time, as dad comes home three kid, tied up, inside the house, and he is tight up and beaten to death with the blunt object. the his family tells thaws they have never had any closure, until today. >> lifted a big burden off my back. because we have been waiting nine years. >> reporter: family of juan cuevas said they have prayed for nine years that investigators would find his killers. on january 20th, 2006, cuevas came home to find four masked men holding his three children hostage in their washington township home. they were all tied up and the alleged robbery and eventually the the intruder beat cuevas to death. >> i just the same it is not same. he held us up, he made the holidays special he made the children special. >> reporter: monday morning a major development in the cold case fbi in philadelphia arrested four three-year old john blocker and his girlfriend, on north 57th street and charged him with murder. gloucester county prosecutor's office which led the

investigation would not release details about how they identified blocker as the suspect. >> they have been getting close over the the last six months. >> reporter: all agencies involved spent a thousand man hours on the case. >> i recalled the scene very vividly, and many of the officers have been since retired or left but it has always been in our heart and mind. >> reporter: police don't know if blocker had an association with cuevas who owned a auto parts store in germantown. some of cuevas children had children of their own and they are keeping their reaction of who they arrest private. >> they don't feel safe. they will never feel safe again. >> reporter: while there is work ahead is there new hope. >> if we had him we're looking forward to receiving the the other one that brutally murdered my brother. >> and police won't say right now how close or if they are close at all to finding anymore of the suspects. the the the arrest today now one million-dollar bail. reporting live a along washington township cleve bryan cbs three "eyewitness news".

we have breaking news right now in the mysterious case surrounding three-year old brendan creato. attorney for creato's father tells "eyewitness news" that the camden county prosecutor's office told him late this afternoon that long awaited toxicology report came back, negative. brendan's body was found in the wood three weeks ago in haddon township. his autopsy was inconclusive. "eyewitness news" has reached out to the camden county prosecutor's office for comment and they would not confirm or tea any the results of the toxicology report. we will have more at ten and 11:00 o'clock. a new jersey man is facing charges for halloween candy scare. police say he lied about finding a needle in the snickers bar. this case comes as police around the region investigate reports of the tainted candy. "eyewitness news" reporter rahel solomon has more from the gloucester county police department rahel. >> reporter: police say dad reported biting into some chocolate and finding a needle in it. ultimately they have decide that had was a fakery.

but when they asked him why he lied, he reportly said he was just trying to teach his son a lesson. >> i was like, why not just throw canned a way. >> reporter: it is a a child's worst fear after what many will tell you is parent's worst nightmare. >> reportedly found some needles inside a candy bar. >> very, very scary. >> reporter: sources tell me this is facebook post that alarmed neighbors but police say once they have started asking robert le drew questions, they have realized it was a hoax. >> he eventually admitted and confessed he tampered with the candy himself. >> reporter: we tried to speak with le drew ourselves but in one answered the door. meanwhile, law enforcement the and kenneth square chester county are investigating reports of the six pieces of canned which needles inside. late monday police told "eyewitness news" they are still trying to get to the bottom of the different stories. one very thought is they are inspecting pieces of canned that i someone claimed had a

>> kate, thanks very much. a vigil is underway for a 16 year-old shot and killed while riding his bike. crowds gathered tonight to remember salem west. west was gunned down sunday afternoon in the 2200 block of west sedgley avenue. he and a 15 year-old friend got the in an altercation with the man in the silver buick. two men got out and started firing killing west. >> did i go across the the street, he is laying there. >> reporter: what was it like to see your friend laying there being shot. >> traumatizing, someone gun my nephew down, a kid's life for in reason. >> he was a good kid. >> reporter: no arrests have been made, if you do have any information you are asked to contact the the homicide detectives. we also want to apologize earlier during our live report from the scene of the vigil you may have heard some profanity, from a man in the crowd. in other news, khusen akhmedov was sentensed to 17 to 34 years in prison. he was found guilty of third

degree murder in the 2013 drag racing crash on roosevelt boulevard that killed northeast philadelphia mother sammer banks and her three children. he had a history of speeding and aggressive driving before that fatal crash. a crash involving a september bus slams in two businessness northeast philadelphia it happened 12:30 this afternoon on the 7,000 block of oxford avenue in fox chase. bus collided with a truck carrying heavy equipment. eyewitnesses say the truck was getting a policees cord when the the bus rounded a corner. bus driver and two passengers were taken to an area hospital with non-life threatening injuries. trapeze artist who was hurt during a performance at the universe soul circus on halloween is out of the hospital. the the that piece artist fell 30 feet from his apparatus and landed in the crowd. he was treated for a lower back injury and expected to make a full recovery. no one else was hurt. circus officials continue to investigate what caused the fall. turning to campaign 2015, and what they are calling a historic election in

"eyewitness news" reporter todd quinones is live in our sat center with a closer look at the candidates, todd. >> reporter: jessica not since the 1700's have we had three opened seats up for election for supreme court of pennsylvania. now one of those candidates is commonwealth court judge ann covey from bucks county. she is also the only judge who is running to receive a not recommended rating from pennsylvania bar a association over a campaign ad and i got a chance to talk to her about that this afternoon. what do you say to that? >> i think it is very interesting in what they did say was i write well reason clear, concise opinions. as far as my qualifications as a judge they highly recommend me but what they didn't like was a television ad that i ran when i ran for commonwealth court judge covey is part of the unprecedented election for the first time in 311 years three pennsylvania supreme court judges will be elect. some other candidates, that are running included superior

helping slaves escape their owners and his pardon was signed today in dover as family members looked on. that is great. on the cbs-3 healthwatch according to new research from north philadelphia, most toddler, used mobile devices like a smart phone and significantly for the first time this study shows even poor children have portable devices signaling an end to what is called the digital divide. >> health reporter stephanie stahl joins us to explain it all. >> reporter: these are independenting findings. this research done in north philadelphia among low income minority families. it used to be many of those children from those families didn't have smart phones and tablets, that technology was mainly for people with money. well this new study from einstein is getting national attention, and national attention, showed, that digital divide is going away. eleven month-old enrique santana is at einstein clinic being treated for a fever. he is easily distracted by his mom's phone.
