victim, could this have been a, accident, according to family members there is no excuse. >> family who did not want their faces shown, did want their voices her. >> we just want y'all to necessity we love him and that he was a very loving child and that whoever did this, we want justice for him because this should never have happened. >> reporter: just before 2:00 a.m. wilmington police say a ten year-old boy was shot in the head inside a home on the 700 block of towns end place. that boy was then rushed to du pont children's hospital. twelve hours later police return to the scene, to once again block off the streets and collect evidence. >> i don't know very much. other than it the is just a constant, constant, and it is just tears at your heart, you know, you feel home less, helpless. >> reporter: neighbors say rick tim's family had just moved to the block several weeks ago from a few streets away. family members called the boy energetic, loving, and about to enter in the fifth grade. woman who identified herself as the victim's grandmother also did not want to be shown,

she's out for answers, and actions. >> we will lay down in front of the city hall, we're march, we are going to go to the streets. that is where it the is all happening on the. we will take it to the streets. >> reporter: family members identify the victim as the young boy, that is the young boy police have not told is his last name. he was in critical will but stable condition at this hour, and it does appear whatever was go wrong when we first began here moved out back. we will have more on that very soon, jessica. reporting live, alexandria hoff for cbs-3 "eyewitness news" good thank you very much. philadelphia police make an arrest in the vicious attack on a five-year old girl. a 15 year-old boy is accused of kidnapping that little girl from her north hutchinson street home last month. then beating and raping her. the child's mother found her daughter bloody and unconscious and in the family's backyard. police have yet to release her attacker's name but say he faces several charges including attempted murder, kidnapping and rape.

are connected, but police continue to collect evidence, tuesday morning, but the the prime minister promises to find those responsible. jonathan vigloti for cbs-3 "eyewitness news". convicted boston marathon bomber dzhokhar tsarnaev are asking that their client get a new trial. the attorneys filed this request in court yesterday and argued social media made it impossible for jurors to avoid outside information on the bombing and that made it impossible for tsarnaev to get a fair trial. attorneys are also questioning the legality of the death penalty in federal cases. officials in indonesia recovered black boxes from a passenger plane that went down over the weekend. authorities say devices were discovered in good condition, a plane with 54 people on board crashed in the heavily forested region on sunday. there were no survivors. recovery crews are working to send remains to the capitol for identification. the the fbi just announced a $20,000 reward to find two

sending 200 active duty sold tours help fire crews battling at least 95 wild fires in seven western states. the troops currently are training after being mobilized for the first time in nearly a decade for fire fighting efforts. cbs news correspondent chris martinez has are latest from southern california. >> reporter: the devastation is clear, in central washington, at least six wild fires surrounds the town, and blackened more than 111,000 acres. >> they have secured area, reduced the threat to structures, and we have people, out there 24 hours a day now. >> reporter: nearly 3,000 were forced to leave their neighborhoods but many are able to return home. john parker escaped with only his dog and possessions in his truck. >> i can actually say i'm actually homeless. >> reporter: wild fires destroyed parker's home and three dozen others. the fires air monk nearly 100 western wild fires, in california, crews are mopping up a 300-acre fire in the

angeles national forest. cooler temperatures are helping fire fighters get an upper hand on the fire burning here in the area but they are worried wind could cause flare-ups. with so many fires burning, 200 active duty soldiers are expected to join fire fighters on the front lines in several states, this sunday. >> the entire country's fire program, and organization, has been taxed heavily for about the last three and a half to four weeks. >> reporter: fast moving wild fire north of san lewis, has devoured 2,000 acres and threatens more than 300 homes. but crews are hoping extra resources and milder weather will help contain fires here and across the west. chris martinez for cbs news, in california. well, it was a little bit warm out there, no doubt, sun was certainly shining down, a lot of people took umbrellas out for protection from the sun. and a lot of people just trying to make it, through as quickly as they can, kate to

a tiger is taking social media by storm after it got loose inside an old plant in detroit. take a look here, police say it was there for a photo shoot with a british photographer and at some point the tiger got away from his handlers and refused to move from a stairwell. eventually, they got him out. that photographer also got a bobcat and a wolf to the shoot, police, shut the photo shoot down. score one for seal in this amazing video seal just narrowly escaped getting eaten by a great white shark off the coast of cape cod yesterday. marine official caught the the

shark jumping out of the water twice but you can see the seal, just out of his grasp, both times. a car in seattle was weaving in and out of traffic and speeding through red lights. when officers pulled that car over they got more than they bargained for, they found a woman, about to deliver. you can hear police officers delivered a healthy baby girl, right there on the side of the road. an ambulance came, officers got a big hug from dad, and mom and baby went to the hospital to get checked out. family wrote a letter to the officers saying they helped deliver a precious gift and said how grateful they were for all of their help. that will do it for "eyewitness news" at 5:00. developing now at 6:00 an arrest is made in the overnight shooting that left a child fighting for his life. we are live, in wilmington. a local man dies in hawaii trying to save his friend life, i'm greg argos in downingtown with details on

>> reporter: good evening. this past hour has been an active one, as you can see police are on the scene doing investigative work on the block but the thing is, they are doing that three doors down from where this early morning shooting took place. so any relation between that incident and what is going on right now, we're not sure if that is the case. we will stay on that. as for the victim police say that ten year-old is in critical but now stable condition. just before 2:00 a.m. a young boy identified by family as ten year-old nikkei was rushed to dew point children's hospital after police say he was shot in the head. twelve hours later an arrest was made in relation to the crime, relationship between 24 year-old jahlil goldsboro and boy has not been confirmed by police. also the nature of this crime, aside from the illegal use of the firearms is still unclear. cousin of the victim spoke out earlier but did not want her face shown. >> it has a lot of people that care about him and that is why we wanted to get to the bottom of
