erika von tiehl. katie outside on the skydeck, meisha keeping an eye on the roads for us, certainly chilly if you are headed out right now. morning, ladies? good morning, certainly does feel a lot chillier today, katie, than it was even yesterday. roadways are nice and dry, just dealing with some construction, but little colder outside this morning. >> absolutely, yes. and the door was open when i came out to the cbs-3 skydeck. so this, microphone, very, very chilly right now. but we're also accompanied by some lovely festive holiday light out here on the skydeck, too, so, you know, that chill definitely makes it feel very festive. doesn't it? but we're actually going to be seeing the opposite be true as the days progress here, nice little warming trend is in the cards for us, as we head forward in this forecast. for now, though, yes, actually storm system nearby. it is producing nothing more than couple every clouds. you can see, very little glimmer of some green showing up right now, out, or just off of monmouth county, ocean county there. that's the retreat actually of a storm system that was just barely produce ago glancing blow to the area.

"eyewitness news" reporter justin finch joins us now at the scene in philadelphia's lawncrest section. good morning. >> reporter: good morning, police tell us this happened late last night, and this morning, police are still actually here. they tell us that a mask man with a gun announced a robbery in this home just behind us here, and he went outside but did he not come back out because in minutes he was dead. police outside this lawncrest row home overnight, the scene every fatal shooting that may have began as home invasion attempt. >> just after 11:30 p.m., second district police responded to 911 call, report after shooting inside of a private residence in the 6100

block of reed street. >> the suspect, 35 year old man, whom sources say was wearing a mask, police tell us they found him unconscious, on the first level, dining room floor, with gunshot wounds to his neck and chest. >> medics worked on him, did cpr, attempt topped revive him, however, the victim never regained consciousness. and he was pronounced dead at 12:04 a.m. >> sources say he was armed and came in through the front door and announced the robbery. inside, five people, three men and two women. >> the 27 year old male homeowner told his weapon, and fired at least four shots at the 35 year old who was committing the robbery, the 35 year old collapsed, and dropped his handgun by his feet. >> officials say a further search of the home just might have turned up what the now dead suspect was after. >> in the basement, it was a

green weed-like substance, and large plastic bag, it appears to be marijuana. has a heavy odor of marijuana. there is also several hundred dollars right next to this alleged marijuana. >> police tell us they also found packaging materials by that weed-like substance, if it turns out that these are indeed drugs, the homeowner will face charges, for in a could the nicks this case. now, that homeowner also lived with those two women, who are also home when this robbery was announced, all three actually had weapons, as well. he, the homeowner, is the only person believed to have discharged his weapon. at this point all five people who were in that home are talking to homicide detective. we are live here in lawncrest, justin finch, cbs-3, "eyewitness news". >> justin, thank you for. that will meanwhile, couple sits behind bars this morning for the brutal murder of 54 year old cathy wilson. fifty year old james chi err and his girlfriend, 47 year old jane johnson, they worked for wilson and confessed to

>> one pro toaster arrested as police try to clear the hallway outside rom emanuel's office. this is dash cam video of separate incident, announced they'll not file charges against hernandez. johnson pointed a gun at police, before he was kill, in october of last year. johnson's family insists that gun was planted on him. a carjacking suspect leads police on wild and dangerous car chase through seattle. dash cam captured the intense moments. authorities say the armed man and in his 30's carjacked at least two vehicles, fired at pursuing police, and careened into multiple vehicles. the suspect was eventually surrounded by police, and killed in a birrage of gunfire. two officers and several civilian drivers suffered minor injuries from the car accident caused by the car chase. >> and, more drama on the road when that van made smashing

those times where it is so, so beautiful. such again festive beginning to the morning for you, as you drive in on the schuylkill and you see the view. right now we've also got clear skies to see. we look at the reflection off the schuylkill river there, so, so pretty. now, i mention nice little warming trend here. let's go to the temperature trend, mercury climbing my friends, average high on this particular day of the year is 47 degrees, in philadelphia. we will be traveling upward and upward through the 50's, low 50's today, mid tomorrow, upper thursday, friday, then by the time we hit saturday, yes, not typo, we are expect to go top off in the 60s, not even for just one day, you will see in the seven day. for now, storm scan pretty quiet. see the clouds retreating off to the north and east there, that's as our area of low pressure that formed coastal low continues to pull away. that will was nice little near miss for us. didn't realize the deal too much with t also, see the combination of some stormy weather out across portions of the northern rockies here, into south dakota that's eventually going to be surface trough that crosses through the area. doesn't bring much more than

>> jerks i for fisherman has a whale after tail to tell down the shore and the video to prove it, too. diana rocco shows us why whales are showing up this time of year. >> people walking the board are out on the water this weekend, up and down the jersey shore, were surprise today find some unexpected visitors who didn't mind putting on a show. >> off the coast of ocean city, this video shows one fisherman getting quite the bump from a hump back whale. it was enough to rock his boat. >> he's feeding, blowing, you know, water out his blow hole. and at one point he started just kind of breaching, coming toward us, then, you know, zig-zag around little bit. next thing you know he comes up, basically, right underneath this guy's boat. >> he shot the video monday morning about mile off shore. fishing for stripes. when he saw the whale getting little too close to another boat. >> it seemed like the whale kind of new where the boats were at one point, you know, people were videos him, taking pictures, almost like he put
