tonight at 11:00 o'clock, damp and dreary weather. our jackets are back on as the chill settles in but for how long? good evening i'm chris may. i'm jessica dean. >> meteorologist kathy orr is live outside on the cbs3 sky deck where things are feeling more like march and kathy it's raining once again. >> it certainly is. we just can't get enough of the rain. too much of a good thing though, too fast. yesterday right now more of a

nuisance say steady light rain across a good part of the delaware valley. on storm scan3 you can see the rain moving toward the northeast. there is a back edge. that is the good news. it's moving through parts of chester county and you can see it almost looks like two areas of rain merging together pushing off toward the eastern seaboard. interior south jersey getting some steady rain. you can see it there in places like hammonton also, through tabernacle work 06 extending through medford lakes we're seeing some steadier heavier rain and that will be moving toward the northeast as well. rain amounts over the past 24 hours most of this yesterday hammonton almost 5-inches of rain wilmington almost 4-inches 4-inches. atlantic city over 2.5, two in philadelphia. chatsworth nearly 2-inches of rain. overnight, more spotty showers and drizzle. more of a nuisance than anything else. temperatures in the 50s. areas of fog and that light rain will continue. come tomorrow morning we will face some light rain and drizzle drizzle. temperatures will be pretty much where they are right now hanging

out in the 50s throughout much of the region. the big question is, when do we finally get rid of the rain? and see a little sun around here? i'll have that answer with your seven day forecast when i join you inside. >> looking forward to that answer, kathy. thanks so much. a frantic scene in chicago tonight. a chicago transit authority bus ended up on the sidewalk with a pedestrian pinned underneath. officials say the bus collided with several other vehicles in the busy downtown district before jumping the curb. we know nine people were injured. two of them critically. caught on camera in florida an amtrak train crashed into a car slicing it in half. amazingly all three people in the vehicle survived with only minor injuries. this accident happened in jacksonville this morning. no one on the train was hurt. the driver was given a nearly $300 ticket for trying to cross railroad tracks while the gate arms were down. congress is demanding answers as lawmakers grill amtrak officials and

investigators during a hearing about the deadly derailment here in philadelphia. the ntsb has 15 days to determine whether the engineer was using his cell phone at the time of that crash or another hearing will be hell. "eyewitness news" reporter todd quinones has more. >> reporter: frustration is mounting weeks after the deadly amtrak derailment top federal investigators still can't say why it happened or clarify questions about engineer brandon bostian's cell phone use at the time of the crash. >> there are very few answers right now three weeks after one of the most horrific crashes that our nation has ever seen. >> reporter: congressman ryan cass stelle low represents philadelphia's western suburbs. >> we didn't get the type of answer that left us fully understanding why after three weeks we don't have an answer to the question of whether or not texting or phone calls were happening. >> reporter: the head of the federal railroad administration and others testifying before the house transportation committee emphasized once again that train

188 traveling at 106 miles an hour on a curve with a 50 miles an hour speed limit caused the crash in port richmond killing eight people and injuring about 200 others. >> the speed was a significant factor. and speed simply put is what we refer to as a human factor. >> the engineers union suggests staffing trains with two crew members in the cab amtrak now plans to install interior cameras to monitor engineer's actions. the railroad's president and ceo says a track side speed safety system called ptc positive train control will be up and running along amtrak rails by year's end. >> and i promise you that bite end of this year this system which will dramatically enhance safety will be complete and operation al. >> reporter: investigating bostian's phone records has been presenting problems. the inform tsb indicates voice and text messages were recorded

