>> waking up to another day this saturday, storm scan3 parts of our area again waking up to the aftermath of some pretty soaking rain. then, this is far from over, folks. also new this morning, fire fighters west philadelphia on scene battling a two alarm fire in a storefront. take a look at those flames. we'll have an update on that intense fire. >> and, did septa police go too far making arrest that was captured on camera? we'll have more on the video that has that force re-thinking its policy. >> today is saturday,

june 27th, good morning to you, thanks so much for joining us, i'm nicole brewer. it is 6:00 right now. we send over to carol for this forecast, a lot of folks wondering; this going to be a wash out? >> total wash out overnight in areas through montgomery county during the day today yes, some showers are out there, and as we move through the rest of the afternoon i think those showers will be getting heavier. can't rule out thunderstorm, it will be cloudy in the interim and the temperatures cool in the seven's some people may love this weather, this is the weather we get today, though, center city philadelphia, you can see, the clouds over us right now, you can see all the way to the top of the builds action, no fog just some clouds, as you head out to reading same deal, 66 degrees, we've got lot of clouds naught that location, as well. now, storm scan3, you can see what is coming, and that is coming up from the south moving in from the north as well. we will be finding rain today and everybody will be getting into this rain over, during the nighttime period, we saw a lot of rain, and you can see

the doppler estimate out through phoenixville, king of prussia, ardmore manayunk, just tremendous amount of rain starting just little after midnight and it just poured there over and over and over again. that's why you pick up three to as much as 5 inches every rain, in some spot. the flood warning there has ended, but the flood watch will start about noon today and it runs until roughly 5:00 in the morning, tomorrow morning, and it is for philadelphia, areas to the west also, new castle county, delaware and cecil count any maryland. we could be finding an inch and a half do you have two and a half inches, especially to the north and west of philadelphia. but, even areas to the south you could be seeing an inch. temperatures are in the 60s right now, we ends up in the 70s, so not a warm day today at all. just cloudy one, with some rain like lurks dow want to spend just second here and show when you we're likely to see some of the stuff here the computer model says even by 2:00 areas will not be seeing anything, but others will, especially, north and west of philadelphia. and you can see, by 8:00 tonight, we are seeing some of the heavier rain

moving into all locations we'll continue with that time line, and show you the seven day forecast, and that's just ahead, nicole? >> carol, thank you. new this morning residents escape apartment fire safely. philadelphia's overbrook neighborhood. the two alarm fire broke out in a storefront building in the 1800 block of north 54th street around 2:00 a.m. >> very heavy volume of fire. wasn't safe for foyers here, fire fighting attacks. we bring out heavier host, heavier water knock the fire down from the outside then cut the spread of the fire off. >> it took two hours for firefighters get it under control. one firefighter was actually injured fight that fire. he's being treated right now at the hospital for a leg injury, the cause is under investigation. well, local utility companies are making problem rest restoring power after this week's earlier storms. atlantic city electric reporting 38,000 outages and peco, still has more than 2,000 customers without power. very frustrating for those folks.

>> well, arrest on a septa train is caught on camera, and it has transit officials re-thinking their own policies. how should police handle a suspect who is holding a child? "eyewitness news" reporter natasha brown shows us how it all happened. >> i'm just sitting there. >> ahmad had no idea that this video he shared on social media would lead to internal affairs investigation after 16-year veteran septa police officer. >> no, i'm not going to get off the train. cursing back and forth at each other. >> septa police attempt to go remove 20 year old ella smith from the market frankford el thursday evening. he boarded the train with a little girl in his arm, at the margaret and oxford station when a cashier reported seeing him evading the fare and jumping on the train. moments later, at the next stop, a septa police officer confronts him, and tries to persuade him to get off the train, produce identification, and except a citation. >> the point of contact to the point where handicuffs are

