spring and continued into winter. the student was between 14 and 15 years old at the time. district attorney tomorrow toll hogan is concerned there could be other victims. >> he did teach at schools both in pennsylvania, and outside of pennsylvania, for really the last 20 to 30 years which means that we will be checking with all of those schools to see if there are any other victims out there. >> simmons has been fired the concept school is cooperating with that investigation. a brutal attack inside of an atlantic city food market leaves a store clerk dead, sources say officers shot the clerk's attacker multiple times after that suspect lunged at them with the knife. it all unfolded this morning on north pennsylvania and adrian avenues. "eyewitness news" reporter cleve bryan is live at the scene with more on this, cleve. >> reporter: jessica, late this afternoon police cleared the scene and it all started inside of the cedar market with that knife attack, we understand that the the suspect was then intercepted in the middle of the adriatic

avenue by the police officers who then fired on him and the atlantic county prosecutor's office which handles all officer involved shootings is investigating this case and also the initial incident, so far, no details on exactly what happened. >> we're still all in shock here. it is a shame. >> reporter: owners of the cedar market on pennsylvania avenue say a customer came in tuesday morning and went berserk, slashing an employee's throat. >> he walk in the store the employee was doing the coffee. so he started. >> reporter: sources tell "eyewitness news" as police responded to the scene the suspect a local man in his mid 30's tried attacking one or more of the officers with the knife. they say a veteran patrolman pulled his gun and shot the suspect. >> he is a customer, that frequents the store. there is no rush now, you know sometimes, i don't know, i just don't know. >> reporter: the the employee killed is egyptian, living in

new york, and came down to the atlantic city at the advice of the friend who got him a john in the cedar market. this was only his second day. >> he was hired by a manager so, he just started yesterday. >> reporter: more than a dozen people from st. paul orthodox church came to the store to mourn the 29 year-old employee >> we will pray for this man. >> reporter: he has no family here no family here. just all of the people coming from one city, so all of one family. >> reporter: cedar market remains closed right now owners have been in and out with some people to try to get the place cleaned up. we understand it was a horrific scene inside, so much that several officers that attend todd this, had to go to the hospital for their stress to be evaluated. the owners of the store tell us that they will try everything that they can to pay for some of the expenses, so that this former employee can be sent back to egypt and

buried with his family. we're live from atlantic city, cleve bryan cbs-3 "eyewitness news" good cleve thank you. the july heat has settled in across the delaware valley, it is hot humid and some showers and storms could pop up. we will get over to meteorologist kate bilo, live on the cbs-3 sky deck. kate, it is sticky out there. >> it is indeed, jessica and breezy as well but right now it is quiet in philadelphia, and most of our suburbs. even though it is steamy at least we're not dealing with showers and thunderstorms for now, we have a few off to the north. so let's take you out to storm scan three and i will show you what is going on. heat and humidity really causing these pop up showers and storms to form and they have heavy rain. the closest we are seeing them right now up in the poconos and portions of bucks county and mercer county, rest of the region is pretty quiet. just a couple of showers and storms popped up over chester county as those started to fizzle. you can see heavy rain coming down with that one storm over northern northampton county and we have a couple of other showers moving from montgomery

into bucks county and at the moment it is all part of the grand landscape as we await the strong cold front starting to move through tomorrow. we will get southwest flow and it brings in this heat and humidity. i can tell you dew points are very uncomfortable. dew points around 70 degrees making it feel worse then it is. those showers move out of here as we go through this evening but temperatures right now sitting at 90 degrees at the airport and feels hotter. i'll tell you when heat and humidity may break and may be just in time for your weekend coming up, jessica back inside to you. f-16 and zest man collide over south carolina. a crash rain down plane parts and debris on the small town north of charleston. two planes collided around 11:00 a.m. we know pilot of the f-16 ejected safely, no word on his condition. it is unclear how many were on board the zesn a or if any of them survived. a six year-old is

recovering after being shot in philadelphia's grays ferry neighborhood last night. police say a single shot was fired from a car that entered a rear driveway on the 1800 block of south 31st street. the child was outside playing basketball with more than a dozen others when he was hit in the foot. no arrests have have been made. no charges are expect to be filed against a septa bus driver who fatally hit a pedestrian overnight. investigators say a man was hit by that bus at 11th and walnut and then dragged five blocks. the driver was not aware he a had hit anyone until authorities pulled him over at 11th and vine. police say bus was equiped with cameras and they are examining them. five-year anniversary of the deadly duck boat crash on the delaware a lawsuit has been filed in another accident involving ride the ducks. last may a woman was hit and killed by a duck boat while crossing the the street at 11th and arch. syma? >> reporter: jessica, those duck boat toursoa intersection but according to a lawsuit filed today folks are trying to get those duck boat tours off the streets and out of the the water. >> you don't promote philadelphia tourism by drowning and crushing to death tourists. >> reporter: a lawsuit is trial to put brakes on duck boat tours in philadelphia suit has been filed exactly five years since a duck boat accident in the delaware river killed two hungarian tourist. >> three deaths in less than five years. >> reporter: third victim, liz car nicki was struck by a duck both on may eighth while her husband watched just steps away. >> just horrifying. as you can see him watch his wife get crushed to death in front of his eyes. >> reporter: lawyers say several blind spots prevented the driver from seeing the the victim. >> why didn't he see them? was he distract and didn't look or was it more likely she