in different time zones and may not have been calibrateed to the exact time as the equipment on the train. bostian suffered a head injury in that crash and he says he doesn't remember the moment before the accident. reporting live tonight in the sat center, todd quinones cbs3 "eyewitness news". >> todd, thank you very much. well, from the rails to the air, there was drama at philadelphia international airport to today when a bomb threat was made against u.s. airways flight. eyewitness cam video shows flight 648 from san diego to philadelphia just after it landed today. passengers evacuateed bomb sniffing dogs checked their luggage but no explosive found. this was one of five threats against nights called in to the tsa in washington around 6:00 o'clock this morning. >> passports will be -- we will be assisting the fbi any any way we can. hopefully we'll be able to make someone answer for this very irresponsible act today. >> passengers were able to continue on their journeys after

that plane was given the all clear. a terror suspect is dead tonight shot by police on the streets of boston. police searched at least two boston area locations linked to raheem hours after officers shot him in a parking lot. he died at the hospital. investigators say the suspect lunged at officers with a knife when they approached him to question him. raheem had been under a round the clock surveillance for several weeks now. officials say he had been radicalized by isis. tonight president obama signed legislation that reforms the nsa's controversial surveillance program n sick months the nsa will lose its authority to collect u.s. phone records to search for terrorists terrorists. the records will stay with phone companies but the government can search them with a warrant. this is the first piece of legislation to reform post 9/11 surveillance measures. >> the funeral arrangements are now set for beau biden. president obama will eulogize the former delaware attorney

general and the son of the vice-president on saturday. members of the public will also be able to pay their respects. on thursday beau biden will lie in honor at legislative hall in dover between 1:00 and 5:00 o'clock. today beau biden's widow haley announced the creation its beau biden foundation for the protection of children. beau biden died saturday at the age of 46 following a battle with brain cancer. iconic image is at the center of a crime tonight the photograph afghan girl is among dozens of items stolen from an exton art gallery. 32-year-old brie destefano arraigned this morning charged with stealing that photograph and several other items and selling them. steve mccurry is the photographer who took the afghan girl photo. did he instead of know work as a sales manager at his studio. >> we've known about these things for quite sometime and we've basketball collaborating with the district attorney's office ever since they approached us. we'll see writ goes from there.

>> the defendant saw these great photographs, saw these wonderful photographs that mr. mccurry had spent his life making and she saw a way to make a quick buck. >> investigators also accuseed her of using alias tousle dozens of mccury's books online. philadelphia police released new surveillance video of some scooter thieves caught in the act. you can see two male suspects taking a scooter from in front of a home on carpenter street. this happened may sixth. police say they believe these suspects are responsible for multiple scooter thefts in philadelphia. if you have any information contact police. a bucks county high school student with special needs fights back when his school tells him he can't be part of the student field day. >> he turned to social media and what he did prompted change and an apology. our steve patterson has the story of a young man who fought for his rights and won. >> it wasn't fair. >> reporter: even without the ability to use his legs,

14-year-old jake wesley has no problem taking a stand. >> i don't think people in wheel chairs are with any disease should be excluded from activities. >> reporter: as child jake was diagnosed with duschenne muscular dystrophy genetic disease that dee greats muscles over time. it makes life tough and makes life short. >> he's always been a strong advocate for himself and for other kids with, you know, with dissables. >> reporter: jake's father keith says his son's nature kicked in last friday when the family received this letter from jake's school. >> my wife and i were very upset. >> that letter from bucks county technical high school was addressed to about 60 students labeled medically exempt from the school's athletic field day. in plane language it tells parents their children aren't allowed to participate, they have to wear special wrist bands to denote their status and if they're caught removing the bands or participating in the day, they face quote disciplinary consequences. labeled and side lined. >> you can't be doing like that.

there needs to be, you know, some kind of, you know, system of checks and balances. >> reporter: turns out, there was. >> when i got the letter i was pretty mad. >> reporter: within 10 minutes of getting that letter jake took action posting it on twitter, calling for us? tis and connecting to special needs groups. jake stood up and his school took note. >> we made a mistake. it needs to be fixed. >> reporter: when schools official saw what jake wrote they immediately retracked a letter they had been putting out for years and issued a full apology. >> i'm happy he brought it to our attention. because again we were wrong. >> reporter: jake's advocacy changing classroom culture make making less better for students now and for years to come. >> very proud. yeah. he's the man. >> reporter: and because of jake's advocacy school officials say they wanted to even more to include special needs students at school activities and school events. field day by the way is this friday. reporting from bucks county, i'm steve patterson cbs3 "eyewitness news".