placed on the person is 14 minutes long. >> the heated verbal exchange between the two became physical, all the while the child is caught in the middle. >> where the officer pushes him up, he is still holding the child. another rider you'll see the other rider heads over to try to take the child the father doesn't release the child. >> back up later arrives and the video captures the tense moments on the platform, describing a crying little girl, still in the arms of her father. >> people was even offering to pay for them, like, here is 225, here is a token, it was just too much, there was no need for like the escalation. >> we can't endanger the lives of little kids over affair evasion, that's unacceptable. and that's on me. >> septa police chief thomas is calling for better training of his officers, in situations like this. >> this is the type of incident that causes us to reflect on what we tell our police officers, and how we

tell them. >> has no regrets about capturing the video hoping if it comes a teachable moment. >> it is not really a matter of, you know, brutality of police but it is a matter of like how situations should be handled. >> this definitely was something that should be handled. >> community activists calling for the immediate removal of the officer involved. he has not been suspended but an internal affairs investigation is currently underway, at septa headquarters natasha brown cbs-3, "eyewitness news". >> well, philadelphia police have now identified the two suspects wanted in the shooting of at a mantua block party last saturday. you may remember 11 people were injured in this. youngest one just one year old child. the suspects are kaileave harley dominick lamar. police believe they opened fire owing did i street man too a the shooting reportedly stemmed from fight they had about a week ago and the suspects apparently wanting revenge. well, three weeks after two convicted killers escape their new york prison, police have shot and killed one of

those men. and the other still on the run. cbs news correspondent kenneth craig with the latest on the search for that second convict. >> hundreds of police officers, will be swarming the woods, near malone, new york this morning searching for escaped killer, david sweat. sweat is still out there. he is considered dangerous. >> police admit there have been no actual sitings of sweat since he broke out of the clinton correctional facility. on friday afternoon federal agents shot fellow inmate, richard matt dead after they found him behind a hunting cabin, near malone. >> a tactical team from customs and border protection met up with matt in the woods challenged him and he was shot dead by border patrol at that time. >> state police say matt refused to surrender and that they found a 20-gauge shotgun on his body. they say matt fired no shots during the confrontation. >> you never want to see

anyone lose their life. but i would remind people that mr. matt was an escaped murderer. >> police say they assume sweat is armed they've set uptight perimeter here in malone about 30 miles northwest of where sweat and matt escaped, three weeks ago today. sweat was serving a life sentence for killing a sheriff's deputy. two prison employees face charges in connection with the escape. kenneth craig cbs news, malone, new york. four correctional officers treated wore smoke inhalation after a fire breaks out at graterford state prison, montgomery county. small fire there broke out in cell around 7:00. it was quickly put out. the cause is under investigation. well, the white house is glowing in rainbow colors to mark the gay right movement historic victory at the supreme court. the highest court in the land ruled same sex couples nationwide had the right to marry in all 50us states.

now, that vote was five to four, with justin anthony kennedy as the swing vote. the majority decided the equal protection clause the 14th amendment prevents states from banning same sex marriage. president obama praised that ruling at the white house. >> this ruling will strengthen all of our communities by offering to all loving same sex couples the dignity of marriage across this great land. >> but not everybody is celebrating the supreme court's ruling including the archdioces of philadelphia. archbishop charles chaput saying the states of the court change nothing about men and women and the truth of god's word. same sex couples are celebrating after decades of passionate activism. "eyewitness news" reporter matt rivers has that part of the story from independence mall. >> from the steps of the supreme court, to independence mall, old city, the magnitude of friday's decision was clear. >> while we're really excited it is also a bit kind of

overwhelming, and i think many of us just never thought that this day would come. >> but the day did come, with a five to four vote, that established marriage equality in all 50 state. legality prompted emotion among the hundreds that gathered for late afternoon rally, to celebrate the decision, meet brett and husband can he begin very emotional. i sat at home watching the news, and called him. he was on the subway. and we couldn't really talk. i was crying. >> beyond cheering for what they would call the shear morality of the today's decision, practical implications, as well. same sex marriage became legal here in pennsylvania last year, but until today marriage licenses issued here at city hall wouldn't necessarily be recognized in other state. that means for some couples we locating, say for a new job, simply wasn't an option. >> we can travel anywhere in the u.s., do not have to worry about being questioned. >> and from the present, to the future, we met some who thought more of the legacy, this ruling will leave behind.