was in the blind spot caused by the design of the deadly duck boat. >> reporter: the suit claims that the vehicle's avoid modern day safety regulations because it is made from 1940's chas is. lawyers say drivers are distract because they act as to your guide. the the duck boat company says that is not true, they released a statement saying in part our equipment is regularly inspect to insure a safe operation on land, water and our drivers are trained annually on safe driving procedures. the lawyers also are suing the city for not having a pedestrian traffic light the at intersection. >> did not have the traffic signal that she needed to let her know whether it was safe or not. >> reporter: and the duck boat company also points out that their driver did not receive a citation in that accident and eyewitnesses say she was distracted. now, we have reached out to the city for a statement but officials tell us they do not comment on pending litigation. we are live in olde city, syma

more legal troubles for donovan mcnabb arrested for dui in arizona gilbert police department released his mug shot. they said he was impaired by alcohol and rear ended another vehicle stopped at a red light. this a alleged incident happened on june 28th. in word if anyone was injured mcnabb was arrested for dui in 2013. subway is suspending its relationship with spokesman jared fogle off fbi agents raided his home today. fogle was caught on video leaving his zionville indiana home this morning. agents were seen taking electronics out of that home. the raid is believed to be connected to the child pornography investigation involving a former employee of fogle's foundation. that foundation focuses on childhood obesity awareness. >> we didn't see him. mostly his family and his wife and stuff like that but we

never saw anything too strange. we figured he like to remain private. it is weird to see this going on. you wouldn't expect it from a family like that. >> fogle a has not been arrested. he became subway's pitch man after losing 200-pound while eating their sandwiches and exercising. a popular tourist destination in washington state became a death trap when chunks of ice felon people inside a frozen cave. cbs news correspondent brian web tells us hikers go inside the dangerous ice caves despite warnings from authorities. >> crews will be working to recover person killed when part of the big four ice caves collapsed. it happened 70 miles north east of seattle at the a tourist site that authorities warned was dangerous, because of warm temperatures. >> because conditions of the ice are so dangerous at this point, teams from mountain rescue and other rescue volunteers are looking at conditions of the ice to see how safe it is. >> reporter: monday evening

it is a big welcome home for team u.s.a., woman's national team is celebrating the world cup title. champions celebrated with fans and a lot of them during a big party in los angeles this

afternoon. of course, on sunday, the team won the first u.s. women's world cup since 1999, delran, new jersey carli lloyd the star of that game, scoring three goals in just the the first 16 minutes. >> it is amazing i want to thank you guys for all of your support. it was an unbelievable sport. great to be here in l.a. we look forward to traveling all over the u.s., and we thank you you guys. you guys are the best fans in the world. >> very excited stuff there. team u.s.a. defeated japan five-two. >> such a fun day exciting stuff. >> so exciting. >> they took lead early and then exciting from here. >> now our local girl in there, it was awesome. >> i know, the the best. >> how about that weather. >> it is not the best. it is a great pool day for kid that went in the afternoon to jump in the area pools. we don't have a whole lot of thunderstorm activity either which is great news. we had half heavy storms last night.

tonight is quiet but we will watch tomorrow and then gannon thursday for another round of thunderstorms. we will get heat and humidity. those storms just like to form, storms thrive on heat and humidity. we've got that plenty over next few days. lets go to the poconos which just got hit with heavy thunderstorms and just heavy rain. it is breezy right now as tree blows in the breeze in carbon county and it is gray, in the sky as well, but looks dry. it doesn't look to be raining in the poconos right now. i want to show you the big picture on storm scan three. this is a strong cold front moving through the u.s. we have been tracking this, and finally it is getting closer to us. this will get here tomorrow. with the heat and humidity drawn in ahead of it showers and storms have been popping up all day mostly off to the north. showers and thunderstorms up through poconos and lehigh valley and couple over bucks county right now. once this moves on out we will stay pretty dry for the remainder of the evening a and overnight.

just a few thunderstorms in northampton county, i80 into new jersey and a few showers over bucks county. rest of the region is quiet for now but we will be watching tomorrow. tomorrow looks like today storms mainly scattered in the afternoon. so far we are not in any risk for severe weather. i will let you know this that changes but heavy rain would be biggest threat with any storm that pops up tomorrow afternoon or evening. it is hot out there. 90 degrees in the city. eighty-seven in wilmington. eighty-eight in millville. few other cities in chester we're at 87. deerfield 87 as well. white hall is 85 degrees right now. dew point is in the upper 60's to near 70's. today's high 903 above average. record is 103. our current temperature dew point is 67. that puts us in steamy to oppressive. that is just about right if you stepped outside today. it definitely feels steamy. very close to oppressive. heading in the next couple of days better wet's head by friday, high pressure builds in. friday is a beautiful day. saturday looks nice as well, as we start off the weekend.