police in ventnor have a mystery on their hands. their trying to figure out the story behind a bust found on the boardwalk. this sculpture of a head was found near lafayette avenue last november. police went door to door they posted flyers but they've had no luck in find it's owner wolf weeks ago they turned to face bock to get the word out. one detail here that's important important. the only inscription is hilda 72 on the back. >> the lack of the nameplate makes us think it's probably a personal piece. probably belonging to a family member maybe somebody in the family painted it this is patriarch for a family member. >> police believe since the skull which are was found in the middle of the boardwalk with no

other items it was probably ditched after a burglary stolen from someone's vacation home during the off season. the dramatic story of the miracle on the hudson is coming to the big screen. clint eastwood will direct bio pick of captain chesley sullenberger will tell the story of how he safely landed disabled u.s. airways plane on the hudson river in january of 2009 saving everyone on board. the film promise toes explore behind the scenes drama that could have caused sully his reputation and his wings. there was no title for that film as of now. when it comes to work experts say you should stand up for your health. medical researchers have long warned prolonged sitting in office chairs is dangerous. we know this. it's associated with hire risk of heart disease obesity and cancer. those researchers now say you should stand move and take breaks for at least two out of your eight hours at work. get this they say four hours of

standing is ideal. they do a great job of cleaning clothes and saving energy but front loading washers can be magnets for mold and a bad smell. three on your side consumer reporter jim donovan takes look at what the problem might be. >> reporter: they tackle dirty jobs with less energy less detergent and less water but not everyone is a fan of front load wash schers. >> this is where the problem was right here in between the basin and the rubber rt this is where the water would trap. >> reporter: kathleen catell thought an energy efficient front load washer would be state of the art but she quickly regarded buying it. >> i couldn't take it. there was black mold getting in there. a true safety hazard. >> reporter: the problem is poor drainage around the door. an entire towel is needed to sop up the extra extra water trapped after every load it. >> has a search it to. >> calls to the manufacturer were even more frustrating. >> it was just no remedy for it except it's my job to clean out

the machine every time. so clear physical i had known that i never would have purchased the machine to begin with. i would have gotten a top loader until they figure out a better design for it report roar class action lawsuits are now pending against several top washing machine makers. like this one against frigid dare which made kathleen's washer. front loads produce a mold or mildew odor that can permeate a consumer's home. >> the company new there was a problem as early as april of 2007 and rather than rhee recalling the machines letting consumers know there was a problem they continued to sell those machines. >> reporter: frigid dare disputes the existence of a design defect. other manufacturers say the majority of customers are satisfied. these machines work well if the operating instructions are closely followed. appliance repairmen hear complaints all the time. >> they will describe the odor they get in the clothes a as swampy type smell. >> reporter: kathleen is now happy with a new machine that has better drainage around the door.

but she may join the suit if her case is eligible. >> that's very frustrating as a consumer reaching out to the manufacturer and saying here's a clear design problem, can you fix it or can you replace it? they don't stand behind their own product. >> reporter: if your front loading washing machine smells there's some things you can do on your own that may help. wipe down the door with disinfecting wipes and keep the door open as long as you don't have small children or pets in the house. reporting for three on your side, i'm jim donovan. >> the pennsylvania horticulture society transformed a vacant light lot into a particle park. >> hard to imagine this beautiful setting was once a forgotten about mess. the decor of the park incorporates recycled bike parts -- parts reclaimed wood and even some elements from past philadelphia flower shows. again that's at ninth and wharton if you want to stop by. maybe once all the rain goes away kathy. what a neat place to be and what great way to take that space and make night something great.

