"eyewitness news" investigative reporter walt hinter is live with more on lawsuits filed today walt. >> reporter: jessica, from their law offices here in center city, the attorneys who are suing amtrak, on behalf of six crash victims, say that they hope to depose the engineer, in order to learn more about the deadly wreck. attorneys suing amtrak on behalf of six crash victims says highly publicized disclosures by the ntsb that the engine might have been struck by a projectile have nothing to do with what caused the crash. >> it is a red harring. it had nothing to do with the operation. >> problem they alleged speed, that the train according to the ntsb traveling 106 miles an hour, more than twice the 50-mile an hour speed limit on the frankford junction curve. >> the conduct here by the

engineer is both unfathomable and unconsciousnable. >> reporter: attorneys representing victims like philip armond who may have of her arm amputated and daniel armond said they want to mare what engineer brandon bostian has to say including why the the engineer told investigators he remembers nothing about the crash. >> it is always, raises red flags, when someone who has been involved in an accident going too fast has a sudden claim of no memory. >> reporter: suit also faults amtrak for failing to install speed restricting safety equipment on the northbound tracks where the wreck occurred. after they had previously put it in on the southbound tracks. finally district attorney seth williams says that he is awaiting more ntsb findings, before deciding if he will launch a criminal

investigation. >> so we will be very methodical, we will take our time, we will dot all of our i's, cross's all of our t's. >> reporter: the district attorney told me it could be months before he get enough information to make that decision, on whether or not to open up a criminal investigation. meanwhile the attorney for the engineer and amtrak officials did not respond to our request for comment. live from center city, walt hunter cbs-3 "eyewitness news". >> thank you very much. commuters were able to travel the rails between philadelphia and insuring today, and passengers who made that journey had amtrak tragedy on their mind. team coverage continues now with steve paterson. >> reporter: message to passengers is amtrak is safe to ride. monday amtrak officials bolding, italic and under lining that message. for the first time since last week's deadly accident, service from philadelphia to new york restored. >> if i had to be in new york today i would have been on that train or one later on

this morning. >> mayor michael nutter was there as first train left in the northeast corridor. >> system is safe, works i take it all the time. you know, this is highly unusual. >> reporter: part of the monday's reopening is new safety features on the track. for the the first time north bound rail near accident scene will feature automatic train control, spokesperson craig schultz calls it a speed safe guard. >> what that will do is basically provide an assurance that the train will come to a top if there is a violation of speed in that area. >> reporter: schultz says tech was in place in the southbound side but testing found it wasn't needed where the accident occurred since the crash, the federal railroad administration, put in a new directive. >> there is now a speed restriction basically in that curve, on the northbound track where there hadn't been before. >> reporter: regular customers say they are happy to service is back and feel safe riding once again. >> i'm sure they have done the necessary repairs and taken precautions and safety. aim not worried.

the president met there with police and some young people to get their take on the department's initiatives. moving. >> good news is they are moving away, at least for today but they will be back. >> they always are. >> bye we are looking at conditions changing rapidly over the next couple of days. warm, stick think morning and then a big cool down with storms this afternoon tomorrow it will be steamy and sticky again. take a look outside where we are dealing with some areas of fog, believe it the or not because we have this marine flow, on shore flow that is bringing in cooler air and it is getting even foggy in center city philadelphia you can see cloud there. on storm scan three we are seeing some cloud popping up, especially through delaware, but those are fading as well as they encountered some dryer air and we are losing daytime heating. that ocean air which is cooler a and dryer is actually winning out. you can see some the poconos and to the west of the lehigh valley, reading, berks county, these are slow moving and as they encountered trier air they will be weakening as they move eastward toward the philadelphia area. that will take a long time for

these to move eastwar. right now on 76 moving to the east a very heavy rain is falling but nothing severe. biggest threat is heavy rain. high today in philadelphia 87 degrees. you felt it. that was earlier this morning at the 10:00 a.m. right now only 68. so why is it 19 degrees cooler in the afternoon in this is why? a back door front has snuck from new england and cooled things down big time, toms river 57. philadelphia is 68. wildwood 66. georgetown delaware still at 77. baltimore 84. but that cooler, dryer air has won out mess of the delaware rally. good news it is keeping us on the the dry side the storms to the the west and south and as these storms move east and even count their dryer air they will begin to fizzle. you can see by 11:00 that real strong line of storms just widely scattered. everything moves east and dies down overnight. during the day tomorrow we will mix of cloud and sun steamy again by the afternoon

i'm lynne abraham. when i became philadelphia's da, child victims had to face a judge ...a jury...the public... and testify eye to eye with their attackers. it wasn't right. so i got a constitutional amendment passed allowing children to testify remotely. i'm running for mayor for the same reason -- our children should come first. jim kenney and tony williams are fighting over public schools versus charters. i disagree. we have to improve education for all of our children.
