drabick, out on the skydeck, quite sun think noon, hey, justin. >> tough to find a cloud outside, chilly start to the day. forty's, 50's, but remember the mid september sun is pretty strong. so it does feel warm, if you are headed outside, so you can shed the jacket, in you it on earlier this morning, but check it out. did reach low temperature for philadelphia, 56 degrees, that makes it the coolest morning since early june, june 5th, to be exact. and again, some of the suburbs did drop down into the upper 40's. here we are 70 at the airport, upper 60s some of the cool spots, we are warming up nicely, the suburbs, 68 degrees, up in quakertown, willow grove also in the upper 60s. there is a breeze to deal with there out of the northwest to west at about 15, 20 miles per hour, so it feels very nice outside, very low humidity, nothing happening on storm scan3 with clear skies, that's the trend through the afternoon. we will make it up to 77 degrees for philadelphia, mid 70s at the shore, and still pretty cool up in the mountains, talking 60s in the sunshine, but a sun remains in

the forecast, we will bring back the 80s later this week. details coming back in just a few more minute. >> thank you, lesbian couple has received a marriage license from the kentucky county clerk's offers on the same kim davis returned to work. davis was jailed for not issuing licenses because of her religious objections to same sex marriage. jericka duncan with the latest from morehead, kentucky. >> reporter: emotional began her first day back at work, with a statement to the media. >> i don't want to have this conflict. i don't want to be in the spotlight. and i certainly don't juan to be a whipping post. >> the county clerk spent five days in jail, for refusing to issue any marriage licenses. siting her religious beliefs against same sex marriage. >> for me, this would be an act of disobedience to my god. >> davis, elected official, was jailed for contempt, in her absence, deputy clerk issued licenses, something davis says can continue but

added: >> any unauthorized license they issue will not have my name, my title or my authority on it. instead, the license will state that they're issued pursuant to a federal court order. >> davis continues to draw supporters and protesters in front of her office, she's now asking the state legislature to make an accommodation for her religious beliefs. she says she won't issue any marriage licenses, but she will not interfere with the deputies who continue to do so. jericka duncan, cbs news, morehead, kentucky. a person has been struck and killed by a septa regional rail train in prospect park, delaware county. it happened just before 7:30, near maryland avenue. service along septa's wilmington line was suspended for several hours while authorities investigated. train service has since been restored. one man is in custody after shots are fired during a barricade situation in north philadelphia. "eyewitness news" reporter jan carabeo shows us police

responded with swat teams early this morning. >> philadelphia police, and gunfire, broke the silence in north philly monday morning. sarah was sitting on her front porch as swat moved into a house just down the street at 15th and lehigh avenue. >> minding my own business, sitting on the porch, drinking my coffee, what i do every morning, then all the sudden there was this -- shots ring out around 6:00 a.m., an investigation that authorities are not yet detailing, brought police to this home on the 1500 block of lehigh. for some reason, they say police were forced to open fire. >> there was two shots fired by police. that is under investigation. there are no injuries. the police or civilian personnel. >> but nine people were at home at the time. >> the house was secured while the detectives got a warrant. >> a 22 year old man was taken into custody. the rest were questioned by

police. and even before today's activities, folks who live in this area say they've been on high alert. they say they've had some trouble lately. now they don't know what tolls expect. >> it's been break-in's here, break-in's across the street, every noise makes me jump now. >> both the shooting and when led police to this house to begin with are still under investigation. in north philly, jan carabeo, cbs 3, "eyewitness news". a suspect wanted in the shooting death of a kentucky state troop is her dead. police say they fatally shot joseph johnson shank this morning after he refused to put down his weapon. authorities say johnson shot trooper joseph ponder late last night after fleeing a traffic stop on a kentucky highway. trooper had been on the force for less than a year. fast moving wild fires continue to blaze a path of destruction across part of northern california. a wild fire in lake county is only 5% contained and being blamed for at least one death. authorities say that fire has

destroyed nearly 500 homes and businesses and more than a thousand structures since it errupted saturday afternoon. we have an update now to plane crash off the coast of atlantic city last week. "eyewitness news" obtained these exclusive photos as a sal raj team moves the plane's wreckage to a barge. crews recovered the plane, and the pilots body over the weekend. the pilot has been identified as 68 year old michael moore of michigan. the mooney m20 aircraft departed from michigan thursday, it was head today atlantic city international airport when it crashed into the ocean. >> and, an investigation will determine the damage to two planes that clipped each other on the ground at los angeles international airport last night. investigators also want to determine who was at fault here. a united airplanes flight, alaska airlines flight bumped into each other while maneuvering between terminals. more than 250 people on board those two planes, but no reported injuries. still ahead this noon:

>> cbs-3 fired up for tonight's game. live look inside of our news room, eagles, falcons, oh, it is on. ready for tonight's season opener in atlanta. so time to talk some eagles football right now. it has been a long time coming. but tonight the night the birds kick off a new season. coach chip kelly has remade the eagles roster, including new quarterback, sam bradford. and 2014nfl rushing champ demarco murray. tonight will be bradford's first regular season action, in more than a year. >> even when i was playing before i got injured it, makes the game fun, part of the process. soap, i think it is natural to have those. >> he was in great shape when he got here in august, and not -- >> the dallas cowboys come back win over the giants last night, does come at a cost we've learned, wide receiver dez bryant will miss month or more with a broken right foot. that means, the cowboys will be without one of theirs most powerful players when they

play the eagles next week. just saying. >> new study highlights dangers of try sick else and children. researchers in georgia found hospitalization treated more than 9,000 tricycle related injuries in 2012 and 2013. boys, and two year old, were most frequently injured. experts say most kids just don't have the balance or coordination they need until they're about three. so, if your child does ride a tricycle, experts suggest ones low to the ground and with big wheels. and as always, make sure your child is wearing a helmet. never too soon to stress that. still ahead, 14 seasons, wow, doctor phil fill returns to cbs-3 today and foresees on premiere, he'll share an exclusive interview that will leave you just at the edge of your seat. i'm talking to him live coming up next. justin? >> starting off the work week with a loft sunshine, sunny stretch continues in the forecast. i'll let you know how long it lasts when i show you the seven day when we return.

