really creeping in after midnight. and then another round of strong storms in the afternoon. so look at what's happening right now heaviest rain is still well off to our west. what you want to watch all this rain right here over portions of west virginia and into western virginia and this is all lifting north and eastward and eventually will be lifting into our region but we do little bit of rain already falling across portions of the area at the moment as we scan the area you can see a line of showers extending from montgomery county right down into portions of camden and gloucester counties here and down toward the shore points as well from 7 miles down towards cape may point you're getting wet at the moment. rain south and west of philadelphia toward elmer, ridley upper darby seeing pretty steady showers at the moment. southward down near writes mills clayton along 55, 47, seeing slow downs thanks to some pretty steady showers right now. this is just the appetizer. main course comes in overnight and it's really by about 2:00 a.m. we start to see heavier rains living in. we had little bit of separation

off to the west that first batch lifted to the north what we're watcwatching is this southern mt ban lifting in four, 5am from the south and west. you can see 6am heavy rain lightning and thunder moving through by 8am that band starts to lift out watch what happens in the afternoon. another round of scattered showers and storms move through. while the heaviest is in the morning, the storms in the afternoon can also be locally stock. so what to expect overnight scattered showers now. then thunderstorms and heaviest rain arriving between 3:00 a.m. and 7:00 a.m. across the region. downpours and gusty winds for your early tuesday morning. watch for ponding and slow travel especially during the morning commute. and to a lesser extent again in the evening as another round of scattered storms pops upcoming up i'll have better news though when i bring you the seven day forecast in just a few minutes. ukee and jessica, back over to you g see in a bit, kate. thank you tonight "eyewitness news" has learned city officials plan on meeting with business owners who have concerns about the upcoming papal visit. in visit is of course expecte ed to bring more than a million people here to philadelphia.

>> "eyewitness news" reporter david spunt is on the steps of the art museum right now with more on this meet. david? >> reporter: ukee when pope francis comes to philadelphia he'll stand not far from where i'm standing of course it could always change based on security tonight. city officials and mayor nutter admit there will be a meeting with business owners, but they won't give specifics. things were biz easy early monday morning inside a few block from the art museum the shop should be packed. the weekend pope francis is in town. but as of now, it will be empty. >> it's too much security for to us come in and our customers to come in and just get deliveries out. >> reporter: corrine dennis is the store manager and says employees don't want to stay open. sight citing concerns about actually running the business. that could be a lot of business for you guys. >> it really could be a lot of business but we really don't know. taking a chance with this. >> reporter: "eyewitness news" has learned city officials will

"eyewitness news" reporter diana rocco is live with more what's happening in ferguson and also a local protest. diana? >> reporter: that's right, jessica. lot happening in the city of ferguson missouri tonight.

the city is now under a state of emergency and tensions between protesters and police still remain high. very reminiscent of the violence we saw just one year ago. >> so many of our brothers and sisters have been killed. >> reporter: holding sign as few dozen philadelphia demonstrators on broad street stand with protesters in ferguson monday who mr. again clashing on the streets with police. >> demonstrations continued with a walk to the courthouse where many were taken into custody outside the say lewd courthouse for crossing police lines and staging a sit in. county police are now in charge and have issued an emergency order. >> we are trying to to do everything that we can to protect life and property. and last night it was demonstrated 50 shots rang out our community has come too far and has worked too hard to be set back again report roar tension are rising after peaceful protest turned violent sunday more than dozen shots

rang out and 18-year-old was critically wounded by police when a gun fight broke outpatient between two groups on the street. police undercover vehicle fold one of the shooters as he fired on them. they fired back. tyrone harris was hit multiple times is now facing multiple charge. >> they were criminals. they weren't protesters. protesters are people out there talking about a way to affect change. >> monday 200 demonstrators marked the one year anniversary of the death of michael brown. the officer that shot him was cleared by a grand jury and the department of justice. still many chanting and carrying signs a local pastor working to diffuse racial tensions was talking about the angry crowd. >> we have got to have patience. this didn't happen overnight not going to changeover night. >> reporter: since michael brown's death one year ago, ferguson has a new black police chief city manager and two new city council members. also an investment of half a billion dollars has helped to crow 881,000 new job there is.

