sunday. temperatures on the warmer side but humidity levels still low. let's break down your day 9:00 a.m. temperatures still in the mid 70's, pleasant in the sunshine. up to 84 by noon time. by 3:00 we will reach our daytime high temperatures with a high of 89 for philadelphia, near the shore around 83 degrees mountains look good with a high of 80. we will talk about the extended forecast with better chance for showers and storms coming up as well, that is coming up in a few minutes. nicole, back to you. right now a disturbing allegation against owner of the restaurant in the popular philadelphia neighborhood. police arrested 41 year-old alex capasso as part of the federal child pornography investigation. capasso is co-owner of the crow and pitcher in the rittenhouse neighborhood. "eyewitness news" reporter david spunt has more on the investigation. >> reporter: for customers everything seemed normal friday night at crow and the pitcher in rittenhouse square. the employees are still coming to grips after co-owner and head chef alex capasso was

pick up for his alleged involvement with child porn. >> how do you expect something like that. >> reporter: michael franco and alex capasso opened up the place just over a year ago. authorities arrested capasso on monday but his collogues just found out late friday afternoon. >> the last three hours have been like a tail spin. i haven't seen him for the whole week. >> reporter: according to federal document obtain by "eyewitness news" capasso allegedly sexually abused a five-year old girl and had pictures to prove it. she's niece of one of his friends according to authorities. the paperwork describes capasso texting in under cover police officer in washington d.c., who claimed to have a nine year-old daughter. the under cover officer told capasso that he had permission to touch the daughter. text messages paint a disturbing picture, according to court documents the undercover agent said cool, what all are you looking to do? i do have a few limits with her.

capasso allegedly responded oh, i would be happy to watch but will go as far as you allow, what are the boundaries? the rest of the conversation is too graphic to share. >> i just can't believe it is somebody who runs a restaurant in my neighborhood. i cannot even wrap my mind around it. >> reporter: rosa lee has spent time inside capasso's restaurant. >> there are children that come by here all the time. >> reporter: office's rested capasso at his collinswood home. things were quiet outside the home friday night. >> we really became like a family, so it is hitting us hard and it is, now we're just going to ban together and continue to do what we are doing. >> reporter: alex capasso will face that charge in washington d.c. his bio has been removed from the restaurant web site. according this document capasso admitted to having those photographs but he found them on the internet reporting from rittenhouse square, david spunt for cbs-3 "eyewitness news".

the accused killer of a drexel university graduate sits behind bars this morning. the authorities say the former handy man had access to that victim's apartment even though he lost that job and had a lengthy criminal history. natasha brown has the very latest from police headquarters. >> he is a monster and we're very happy to get him off of the street. >> reporter: thinks the face of the monster police are describing, 56 year-old career criminal, james harris, now charged with the murder and sexual assault of 27 year-old jasmine wright. >> he has god 31 priors, back in 82, he was arrested for killing his own father. he has been arrested several times for sexual assault several robberies and burglaries. >> reporter: recent drexel graduate was found beaten, strangled and sexually assaulted inside her third floor apartment in the 200 block of south 50th street. witness accounts coupled with dna and fingerprints led police to the prime suspect harris, who worked as a handy man in the victim's building. he had been fired a week prior to the murder but was last seen entering the building

july 16th, 30 minutes before the victim. >> he broke into her apartment, and she came in, about 30 minutes later after she was inside the apartment. she was on her cell phone talking to her mother who lived in virginia. at that time he attacked her. >> reporter: police are still trying to filing another out why he still had keys to the building a question that haunts this resident who said he lives in another building owned by the same man who owns the the property along 50th street. he didn't want to be identified. >> if you have some kind of business where you have people thaw are renting to, you should have a system or procedure that you do, prior to you hiring any people, you know handy man's or maintenance guys because if in the, anybody can just come in here. >> it is a terrible thing a there isty. >> reporter: back in jasmine wright's neighborhood resident grabble with grief gratitude with news of an arrest. a memorial continues to grow honoring a young woman whose life was cut too short. >> i'm very grateful, grateful

that the mother and father has closure, thank new this matter. you know, somebody that did some harm to more than just one person. >> reporter: police say harris is not being cooperative win investigators. they have still not uncovered a motive in this case. meantime he is currently facing murder rape, robbery burglary and other offences. at police headquarters, natasha brown cbs-3 "eyewitness news". 6:07. philadelphia swat officer wounded in a shoot-out is new recovering at home this morning. officer francis whalen took a shot to the bullet-proof vest while executing a search warrant on wednesday. authorities say that murder suspect devon guisherd was killed in the shoot-out with police in a northeast philadelphia apartment. officer whalen was checked out of the hospital for a bruce to his stomach and then released. well, we're now learning more about the gunman behind the deadly louisiana theater shooting. twenty minutes in the film train wreck, 59 year-old john houser, stood up and opened