what she went through. why was it so important for michelle to share her story with you? >> well, erika, i think this is something that she fought so hard to survive, and i think she needed this to tell this story, and i tell you, this is a story of victory, it is a story of survival, and i just think if people are ever going to watch one doctor phil show, this would be the show i would tell them to watch. this is something that makes such an impact on people, and it has such a message about what do you on the internet. whether you put yourself in harm's way by going behind closed doors with people you know absolutely nothing about. >> because doctor phil, i believe she met her attacker through a craigslist ad. is that right? >> it was a craigslist ad for maternity clothes. and it was a very upscale neighborhood, a very nicetown home. and this woman supposedly is

suburban housewife lures her into the house, supposedly, to look at this clothing, and once she's in there, she over powers her, and then ultimately cuts her stomach open and takes her seven month fetus and leaves her for dead. but she fights for her life, gets to phone, calls for help, and she tells us this whole story as it unfolds, and it is one of the most compelling and rivetting stories i've ever heard in my entire life. >> now, i understand the attack took place back in march, how is michelle today? both emotionally and physically? >> well, erika, i have to say, she is such a strong woman. and she has found such strength in fate and really even forgiveness. but at this point she is obviously struggling. it is still very raw for her. this is the first time she has ever talked about it.

so this is an exclusive interview. but you can see and in talking with her that it is still very much part of her psyche, still very much present in her, what happened to her, so it is certainly not something that she has healed at this point. but, she's making progress, and i feel that it is something she is strong enough to come back from. >> now, i want to talk briefly about her attacker, i read the attacker lightly -- likely suffers from a mental illness. i know we talk about mental health, but do you think cases like this why it is so important to do so? >> well, you know, obviously a well person would never do this. and the alleged perpetrator here, and i say alleged, because she has now pled not guilty and is going to trial very soon and is going to plead not guilty. now, what the theory of her defense is, we don't know. but obviously, anyone that would perpetrate this kind of brutal attack on another person cannot be in their

right mind. they cannot be thinking right. and this is a woman, this alleged perpetrator, had said she was pregnant, had given a due date, the due date came and went, she said there was another due date. it came and went. said there was another due date. so her contact with reality was obviously spurious, at best. so there is clearly a very weak contact with reality here. so who knows what all was going on in the alleged perpetrator's mind. >> well, we will be watching today at 4:00. doctor phil, thanks for your time. >> erika, thank you, compelling story, i promise. >> really is. the 14th season of doctor phil starts today once again at 4:00 p.m. right here on cbs-3. it is followed by "eyewitness news" at 5:00. >> well, justin, we saw you out on the skydeck, looks like you had to squint almost, so bright. >> tough to read, my eyes couldn't adjust out there. a lot of sun. have the sunglasses out, there

protect the eyes. we'll keep this sunday i trend through much of the upcoming week. temperatures will be warming up, as well. today little cool. keep our highs in the 70s. bringing back some 80s for the rest of the week. remember still officially the summer season. take you to the shore right now. still few people out on the beach. live look at margate right now from our neighborhood network. enjoying the sunshine, nice, glassy conditions on the ocean, off-shored wind, comfortable beach temperatures today should make it into the middle open's. our trend, somewhat on the schooler side, still the upper 70s, couple of degrees below average, yesterday was our coolest day at 72. but each day gets little warmer starting tomorrow back to the low 80s, should top off in the mid 80s, wednesday, thursday, and even into the upcoming weekend. notice the winds flow here, coming out of the west to northwest. that's cooler, drier wind, coming out of canada. dew point temperatures, humidity, solo right now, very dry outside, still comfortable. sixty-six in state college, 67 in buffalo, so sitting in cool air mass for about the next 12-24 hours, then we start to

change it up little bit. the storm that brought saturday's rain now up across northern new england, right now, spinning away, back to full sunshine, high pressure builds back into the mid-atlantic it, just sit on top of us for the next several days. that blocks any storms from developing. that's why we have dry weather pattern, returning to the region, again, that boosts the temperature back up into the low and mid 80s with the full sunshine, not much happening this afternoon, enjoy the gorgeous conditions, outside. tonight, very quiet, cool again, some suburbs will be down into the 50's, and then tuesday, back to mostly sunny skies. there is the cold pocket of air over us right now, slowly departing over new england, so that jet stream start to move back to the north, that allows some of the warmth to return to the delaware valley. but, you don't like humidity, don't worry. the forecast just stays dry, with low humidity levels. today, mostly sunny, breezy, pleasant 77 degrees for the afternoon temperature. west winds coming in at about ten to 15 miles per hour. maybe few higher gust, tonight comfortable, center city low

of 60s suburbs dropping down to the 50's, i don't think we'll see any 40's like we had this morning. heading to the ballpark tonight, watching the nationals, phillies, mostly clear skies at first pitch, 74 degrees, game time, west breeze at about 15 miles per hour. at the end of the game, still comfortable, we will be in the upper 60s, overall, just nice night for baseball, maybe bring jacket, because it does get windy in the stadium. here is the extended forecast, look at that, string every sunday i days, shaping up. we go from 77 today to 82 on tuesday. then the mid 80s return on wednesday, and continue all the way through the weekend, maybe few more clouds for the weekends, but keeping it dry with comfortable conditions. that's checking your forecast. stay with us, we'll be right