oath. after decade of dodging rape allegations cosby admitted to giving drugs to women he was pursuing for sex. these new details are from newly released testimony from a sexual assault lawsuit brought by andrea connstand a former temple university employee. one of the cosby's accusers called the revelation slipped case. >> i mean he called me and the other women a liar, in the press. and, now, people know that we're not liars anymore. >> reporter: more than two dozen women accused the philadelphia icon of sexual assault. four montgomery county district attorney bruce castor decline to bring charges against cosby in the andrea conn stand case. now that the case is public he is explaining his decision. "eyewitness news" reporter alexandria hoff is live in the sat center with that part of the story alexandria. >> reporter: jessica mr. cosby could not have expect these comments to be made public because they were supposed to remain sealed as part of the settlement deal. now the former montgomery county district attorney says

someone on cosby's legal team drop the ball. in february of 2005, then montgomery county district attorney, bruce castor released that he would be bringing charges against bill cosby for at ledge assault of the former temple university employee, saying that at the time he found that insufficient credible, admissible evidence exist upon which any charge against mr. cosby could be sustained beyond a reasonable doubt but with the release of these most recent transcripts he says he is now able to reveal more about the decision to not prosecute a man he believes to be guilty. >> i thought that the record would be sealed, and would i go to my grave being the only one who knew, how it is that we had set this scenario up to get him. >> reporter: castor believes by not prosecuting a weak criminal case he stripped cosby of his fifth amendment right forcing him to provide testimony in the civil case that followed, and allowing the victim to be awarded damages. >> did he know that the judge

would unseal those documents? i guarantee you he didn't know that. >> reporter: but because the judge did there is an advantage, according to castor who is also rerunning for district attorney. >> if, in fact, i am the d.a. in january what i would do is i would get those depositions i would have our people tear them apart word for word and try to disprove all of the facts in there that were material. >> reporter: if that works and falsehoods were found he could charge cosby with perjury. now, here's the interesting part about that, there is a five-year statute of limittation on perjury charges. so one would think that would of expired in 2010 but castor says that begins when testimony is released. since that happened this week that side of the case can be explored until 2020. live from the sat center, alexandria hoff, cbs-3 "eyewitness news". >> very interesting information there alex, thanks very much. keep it right here on "eyewitness news" for the latest on the story.

get latest anytime on line at cbs philly.com. they have dismissed freshman deandre johnson from the football team after being caught on camera punching a woman. you can see in this video from the bar. johnson and the woman were in the altercation. he then punched her in the face while grabbing her other hand. it is not immediately clear what the confrontation between the two was about but johnson's attorney says the woman used a racial slur. this video has shocked florida state students. >> i don't know why wow do that especially it is just a woman, you know, not acceptable. >> that is just crazy. i hate to see a man hit a female, i just don't like that. >> this incident happened june 24th johnson has been charged with misdemeanor battery. a big step today for removing the confederate flag from south carolina's capitol ground. the state senate there approved a bill to remove flag and tomorrow that proposal

heads to the house. cbs news correspondent don champion has the very latest. >> reporter: confederate flag still flies outside of south carolina's state capitol while lawmakers debate whether it should come down. >> i. >> reporter: state senators gave final approval this morning to remove it but the bill must still be debated and voted on in the house. reverend jesse jackson visited protesters calling for the flag's removal monday night today he is meeting with the governor to talk about moving forward. >> a lot of hate left but there is more hope and healing. >> reporter: the debate here is not just about the confederate flag but the fate of the pole it flies on is also in question. most democrats want the pole down while some republicans are calling for a different flag on it. >> it is about heritage, it is about honoring over 300,000 southern americans who bled and gave their lives. >> reporter: governor nicki haley promises to sign the bill if and when it reaches their desk.

the fall out continues over bill cosby's deposition admission, but what could it mean for the comedian in the courtroom, moving forward. good evening i'm jessica dean. tonight we are hearing from the attorney of three women involved in the defamation suit against cosby "eyewitness news" reporter steve paterson has more on the story that is getting national attention. >> reporter: it is a big big deal. >> reporter: to the general public, following the fall of bill cosby monday's revelation may be a new salacious twist casting more doubt on the embattled cosby but to the attorney joe cameraata it is difference between winning and losing one of the nation's most high profile cases. >> these ladies are victims. >> reporter: he represents three women in the massachusetts defamation case against cosby. we spoke to him through face time. >> when they accused mr. cosby

of sexually abusing and assaulting them, he responded by branding them liars. >> reporter: monday formally sealed testimony from a 2005 sexual assault lawsuit quotes cosby admitting he gave drugs to women he was pursuing for sex. in a transcript an attorney asked cosby when you get quaaludes was it in your mind you would use these quaaludes for young woman who you wanted to have sex with? cosby police yes. when lawyer follows up with this question quote did you give those young woman quaaludes without their knowledge. cosby's attorney makes several objections, and the comedian never answers. the case was settled. the documents sealed in 2006. cosby has never been charged with a crime and statute have of limitations on mess of the accusations has expired. but cameraata says in an active defamation case this new admittance may mean justice. >> it will be helpful to the victims that have claimed that they are telling
