in millville. 66 in the poconos. in allentown it is 71 degrees.

similar temperatures down the shore with on shore flow. ocean city 67. cape may 65. that mild moist air coming from the south. this is ana subtropical right now but it is going to be developing some tropical characteristics it has sustained winds at about 60 miles an hour so it is strengthened over the past 24 hours. it's going spread its moisture toward the north. i not expecting a lot of rain from this at all. but the moisture will create fog the next couple of mornings and we're also talking about increase in humidity. so let's take a look. during the overnight the fog continues to spread toward the north and east. by 6am visibility reduced to only .2 of a mile in reading. less than half a mile in many locations. six tenths in trenton, millville and atlantic city. and wildwood four terms of an inch or four tenches of a mile and then during the morning hours we see improvement in the visibility through most areas the poconos only half a mile visibility there. so with that moisture it will be more humid during the day on

saturday and during the day on sunday. for mother's day watch a front approach from the northwest but it will not be impacting our weather. by monday and tuesday a better chance of a scattered shower or a thunderstorm as the front drops towards the south and that area of low pressure spreads some of this moisture towards the north. we will be seeing some warm conditions. overnight the low 61. during the day tomorrow, partly sunny, 82. for mother' days looking good as well. if you're heading down the shore this weekend saturday and sunday highs in the 70s. after morning fog it will be very mess san. on the exclusive eyewitness wet seven day forecast, sunday 86. monday and tuesday upper 80s. but much cooler by wednesday feeling more like spring thursday 69. and by friday 71 which is average for this time of year. >> all right. looking good out there. looking very good for sunday and we hope you'll be joining the women of "eyewitness news" for the live coverage of the 25th anniversary of the susan g. komen race for the cure. 25 years now of saving lives and we are live on the air starting

dad vail regatta. these rowers come from more than 120 colleges and universities across the country and canada. regatta is the largest inter collegiate rogue event in the us and it is held right here in philadelphia every year. the philadelphia museum of art i look at its paintings without having to step into the museum. >> as part of new installation called inside out the museum is taking original paintings and turning them into high-quality reproductions that have are being placed outside. you can find the artwork in five communities across the region including two here in philadelphia. the paintings will stay outside for three months. then five more neighborhoods will get a turn. keep your eyes peeled. we'll be right back.
