>> reporter: good evening. this past hour has been an active one, as you can see police are on the scene doing investigative work on the block but the thing is, they are doing that three doors down from where this early morning shooting took place. so any relation between that incident and what is going on right now, we're not sure if that is the case. we will stay on that. as for the victim police say that ten year-old is in critical but now stable condition. just before 2:00 a.m. a young boy identified by family as ten year-old nikkei was rushed to dew point children's hospital after police say he was shot in the head. twelve hours later an arrest was made in relation to the crime, relationship between 24 year-old jahlil goldsboro and boy has not been confirmed by police. also the nature of this crime, aside from the illegal use of the firearms is still unclear. cousin of the victim spoke out earlier but did not want her face shown. >> it has a lot of people that care about him and that is why we wanted to get to the bottom of the situation.

>> reporter: then as we were reporting on goldsboro's a arrest the intense situation, a man led out of the home three doors down from where this early morning shooting took place. a a connection to the shooting, if any, is still unclear at this time. that man's face was blurred because it is not been confirmed, his situation, at this time, nor any possible relation to this incident and this morning's early morning crime. obviously still a lot of questions here but once again that ten year-old victim is in critical but stable condition. reporting live from wilmington alexandria hoff for cbs-3 "eyewitness news". charges have been filed against a 14 year-old shot by police earlier this month in trenton. that shooting is under investigation by new jersey attorney general's office. "eyewitness news" reporter charlotte huffman has been covering this story and has this update. >> reporter: one day of supporters, hearn hearns gathered to demand answers from investigators about why police shot hearns several times, the the new jersey

attorney general's office filed charges against the 14 year-old including unlawful possession of a handgun, and aggravated assault. the august 7th shooting a happened in trenton's west ward after police tried to question hearns about reports of shots fired but hearns took off running. that is when authorities say officers shot hearns but until today, they remained tight-lipped, about why. now investigators say while running, hearns pointed a 22 caliber handgun at the the officers which they recovered from the scene but not until 12 hours after the shooting. something hearns attorney says that raises questions. >> you don't find a weapon, in the vicinity of where you encountered this child, and where you find him after shooting him, then that raises questions. >> reporter: investigators today said that the gun remained hidden underneath an emergency response truck until it was discovered the next day by a passerby. now the the attorney general's office continues to investigate whether the actual

in here as we look at future weather. a few clouds overnight and better chance for scattered showers tomorrow. we can see them on and off at anytime tomorrow. temperatures have dropped this afternoon, we are back to 88 after a high of 92 here in philadelphia. ninety still in allentown. eighty-three in wilmington. cooler at the coast thanks to the breeze off the 69 degrees ocean water. it has been a four day heat wave. yesterday was the the peak at 94. tomorrow we are back to the 80's but as temperatures drops, humidity rises, as does our chance for showers and storms. i will have more with the seven day forecast coming up when i join you than side, jessica. >> kate, thank you. congress manning chaka fattah plead not guilty, and is photographed and fingerprinted. cbs-3 was there as fattah walked into federal court. three weeks ago the 11 term democrat was indicted on 29 corruption counts. federal prosecutors say fattah used charitable donations and federal grants to pay off an illegal million-dollar campaign loan, after a failed run for mayor in 2007.

>> i am innocent of each and everyone of these allegations. fully expect that when we vet these allegations that we're going to get to a point in which where they will no longer represent any cloud on my very good reputation. >> yesterday fattah sent a five page letter to a congressional oversight committee questioning the the motivation, ethics, and methods of prosecutors in the case. a citizen activist files a complaint against pennsylvania attorney general kathleen kane over her use of government resources. he a has asked the state ethics commission to investigate and he wants to know more about kane's use of her security detail when she was arraigned on criminal charges. also, kane's use of the capitol media center to comment on her legal problems. the criminal charges against kane are a personal matter and her use of state resources and employees represents a conflict of interest. >> she has to take responsibility, not use state resources, not use state

services and state personnel for any kind of defense. >> kane is accused of leaking confidential grand jury, information to a newspaper in order to embarras a former state prosecutor that she thought made her look bad and lying bit under oath. she had has denied that. kane's spokesmen says her alleged office entitle tolls use state resources. police in hawaii are investigating the death of the local man who was trying to save a suicidal friend who climbed out on to the 14th floor ledge, both men, fell, and tonight, cbs-3 reporter greg argos has more. >> reporter: the the tragic fall happened outside of a 14 floor university of hawaii dorm room where both men were visiting. police say a young man was just helping a suicidal friend earlier sunday morning trying to convince him not to jump. try to remove him from the dorm's ledge. victim tommy bennet went to high school here at downingtown high school east and his friend say he was energetic, outing, and he

loved adventure which is why he ended up moving to hawaii. >> he always loved the scenery of like the world. he was always down for trying something new, walking around, seeing different things. >> reporter: that was obvious from the many pictures tommy took, enjoying beauty of hawaii after moving there last year. >> he has so many pictures of him with this beautiful scenery and just looked like he was just loving it out there having a great time. he looked happy. >> reporter: sunday night tommy was trying to help his buddy who was trying to jump, both men fell 14 stories, tommy died, the the 19 year-old survived. >> silver lining i try to look at, it was a 19 year-old kid that he saved, and i hope that this kid does survive and has a long life. >> reporter: as much as childhood friend johnny denise wishes he could see tommy again. >> i haven't seen him since he moved to hawaii which breaks my heart. i thought he would come back. >> reporter: he hopes the 19

confidentable 83 in wilmington. south wind helping out. allentown, hottest spot on the map, 90 degrees. it works other way where we are cooler in the northwest suburbs, not today and thanks to the marine influence. as we head through next couple days showers and storms will move closer, each day. here's tomorrow at 1:00. scattered showers and thunderstorms from the city on west but they will be around anytime tomorrow. then we have to see a arrival of the slow moving cold front, thursday at 11:00 a.m. just getting into western pennsylvania. most of this stays out of here until overnight hours. 1:00 a.m. rain moves through. you'll wake up to some rain, steady at times and watch how slowly this push es out. we are still looking at showers just starting to move down the shore. so friday does look like most active day weather-wise with showers lingering through the morning and afternoon hours, just a 40 percent chance of the scattered showers or storm tomorrow. thursday, better chance. friday same story 70 percent chance of rape, saturday we are back to 20 percent a stray shower possible this weekend.

we have tropical storm danny, that became, ts4, it jumped to a tropical storm. wind gusts, 50 miles an hour moving to the west at 12. good news about danny, days away from land, out in the opened atlantic. should be a category two hurricane by week end and heading toward lesser antilles. we will keep an eye on it. warm, muggy at 74, warm, humid wednesday but not in the 90's. we will hit 87. cloud, showers, late thursday into friday. friday looks slow to clear and weekend looks better with sun returning and temperatures still seasonable. take care, we will