damian tracey works at cbs-3 has been married to his partner brian for about a year. together they are raising a daughter, eight month old elena, in what they hope lab more inclusive society. >> to think 20 years from now she will think it was crazy that we -- >> a question. >> as of friday, that question has been answered. matt rivers cbs-3 "eyewitness news". it is 6:11 right now. a lawyer for comedian bill cosby is fighting effort by the associated press to unseal documents, from a 2005 sex assault lawsuit. an attorney for cosby says it would be quote terribly embarrassing if details of the suit settled with former temple university employee were made public. now, at issue here, information given by cosby at a deposition detailing his marriage, his sex life, and prescription drug use. the plaintiff accused cosby of drugging and sexually assaulting her at his home. well, ryan sandberg has resigned as manager of the phillies. sandberg thanked fans at a

tall shims festival is in philadelphia, and many are expected. >> if you head down there you might in the there is one big attraction missing. syma chowdhry with the details on mama duck, and this giant rubber ducky controversy. what's going on, syma? >> well, nicole, it is funny that the giant duck is one of the biggest attractions at a tall ship festival. but if you look around, on the delaware you'll find ships but you won't finds mama duck. that's because she is out for repairs. the world's largest rubber duck is having some issues. now, the problem started on thursday, during the parade of

ships. the month tune, the duck came in on, took on some water and that turns out there were lot of holes in mama duck, too. and that's why she ended up sitting lob sided. so, they took her out of the water, they are fixing her up. but no worries rocky the baby duck, at wiggins park, where kids can take pictures with him. but for mama, they say she needs to recover from quote some ducky bruce. >> think of big bicycle tubes that needs lot of patches. one we get her back up and rolling, get her wing fixed she will be taking a few hours to get pumped up. >> yes, few hours and lot of people are going to be excited for. that will now organizers say, to tune onto their facebook page, for the facebook page to get updates on mama duck, kind of check where she is, what the situation will be, when exactly back, not quite sure

just yet, they are hoping by the end of the weekend also, to note, a lot of people are coming to enjoy the fireworks but, this evening fireworks has been canceled, and moved to tomorrow at 9:30. so, some changes with the tall ships festival. but nicole, like i said before, at least we have tall ships. we send it back to you. >> that's important, tall ships festival. syma thank you. >> exactly. >> yep, hey, after several delays of the town set inlet bridge connecting avalon to sea isle finally back open. bridge closed for repairs and it opened back up shortly after 7:00 last night. so, a lot of folks will be happy about that. >> let's sends it over to carol now. good morning carol. >> no matter how long the bridge is, if there is this much that isn't there the bridge is shutdown. >> it is a problem. >> really. >> our weather watchers are up this morning nicole. happy to say. let's head out to the west, this is where we saw some really heavy rainout through conshohocken, and that sort of thing, during the overnight time period. and, we've got matthew out in

conshohocken and he says, and i think real understatement, a cool but very damp morning. they pick up inches of rainout through conshohocken, and phoenixville, and collegeville. and another temperature of 66 degrees, and this is where we find phil and phil always knows what the wet s and he does again this morning little temperature change in the last eight hours no winds, gray morning rain is coming, and yes, it is coming, and another temperature of 64 degrees again these areas i'm showing you right now are where the flood watch will be in effect at noon. but many of those spots pick up some heavy rain overnight. and bill with his lovely dog says mostly cloudy, hoping the rain holds off until tonight. i think bill, your heaviest rain is holding off until tonight. and everybody's going to be getting into it, let's stroll, come on, let's stroll. atlantic city, looking at some clouds down there right now not the brightest of beach days unfortunately, and probably won't stay the brightest of beach days. we have shower chances expected there. even though, shore areas not