in satellite center tonight, i'm diana rocco cbs3 "eyewitness news". >> diana, thank you. one person is dead and two others are wounded including a child after gunfire breaks out in wilmington. "eyewitness news" in the 400 block of west seventh street. 25-year-old woman died at a hospital. a four-year-old girl was shot in her legs and taken to a hospital. we also know a 51-year-old woman has been hospitalized. tonight police are still investigating. later this week we expect to hear from pennsylvania attorney general kathleen cane can about the criminal charges she's now facing. kane will answer questions at a news conference in harrisburg on wednesday. she was are a rain over the weekend after being accused of of leaking secret grand jury information to a newspaper reporter and then lying about it under oath. kane insists she is innocent and has resisted calls to resign. tolls could be going up on the tacony-palmyra bridge and burlington-bristol bridges. tonight the burlington county mitch commission held the first of two public hearings on

proposal toll increase much another forum tomorrow. a vote is expected wednesday. currently the toll is $2 a car. e-z pass users would see their tolls rise to $3. cash users would see arise to $4. lyme disease is a serious illness that not only affects humans but also our mets. >> pennsylvania alone 13% of dogs have been diagnosed with the disease. still ahead tonight, how you can keep your dog safe. >> plus, a popular beach area at the jersey shore shut down. beach erosion carved cliffs out of the sand. we'll tell was is being done to stop the dangerous conditions. >> kate. >> and rain tracking tour the area right now. let's take look at storm scan3 you can see the heavy rain just off to our west. it's all lifting into our region overnight. but we won't get in and get it out. it looks like tuesday from start to finish could be a stormy day. i'll have the latest details coming up. >> also tonight, the eye opening study the government kept hidden for years. hair traffic controllers confess about sleeping on the job.

visual proof tonight of an environmental mess in colorado. river there that was pristine has turned a mustard color. after contaminated water from a mine was mistakenly dumped into the river. so far more than 3 million gallons have flowed into the river and epa team was using heavy equipment to enter a mine near durango and that team accidentally caused the couldn't dam natalled water to flow into the river instead of pumping it out and treating it. the water now contains iron, sing and copper. cities downstream in new mexico at risk as the water flows into the san jawn river. the demanding work schedules for air traffic controllers is put air travelers at risk. that's according to study which the government has kept secret for nearly four years. the study found that 61% of air traffic controllers admitted to

catching themselves about to doze off while on the job. it also found that nearly two in 10 controllers had committed a significant error in the previous years. big announcement from google today. its create agnew company called alphabet. the company says alphabet will be compromised the core google business including internet searches and youtube but also include newer businesses that will be managed separately. such as google fiber. google co-founders will still run alphabet but new ceo will be named. on the cbs3 health watch night it's been called the silent killer but new research shows more than women than ever are surviving ovarian cancer. recent study shows women diagnosed with the disease are now 50% less likely to die from it than women diagnosed decades ago. doctors credit new drugs and new chemotherapies. the biggest risk factors for developing oh vare can yann cancer are age and family history.

pennsylvania continues to lead the nation in confirmed cases of lyme disease for three straight years now. it's not just a problem for people. dogs can be infected. >> health reporter stephanie stahl has more on a vaccine for our four leg friends. >> tiny dicks that cause lyme disease can be especially difficult to find on dogs and most dogs exposed to the bacteria don't have symptoms. those who do get sick from the tick bites can run the range from mild to severe. vets say young dogs app per to be more susceptible. >> painful, all four limbs, um, you know, not eating, owner says not himself the past few days. fever like 105. very very sick dogs. >> reporter: people cannot get lyme disease directly from a pet but the tick that carries the bacteria can bite and infect both dogs and humans. there is a lime vaccine for dogs developed from human vaccine which is no longer available to people because of complications. >> it seem to be very very safe.

