conspiracy. >> under my public faith in government. >> reporter: allegations of political corruption surround congressman fattah, and four of his associates. a 29 count indictment stems from five alleged schemes circling around miss appropriating federal charitable and campaign fund. officials say one of the schemes happened during fattah's fail mayoral run back in 2007. the time states that the congressman borrowed a million dollars from a wealthy supporter, and paid some of it back using money and federal galant from a non-profit charity he controls f take is accused of giving campaign money to pay off his son's student loans totaling $23,000. but fattah and one of the co-defendants are charged with claiming, to host a non-existent annual education conference just to get a federal grant. another scheme alleged that he hid a bribe payment for personal gain. >> there is a mortgage in play

"eyewitness news" reporter cleve bryan is at the scene with the very latest information on an arrest, cleve. >> reporter: ukee, that is got news now, an arrest was made about an hour, within an hour after the incident and the victim here did not sustain a life threatening injury, from the gun shot wound. all this happened back in the stable area, somewhere you may not see very often at the delaware park. one employee here described what he saw as being somewhat chaotic. >> it is unheard of. >> reporter: troy bucket was hard at work at delaware park's stables when this started to go on around him a manhunt for a suspect gunman.

>> i heard helicopters. i said what is going on? that is when i heard. >> reporter: just before 9:00 a a.m. delaware state the police received a report of the shooting in the race track stable area. >> while in route they were advised an male victim had been shot and transported to christiana hospital in newark. they were advised that a male suspect had fled the area, and in a vehicle. >> reporter: using their helicopter state police located the suspect vehicle at nearby court apartments. as troopers in and new castle county police, swarmed the complex the man surrendered. >> right now we have the suspect in custody and he is here in troop two being questioned. >> reporter: police say victim and suspect both work at delaware park. shooter is a jockey and victim a trainer. they say jockey hit the trainer in the abdomen with the single shot the for what they were described in general terms as a personal dispute. soon after the arrest police recovered the gun near a street near stable. troy bucket says he has never seen any problems like this among the people that work with the horses at delaware

a driver was killed after flood waters washed out a road in kentucky. authority found would the man's body trapped inside her car. storms stopped heavy rains on the area last night. first responder who helped search for a victim later learned that she was his own mother, when he found her. and an s suv landed upside down after being swept off the road by flood waters.

humidity. lets look outside and see how evening is shaping up. few cloud drifted in and that has limited the temperature a little bit outside. temperatures in the lower 90's at the airport. not too bad but feels very steamy. feels five to 10 degrees hotter then thermometer indicates this evening. kind of the cloudy, overcast evening at least here in philadelphia portions of the area still seeing full sunshine this afternoon and this evening but boy it is hot. we are tracking a couple showers and storms off to the south across portions of kent, sussex counties in delaware. the rest of the region is quiet. sprinkle popping up in lancaster county. they are drifting north to south. cannot rule out them making its way in south jersey. they have heavy rain associated with them. you can see dover down toward milford still seeing heavy rain and still a flood advisory for that region. here is our next weather maker a clearly define storm over central canada and this cold front associated with it pushing through great lakes state tonight. that will cross our area tomorrow and bring us threat

twenty-nine count indictment describes four schemes, two involved efforts to pay down debt from fattah's failed philadelphia a mayoral bid. fattah has stepped down from his leadership post as top democrat on the house appropriations subcommittee. fattah has not been arrested and no court date has been set for his initial appearance. pat ciarrocchi joins us from our satellite center with more reaction from some people in his district, pat. >> reporter: the extensive nature of the congressman's indictments has brought reaction that is mixed both of sadness and surprise but among the heaviest hearts it comes from a reaction from his mother mrs. fattah, she has been a community activist who healed rival gangs back in the 1970's. i spoke to her about an hour after the indictments were announced and this is what she had to say to me. i have faith in my son and his innocence and i have faith in god. chaka fattah's political career has had him next to the powerful and needy. >> a good chapel many for the people that he had been in

political office all that time and it is a shame. >> there is speculation he was unnamed in the indictment about six months ago i think so i can't say that i'm all that surprised. >> reporter: the democrat's second district expands neighborhood that reflect wealthy and working class. deep in urban streets of west philadelphia, north to germantown and chestnut hill and west to gladwynn into montgomery county. >> as far as the family i have known them for many years and they are great people. >> reporter: chaka fattah's family and political interests grew out of west philadelphia where they founded the now closed house of e moja which brought unity among rival street gangs. >> i'm shock as a congressman for the youth and he has been in office i thought he was okay. i didn't hear anything negative. >> reporter: in mt. airy corner known as weaver's way bring community organizers together. pam is one of them. >> he has been on the right side of so many issues, it is

get more anytime at cbs philly.com. a university of cincinnati police officer who shot a driver during a traffic stop is now charged with murder. as cbs reporter marley hall tells us, prosecutors say the officer intentionally shot the man. >> reporter: university of cincinnati police officer ray tenton surrendered to authorities wednesday, he is being indicted for murder of four three-year old samuel duboise shot death on july 19th. >> this is, without question, a murder. >> reporter: the prosecutor released the officer's body camera video that shows him pulling him over for missing front license plate. dubois hands the officer a bottle of gin and says he does not have his driver license on him. he asked him to get out of the car. dubois restarts the vehicle. the officer ordered him to stop and fires one shot. >> people don't get shot for a

traffic stop unless they are violent toward the police officer, and he wasn't. >> reporter: the prosecutors say the officer's claim that the car dragged him is not true. dubois family says without the camera they wouldn't have an indictment. >> we knew the video was going to vindicate our brother. >> reporter: tenson's attorney says the officer broke down in tears when the indictment was announced. he will ab rained thursday morning. marley hall for cbs-3 "eyewitness news". also developing, u.s. officials are investigating reports that one of the america's long time enemies is dead. white house says reports of the taliban leader mullah omar's death were credible and the intelligence community is looking into them. correspondent jonathan vigilante reports from london. >> reporter: afghanistan's top intelligence agencies says country's illusive taliban leader mullah omar is dead. authorities say he died from natural cause necessary a pakistani hospital more than two years ago. but taliban spokesmen refutes

purchased numerous items of military combat gear, including night vision goggles, other items which can be used in the military or violent context. >> reporter: if convicted he faces up to 15 years in prison. a fire damaged home is at center of the investigation by city inn expecters and the fire marshall today. let's show you the scene this morning on the 300 block of ease tuscolumn street in kensington. fifer started at 5:00 a.m. and engulfed this two story home and destroyed the front. the only man inside escaped without injuries. the cause of the fire is still being looked into. a man was rush to the hospital overnight after he was hit by a csx freight train in bustleton. it happened just before 3:00 a.m. near grant avenue and welsh road. it took emergency crews two hours to free the 46 year-old man who subsequently, had his leg amputated. he is in stable condition we're told this evening. it is in the clear why the man was on the train tracks at that time.

well today's philadelphia office of emergency management teamed up with police and fire fighters to practice some response for a mass casualty incident. this was the scene at at&t station on the broad street line. the drill simulated a decontamination response if a chemical were to be released intentionally at the subway station. those who a appeared to be injured are all volunteer actors. emergency management director samantha phillips explains how critical these rehearsals are. >> it is really important that if this were to happen in the city of philadelphia that the public listen to first responders listen to the philadelphia fire department, listen to the philadelphia police department and follow actions. it is just all for the public safety. >> there were decontamination stations set up throughout the area as rehearsals lasted for multiple hours. about 1,501st responders and 75 volunteer actors participated in today's drill. new banner is hanging in advance of the pope francis