involved in this flood watch you can be expecting in many locations to pick up to about an inch of rain through south jersey. another gray look, this is right here, on the delaware, syma chowdhry probably somewhere over there across the delaware, near the tall ships. so palmyra cove nature park, it is a gloomy start to the day, and every single location that we've got out there this morning, temperatures are in the 60s every place, one location, that's not that's down in wildwood at 70 degrees this morning. our storm scan3 this is a look over the last couple of hours, and you can see that we did see heavy rain, worked its way from montgomery county points north inches every rainout of the thing, just kinds of rained from midnight until about 3:00, 4:00 in the morning, then finally left. now, we are starting to see some showers pressing in from the west, there is a low pressure system, to the west, but there is another one forming to the south. that's why we get some rain today, and then we get another batch coming up tonight. today, heavy rain, specially

as we move through the afternoon and evening. amounts, one to 2 inches of rain, and there could be locally higher amount, than that especially, north and west of philadelphia. wind gusts, 30 miles an hour, can't be tonightly ruled out. thunderstorm tomorrow morning showers, some clearing in the afternoon, but still maybe a light wrap around shower. but, sunday, definitely better day than today. flood watch philadelphia, points west, new castle county, cecil count any maryland again starts at noon today. computer models pretty accurate right now. so we will give it a b plus. and then as we move through tonight, we will be watching for some areas with no showers, and some areas with showers through the afternoon. but tonight we fill in, start to see heavier rain coming into the picture. and it is pretty widely scattered even through areas without the flood watch. looking at some of that heavier rain with some wrap around showers coming in after that. so, it is just something to monitor in the computer models are saying around philadelphia, and inch to inch and a half of rain cannot be ruled out. than as we take a look at some

estimate to the north, by the time this thing is all over, couple of inches of rain could have fallen to the north and everybody is picking up some decent or indecent amounts of rain depending how you feel about the rain. poconos, 62 degrees, remember, a lot of heavy rain today specially later today. cloudy cool, mostly your creeks streams, nos the maine street rivers. but in a area normally flood prone, you will probably find that again tonight. 68 degrees, rain thunderstorm, some that far rain can get heavy tomorrow 81 degrees, we end up better than we started though, by monday, looks terrific, 83, tuesday, 87 degrees. wednesday, thursday, still in the 80s and friday, maybe another shower chance. nicole? >> all right carol thanks. still ahead his show hasn't even premiered yet. new late show host steven colbert offering his take on the days headlines. we'll share it for you. plus magic mike xxl dances into theatres this weekend. hey, if that's your thing

>> today is saturday, june 27, good morning to you thanks so much for joining us, i'm nicole brewer. it is 6:30 on the dot. we sends over to carol to talk more about this rain because we have more on the way. >> i guess a lot of people already had a bunch this morning, right? >> yes, some areas in montgomery county pick upton of rain overnight three 5 inches every rain by the doppler estimates. soap, there was a lot of rainout there. and there will be more rain, as we move on through the rest of the afternoon as well. >> center city philadelphia, dry at this point, margate dry there. also, pretty gloomy looking at the shore areas. we have low pressure system to the west, we have another one that will be forming to the south. that combination is going to be keeping us in shower chances today and maybe

specially heavy shower chances as we move through later on tonight. we zoom in little closer into philadelphia. seeing few showers breaking out, so it will be the trends for the day but i think some of the heaviest will be holding off until later when the other low forms, the one to the south. now, temperatures are in the 80s, will be slow to rise, because we're not going all that high. high temperatures this afternoon just get to go about 74 degrees. it is slow warm up, by noon, at 73, by 3:00 p.m. 74 degrees, and we've got these rain chances now this computer model notice, the rain look like it was little closer to philadelphia, than it is here. >> thinking how this is going it does move it on into the area. as we go through the morning hours, and then, not everybody is seeing it, all at the same time, but as we move into tonight, some of the heavier rain starts as we see that second low moving up from the south. we'll talk with the flood watch, just how long that goes, and what follows and that's coming up.