people and dogs are quite different roar report k9 lime vaccines is a series of two shots as puppy with yearly booster. >> it actually anti bodies in the dog's bloodstream actually go into the tick and then prevent the bacteria from ever going into the dog. >> reporter: vaccine is used in couldn't fifty one gentlemen routine tick prevention for dogs. >> a lot of people are thinking it can take the place of prevention, which is it definitely cannot. lyme disease is diagnosed in both dogs and humans with a blood test and both are treated with antibiotics. but there can be chronic issues related to lyme disease. i'm stephanie stahl, cbs3 "eyewitness news". 12 year old boy is hospitalized after sand suddenly caved in on him at the beach it happened in surf city. lifeguards and other beach goers freed the boy eyewitnesses reported bystanders performed cpr. the boy was flown to the hospital and is in stable condition tonight. it's not known what caused the sand to clap but the boy was reportedly digging a hole at the time.

chopper three over sand cliffs on the beach caused by erosion. >> dangerous drop off forced the closure avenue popular stretch of avalon over the weekend. take look at it from the ground. the cliffs were about 5 feet high they stretched for about mile and for two days strong northeast winds hit the sand hard. sand from a recent beach replenishment project headed south and created the cliff. >> the sand that was displaced by the natural from the wind will wind up on south end beaches and avalon is progressive to the point we do back passing projects in the winter we take the sand that was in the north end that washes to the south and mechanically relocate it back to the north end where it belongs. >> beach patrol had to shut down a second of the north end until crews korea grade the sand and smooth it out. now all beaches are back open. unfortunately, it will be a little rainy over the next, what, few hours you can say. >> at least. and tomorrow doesn't look like a great beach day. doesn't look like a great day for any outdoor activities.

>> between three and seven in the morning the heavy stuff. >> that's when the heavy stuff will arrive but all day tomorrow watch for these pop up showers and thunderstorms even once the heaviest rain moves out of the. sometimes we get these fronts that come from bring rain for an hour or two and out of here. we clear it out a nice day behind it. this is not that kind of a storm. we'll be dealing with rain and at least showers and thunderstorm all day tomorrow. but if you're out now, you're enjoying perhaps a nice evening in ocean city. it looks like it has thinned out little bit monday night there most of the shops closed up and the rides closed as well looks like most of the rain though the showers at love missing ocean city just off to the south. still looks to me as if the boardwalk is generally dry maybe a little bit damp out there. kind of see a little bit of reflection here this light shining on a few puddles a couple of sprinkles at leave moving through that area at at the moment. you can see a couple of light showers are pushing through portions of the shore points but the heaviest of the rain that we're really watchin watching is right here all going to converge on our region overnight and into the early morning hours. so this is just a taste so to

speak this line of showers right now pushing that was center city, montgomery county, and extending right down towards the shore points it looks to see ocean city is getting at least a little wet at the moment. temperatures right now, we're in the low 70s. everywhere september for mount pocono it's 64 right now. seventy two in philadelphia. it's been a cool day most of that thanks to a southeast wind keeping temperatures really below average. the ocean water in the low to mid 70s. we haven't been able to rise much above that. southeast wind continuing to impact the shore points as we await the arrival of this advancing system. so warm front lifting through overnight much cold front will follow tomorrow and they both have heavy rains associated with them. here 4am. steady rain across the area. that first batch lifts out by noon tomorrow. heavy rain over new england but notice another round of scattered showers and storms will develop on the back edge here. by tuesday at 3:00 o'clock that then clears out and even though wednesday looks like much better day that cooler drier air comes in. can't rule out a couple of instability showers. the worst of it by far is overnight and into tomorrow

morning. showers and storms will bring downpours half an inch to an inch between 3am and 7am and then scattered gusty thunderstorms between 2:00 p.m. and 6:00 p.m. so through the day tomorrow, we're talking as much as half an inch to maybe an inch of rain. some of our models have it .95-inches in philadelphia. so half an inch to an inch. highest risk with these storms downpours also wind and lightning very low risk of hail and tornadoes. as far as the overnight hours again scattered showers now. that heavier rain comes in late. and for the first part of the morning commute it looks like it will be raining heavily out there. definitely make sure the windshield wipers in good working order you want the umbrella tomorrow. 82 degrees will be the daytime high. maybe few breaks of sun if we see any break in the cloud cover it will be midday. the worst of it in the morning and again in the afternoon just in time for those two commutes. wednesday though improvement. partly sunny, breezy maybe a stray shower at 86. thursday is the winner of the week. 84, low humidity, gorgeous day. friday warmer and then another hot sunny summer weekend if
