>> reporter: erika and ukee, good morning we now necessity just how fast this train was traveling right before it the derailed. it was speeding down the tracks at more than twice the limit. big question this morning is why and how did this happen. investigators will remain on the scene here for days for a thorough investigation. take a look at the video. the we are getting a full scope of what has happened here at least seven people were killed and more than 200 injured when amtrak train 188 derailed here tuesday night. investigators work hard, nt. b says train was traveling at 106 miles per hour, coming into a sharp curve in the track. they say train's engineer applied emergency break moments before the derailment but that only slowed slightly to 102 miles an hour. limit here is just 50. now the train's black box and front mounted camera have been recovered, up rest gators hope those provide vital clues. the they a if automatic breaking technology called positive train control was in place as it is in many areas

on amtrak's northeast corridor this accident probably wouldn't have happened. amtrak throughout the the good bit of the northeastern corridor has advanced civil speed enforcement it is called ases. ases is installed throughout most of the northeast corridor for amtrak, however it is not installed, here for this area, where the accident occurred, where the the derailment occurred. that type of a system, we call it a positive train control is tell, that type of system is designed, to enforce the civil speed, to keep the train a alone, and below its maximum speed. we have called for positive train control for many, many years, it is on our most wanted list. congress has mandated that it be installed by the end of this year. so, we are very keen on positive train control.

while you can because because tomorrow we will see a warm front coming n with the warm front lift nothing we will see potential for showers thunderstorms returning to the forecast especially for the upcoming weekend. we will talk a little bit more about that later in the show. ukee, back to you. more on the amtrak tragedy, seven people confirmed dead and we're starting to learn about the the victims. latest victim to be identify is 42 year-old derek griffith, dean of student affairs at met gets ever college in new york city. thirty-nine year-old rachel jacobs missing ceo of a philadelphia tech company has been confirmed dead. and also killed 48 year-old jim gaines of plainsboro, new jersey who worked as a video software architect for i a the the associated press. justin zemser of rockaway beach in new york was a mid ship man this is his mother. >> absolutely wonderful. everybody looked up to my son.

there is just no other word i could say. >> more than 200 others were injured in the derailment. we will have a live report from temple university hospital coming up at the top of the hour. now we're also learning more about the engineer behind the control of the the train. brandon bostian's professional page on linkedin shows he started with amtrak in july 2006 a as a passenger and conductor. bee can aim an engineer in december 2010. hours after the the derailment he changed his profile to a black square. he gave a statement to police, at this point and has not talked directly with the national transportation safety board. you can also get very latest information on the train crash anytime at cbs philly.com. and new this morning the u.s. house passes a bill to curb spying by the national security agency. that bill called u.s.a. freedom act would bar nsa from collecting bulk information about who people call and the the duration of conversations. a practice that is used since

2006. the bill, on the table now would create a new system that requires court approval to search data held by telephone companies on a case by case basis. the the house passed a similar bill last year but it the failed in the senate. well, a happening today a federal jury resumes deliberations on whether to sentence convicted boston bomber dzhokhar air neff to death or life in prison. the 21 year-old was convicted in the boston marathon bombing in april 2013 that killed three people and injured more than 260. defense claims tsarnaev's older brother led him down the path of terrorism. it must be a unanimous decision to impose a death penalty. levittown exterminator has been found guilty in the murder of a center city doctor. jason smith was charged with first degree murder, arson and other related counts in the 013 gruesome death of 35 year old melissa death nutty. smith confessed in the basement of her home after an argument. smith told police he felt that

buildings will fly at half staff today. governor tom wolf made the order yesterday to honor victims of the deadly train derailment. they will remain lowered until sundown on sunday may 17th. pennsylvania congressman bob brady is one of many civic leaders to visit the thent site. our chris may asked him what he plans to do in washington in the wake of this tragedy. >> well, i go back there and we will ask for a publicist tell wide audit from the department of transportation, with all of our railroads. >> late last night the republican led house a appropriations committee voted 30 to 21 along party lines to cut amtrak budget from $1.4 billion to $1.3 billion. >> would seat belt have saved lives in the amtrak derailment. former transportation secretary ray lahoud suggest federal investigators consider them. he ride the line frequently and often thought about seat belts. 2007 study by britain's rail safety and standard board said

i'm lynne abraham. when i became philadelphia's da, child victims had to face a judge ...a jury...the public... and testify eye to eye with their attackers. it wasn't right. so i got a constitutional amendment passed allowing children to testify remotely. i'm running for mayor for the same reason -- our children should come first. jim kenney and tony williams are fighting over public schools versus charters. i disagree. we have to improve education for all of our children.

federal investigators want to know why the train that derailed tuesday night was traveling more than a hundred miles an hour through the city of philadelphia. at least seven people were killed when that train 188 jumped the track. more than 200 people were injured and ten remain in critical condition this morning. investigators say the train was traveling 106 miles an hour when it entered a curve with the posted speed limit of 50 miles per hour. the engineer of that train has not yet spoken to authorities and has retained a lawyer. up investigators with the national transportation safety board say that reporters from inside the train will aid their investigation. we will have another live update on this deadly crash at 5:00 o'clock. 4:49. retailers are compete to go get all important on line shoppers and now wal-mart is rolling out a new service. >> money watch's jill wagner joins us from the the new york

stock exchange. jill, what have you her about this. >> reporter: wal-mart is testing a new unlimited shipping service that cost $50 a year, products would arrive in three days or less. this would compete with prime shipping service from amazon that cost $99 a year for unlimited shipping. for now wal-mart service is invitation only. i did not get my invite, i don't know about you. >> it is exclusive. >> jill, 16 million people use star bucks mobile phone app to pay information coffee. there were reports that it was hack but star bucks says that is not true, um. >> reporter: yes, star bucks is denying reports that this mobile phone app was hacked. media outlets pointed to two specific cases they say cyber criminals were using systems to drain money from customers accounts and steel credit and debit card info. tar bucks isn't sure and could not comment on specific customers but 16 million people use that star bucks

let's get traffic and weather together. good morning vittoria. >> good morning everyone. we are going in the northeast section of philadelphia to the accident scene ongoing at the this time where two vehicles are in transport we are getting word. this is traveling not too far from that bustleton area intersection is grant and wells. you will notice it does seem to be that vehicle there obviously one involved, two vehicle crash, one off to the shoulder, one off in the embankment. you will net is camera zooming in, another tragic scene that we're looking at here in northeast philadelphia, at grant and welsh. as a result of this accident you will note closures at this point in the northeast traveling in and around this area, you will want to do maneuvering if you can. we will continue to keep you updated on that. as we have move now we will update you on the traffic