nicole? >> all right carol thank you. well the supreme court weighed in on the issue every same sex marriage on friday, the court sided along its typical conservative liberal lines, the swing vote here, craig boswell outside with the details of this historic decision. >> same sex marriage now the law of the land. it was little too much for pam yorksmith who sued to have her name added to her son's birth certificate. >> overwelmed and overjoyed and really proud to be an american today. >> the five to four decision fell along conservative liberal lines with justice anthony kennedy giving the swing vote. he wrote marriage is a funds mental right in which homosexual couples must share and will also and violation every equal protection to extends that right only to hetero sexual couples. >> within a few sentences i would just cry. >> the lead plaintiff in the case. he sued to have his name added to his late spouse's death certificate. >> knowing him, loving him

senate version which lifts amtrak's funds to go $1.4 billion. house committee reduced fun g to 1.1, underscored the need to improve amtrak safety and infrastructure. >> we have to make the case specially in the aftermath of a horrific tragedy to make sure that folks in washington know that amtrak is essential not only for the northeast but for the whole country. >> the house bill does include $9 million in new funding for video cameras inside amtrak locomotive cabs. >> meanwhile, the investigation into the amtrak crash that left eight dead and more than 200 wounded is still ongoing. more than six weeks later local survive offer talks with "eyewitness news" reporter david spunt about his ongoing struggle. >> you never know your last day of earth is in. i was close. >> but lenny knobs survived, and more than a month later, he says, this nightmare

continues to haunt him. >> every time i close my eyes, i relive the whole tragedy. >> thirty-four year old philadelphia native had never used amtrak before. but, decided to take the train on may 12th, for a business meeting in new york. when the train derailed, knobs, who was in the third car, says he flew out of his seat and a table collapsed on him. >> big crashes even get a night with bad storms, the thunder actually made me really nervous, because it sounded like the crash. >> he suffered a bruised lung, four broken ribs, a leg injury and a fractured spine. >> i have bruises all over my face for about a week and half, cuts all over my face. >> "eyewitness news" was in the hospital with knobs just few days after the crash. >> that's all could you hear was screaming complete chaos darkness, you don't know waist going on. >> another passenger took this photograph from inside, knobs is on the ground, the crash happened just a few blocks from his childhood home in port richmond. >> i used to walk through that

little area, coming home from my old high school. >> now he spends all of his time focused on recovery, both physical and mental. >> i don't think i will ' ride a train probably not, not in the near future. >> he'll continue to conquer his goal. he wants to be able to walk without any help. >> i'm happen that i my life, but most sad because i mean, people did die in this. it is a tragedy. >> david spunt cbs-3 "eyewitness news". we should mention that engineer brandon bostian has not been charged with any crime. his attorney has gone on the record saying his client doesn't remember that crash. ntsb officials yet to release bostian's toxicology reports. >> well, the death toll continues to rise in the deadly terror attack in tone osha. at least 39 people reported dead there. the islamic state is claiming responsibility for this attack, in which a young man hid assault rifle in a umbrella, then opened fire on a beach full of tourists, just unbelievable. the shooting spree ended with police shooting that suspect

to death. another terror attack there is one in france, ends with one person dead, and we've now learned of a connection to our area. investigators say, a delivery manna tacked a gas factory near leone using his car to ram oxygen tanks ignite the explosion. suspect who was killed by police, was also suspected of decapitating his boss, scrolling arabic mission zero message on his head, facing it on a fence post. factory where it happened belongs to air products of lehigh county. it is 6:38. president obama delivers heartfelt eulogy at the funeral service for reverend clementa pinckney. the south carolina state senator was one of nine victims killed in the charleston church massacre. >> ♪ ♪ >> thousands of mourners came together yesterday to celebrate pinkney's life. family and friends remembered him as strong force for good in the community. the president asked americans to confront the ugliness of america's racial history.

on the cbs-3 health watch this morning millions of smokers may have undiagnosed lung disease. that's according to researchers in denver, who say lung function tests alone underestimate the impact of chronic smoking. now, they found 55% smokers ex smokers said to be disease free actually, had some sort of respiratory ailment. so, something to check into.