fire killing two people and injuring nine others all before taking his own life. as cbs news correspondent kenneth craig reports police are beginning to piece together a time line of what all happened. >> reporter: yes. >> this was a slow met california it was barbaric. >> reporter: fifty-nine year-old john houser, ambushed movie goers inside this theater in lafayette louisiana thursday night. he sat near the top of the screening room and waited until the movie got underway and then opened fire. lucas was just 60 feet from the shooter. >> you could see the the flash from the chamber it was awful. >> reporter: twenty-one year-old macy breaux and jillian johnson was killed and nine other injury. >> one of the surviving wounded victims played dead to stay alive. >> reporter: witnesses say houser exited and was reloading his gun as police were arriving and ran back inside fired several more round before he took his own life. in 2008 houser's family had

first responders with several bystanders, lift a car to rescue a woman trapped underneath. surveillance video captured that crash on july 9th. a woman in her 40's was riding a motorcycle when police say she was hit by a nissan altima as driver tried to change lanes. that woman was pinned underneath her helmet wedged in the ground gasping for air. >> we tried to make sure that she was still alive still breathing, something.

humidity. right new in the 50's. that is why it is so comfortable outside. check out this shot down the shore. beautiful sunrise the atlantic city. ocean conditions calm. great beach day maybe go swimming later on this afternoon. rip current risk is low. pretty much flat conditions in the ocean though. surfing is not that good but not bad for some stand up paddle boarding in the atlantic ocean today. lets talk about the the dew point temperatures i was mentioning just a second ago. right now in the mid to upper 50's, compared to last weekend at this time we were in the mid 70's. the that is what was indicating a tropical air mass. this is very dry. typically that is what you see in the spring and fall, in the late july, so enjoy it. it will feel pleasant today tomorrow humidity levels start to increase a little bit. if you dent like humid conditions, to i day is your best day of the weekend for you. monday tuesday each day gets a little bit more humid as we progress in the middle of the next week and bring back some heat as well. the nice and quiet high

city's sky line and you can expect detours for at least the next few weeks. commerce building was built in 1965 and hailed as a sign of camden's progress at the time but now with the property at broadway and federal streets will be turned into a parking lot. demolition is expect to take about two weeks and during that time streets around the demolition site will be closed to traffic. buses will also be detoured. also happening today the pop up beer garden at center of the nasty battle between its owner and philadelphia officials will reopen. the point breeze establishment has been shut down twice in just two weeks. "eyewitness news" reporter syma chowdhry is live with more on that battle, what is happening, syma? >> reporter: well, nicole, as you know pop up beer gardens have been popping up throughout philadelphia this summer but the developer of this point breeze pop up beer garden has been fighting with the city to keep his opened. >> first, just too much red tape. is there too much bureaucratic nonsense and too many circumstances like this that keep people from coming in.

>> reporter: developers john longacre is upset avenue was forced to shut down point breeze peer garden twice in two weeks. empty lot he says had been an eye sore for 30 years and was filled with trash. he spent $60,000 to clean it up. >> there were magnum 357 shell casings, drug bags, syringes, a class my bag trash every where. >> reporter: pop up beer garden needed state issued liquor license something longacre obtained but six weeks after being opened longacre says, without warning, l and i shut them down citing zoning issues. the developer says's replied for the permits but was still not allowed to opened. >> that has been the most dysfunctional department that we have had to deal with maybe ever and i have been working in the professional capacity with that department since 1996. >> reporter: both side have been going back and forth in court. longacre does not understand what the issue with the beer garden is. >> i don't know whether it is

your carpet act quickly but don't be too had hasty. make sure you are using the right tool, use a dry clean cloth and blot don't rub in the stain otherwise it might lead to a lasting stain. >> reporter: blood can be one of the most tricky things to get out. >> if the blood started to clump you will want to take a spoon or a very dull type industry butter knife something of that nature and remove it first and then blot it out with soap and water solution. >> reporter: use cold water for blood stains but erect mend a cup of warm water mixed with a quarter cup of dish washing liquid for just about everything else. there is another trick when dealing with a spilled glass of red wine. >> red wine can be one of the toughest stains but it can be solve. what you need do is first blot the spot where red wine has been spilled and then if you sprinkle some white wine on top of the red wayne you'll improve your chances of getting that spot up. >> reporter: angie says certain stains are best left