>> yes. we have so many beautiful sets from that knauer show. >> yeah. >> if we could spread that through the city it would be the most beautiful city in the world. >> that's right. it already is. we know that. for sure. >> oh, my goodness a lot of green a lot of water to make it green. now we need a little sun and we are going to get some in the seven day forecast. still staying a little damp and dreary at least for the next 24 hours. take a look outside. we got a little fog to talk about as well. nothing that is going create problems overnight. we're seeing liberty one liberty two fairly well tonight. temperatures will stay in the 50s50s. on storm scan3 some rain to talk about. getting more spotty especial specially to the forth and west. south jersey seeing the bulk of it interior south jersey gloucester county camden county extending into burlington county along 206 places like southampton, medford medford lakes extending through mt. laurel evesham and even you can see toward the west toward haddonfield this is where we're seeing the more consistent rain right along route 70, 73. the back roads to the beach here and we'll see this at least for

the neck half hour or so and then that will be moving out. rain over the past 24 hours has been so significant that it is more than we saw for the entire month of may. the month of may only 1.19-inches of rain in philadelphia the last 48 hours most the last 24 hours over 2-inches. so it certainly has been a soggy go of it this week we have more rain in the forecast. at least 30% chance tomorrow and thursday. friday a 40% chance. the same saturday but that does not mean it's a rainy day. it just means there's a better chance of seeing a shower. right now in philadelphia 56. the same in allentown. the poconos just 3 degrees cooler. millville at 55. 56 in wilmington. that persistent easterly wind keeping it cool everywhere. we have high pressure to the north. with that clockwise flow low pressure to the south. and it continues to feed that moisture and that maritime air and that means clouds, that means cool temperatures it still means a few showers maybe a little drizzle during the day

tomorrow. but there's good news. a new computer imagery is suggesting a drier day tomorrow and even thursday with just a chance of a shower even though that area of low pressure is to the south. temperatures will still be climbing through the 60s. by friday, we make it into the 70s. that front is moving farther away with that low pressure center. we have a better chance of seeing more sunshine. that's the good news. overnight cloudy, a few showers, the low 57. that easterly wind really kicks in tomorrow. the high temperature 67. so it will feel cool. as you plan your day in the morning 58. lunch outside 61. a chance of a shower after school evening activities look good with a temperature of 64. on the exclusive "eyewitness weather" seven day forecast tonight is the coolest night then by tomorrow temperatures warm. they'll continue to do so over the course of the weekend and next week getting back to normal normal. turning quite warm again but as you can see each day looks like at least a chance of a shower. it doesn't mean everyone is going to see it so i don't want to frighten you with that thought.

phillies back in action night after day off the fan festival where they raised almost $800,000. did their good deeds help end that seven game losing streak. game one against the reds here we go. o'sullivan got the start tonight tonight. zach doubles to right centerfield. former philly marlon byrd scored to make it three-one. in the sixth phillies down four-one. chase utley had thee hits in the game including his fourth homerun of the season. that made it a four-two game.

moving to the eighth ryan howard on second and miguel franco at the plate. it's a fly ball that stays inside the foul pole that's the rookie's third jack of the season. game tied up. here we go. in the ninth herrara on third. darrin ruf hits a blooper that fell in for the walk off single. seven game losing streak is over. five-four the final. >> i haven't had the best numbers pinch hitting i feel like i've had good at bats in some situations but you had to be there in that situation and still have the confidence from the manager and myself to be able to get the job done. >> the eagles back at work today at the novacare complex and we get a look at quarterback sam bradford it's a big step in his recovery from the second major knee surgery. sam participated in seven on seven passing drills. if it all goes well one of his main targets will be first pick nayly nelson agholor.

before we go there's breaking news we want to tell you about. firefighters are battling a house fire in chester delaware county right now. it's in the 400 block of bicly place and so far there are no