>> also, on the health watch this morning, the fda has given food manufacturers three years to eliminate trans fats, from their products. correspondent holly furfer has a look at what you can use in its place. >> trans fats, will soon be out. partially high dodge nature dollars vegetable oil, make up trans fats, was touted years ago as alternative to cut out cholesterol and natural fats from our every day foods. but, studies found, they clogged up our hearts, and were dangerous to our health. so dangerous the government intends to ban trans fats from americans diets. so what can cooks use to make their foods creamy, tasty? >> new trish zero unition cents recommend healthy options, like oils, taken from canola corn, and soybean. other options although not as healthy, are products high in saturated fats, such as palm, cotton seed oil. some chefs turn to natural lard and butter to add flavor to their foods. they just recommend that you use them in moderation. many food manufacturers have

the north and the west of philadelphia. that's gone. now we're just left with temperatures that are in the 60s, here's 64 degrees temperature. robert stewart out in clementon, says extremely humid, not all that hot. robert won't even get all that hot today. dew .63 no rain yet for areas in south jersey, but that is also coming. 66 degrees temperature than is what we are finding, this is with lynn, in cherry hill, and she says got the movies ready for this soggy saturday. i love that. she's all prepared. it is not a beach day. probably you can walk outside and get a couple of rays, as you can see very faint through atlantic city. but, still i think this is a day if you have got those inside chores, not bad day to do it. >> you won't be missing all that much outside. except for somewhat cooler temperatures, our highs this afternoon, only 74 degrees through philadelphia. it is 66 right now out in reading, in fact, just about everybody continuing in the 60s, that warm up that we

normally see that 20 plus degrees warm up, we will not be finding today. in fact, we could be stopping about 8 degrees from this number. so it is a slow day to warm up. it is a slow day to really do much, except think oh, is the rain coming right now or is it going to hold off another ten minutes? we have temperatures in the 60s, at this point 70 degrees down in wildwood. and storm scan3 showing that some areas are already looking at some rain, moving in, it is light at this point, the very heavy rain, that happened around midnight, and that just moved on to the north, but you can see it moving on in, and just kind of getting absorbed up there and dying down little bit. but a lot of heavy rain through collegeville, and phoenixville, and conshohocken and king of prussia. that's gone. but more rain will be coming in. low pressure system from the west another one developing from the south. as if we needed two of them on a saturday. flood watch in effect, philadelphia, and points to the west. this does not mean even though you are not covered with a flood watch through south jersey, that you're not

getting no rain. you will be getting rain, but not to the criteria to demand a flood watch. and this flood watch primarily not for the main rivers, not for the delaware, but, a creek, a stream, those flood prone areas, that's probably where you will find some of the flooding out of this. and i'll be showing you the amount and the varying place that is we're expecting. if this were completely right there is computer model the rain would be about here. so you can see, it is probably about an hour off time-wise just know that, as we go through time, and it says as we go through mid-morning we're finding some rain, which we are actually finding rightful, and as we move into the afternoon some rain, but specially tonight with the second low coming up from the south. some of the heavier rain and it is in south jersey, as well, we watch for this during the overnight time period. it pulls out of here. just a little wrap around, couple of showers as we go through sunday, sunday a much better day than the wet their we're finding today. but we have the heavy rain,

one to 2 inches generally could be more in some spots and less in a little bit couple of others. wind gusts to 30 miles per hour today and tomorrow again is a better day. these computer models all are saying about an inch of rain plus through the philadelphia area. and we will have to continue to monitor. that will if you go to the north, you are looking at far more than that. look at that, almost 3 inches of rain possible, up in the poconos. it is going to be cool up there, too at 62 degrees. elsewhere, philadelphia, shore, we're at 74 degrees. we've got winds coming up out of the southeast, ten to 15 miles an hour. tonight, we're at 68 degrees, some of that heavy rain may be a gusty under this earl storm, tomorrow, looks better, at 81. but, still couple of showers possible around, monday, terrific 83 degrees, and then by tuesday wednesday thursday, the rest of the week, we should be finding our temperatures getting back into the 80s. nicole? >> well, bus out the shades. did you know today is national sunglasses day? yes, and we have here with us this morning eden wexlar known as the shades consultant
