brain don creato's body was found in the woods in camden county an arrest is made. tonight suspect's lawyer is defending his client and maintaining his innocence. good evening, everyone, i'm jessica dean. >> i'm ukee washington. "eyewitness news" reporter david spunt has been following this story since it broke in october. he joins us now from the cam county prosecutor' office with the very latest tonight. david. >> reporter: ukee and jessica this is the indictment released earlier this afternoon it doesn't have a lot of information but investigators that work in this building behind me are confident they have enough information to put dj creato behind bars meanwhile his attorney says these investigators have the wrong g guy. dj creato said nothing as he left haddon township police department about an hour after he was are a arrested and charged with killing his three year olson. did dj kill his son. >> absolutely not. >> his attorney tells "eyewitness news" his client is cooperating with authorities.

but says detectives have the wrong person behind bars. >> when this first happened, i called it a parent's worst nightmare. i thought nothing could be worse and i think this actually is to not only lose son, but now to be the one accused of of killing him. >> reporter: the three year old's body was discover not even half a mile from his dad's haddon township apartment. at about 9:00 o'clock in the morning on october 13th. three hours before dj creato was on the phone with police. >> 911 what is your emergency. >> i woke up and he my thee-year-old missing. >> you didn't hear anything or see anything or nothing like that. >> i just woke up and he wasn't in my app. i don't know if he wanted out or what happened. i don't know where he is. the door was lock. i guess he unlock it and left. >> neighbors have been on edge for months waiting for some kind of answer. >> a little suspicious about the whole situation, you know, sad to see little kid like that three years old. >> i know people that went to the funeral because they know the grandfather. it's just sad. i feel bad for the family, you

when three men tried to miss jesse's stop and shop on 12th christian this morning the owner opened fire and killed one of the men. a second suspect is in police custody. a third is still at large tonight. schools in the area were put on lock down as precaution but the lock down was lived about an hour later. former philadelphia police commissioner articles ham say has a new job. beginning today the law enforcement veteran is now serving as a public safety consult tan for wilmington, delaware. he will assist with violence reduction initiatives throughout the city. ramsay who retired as commission are in just last week, also served as a chairman on president obama's task force. 21st century policing torments night we are getting a dramatic look at new video of the operation that led to the arrest of the world's most wanted drug lord. >> government officials nor trying to extradite joaquin al chap poe guzman and hearing from sean penn about the coors winner's interview with the cartel boss.

that's tomorrow once again at 9:00 p.m. a government task force has finalized its recommendations on mammograms saying they do the most good later in life. the u.s. preventive service task force says women should get a mammogram to check for breast cancer every other year beginning at age 50. task force says women between the ages of 40 and 49 don't get as much of benefit from screening as older women. those between 40 and 49 are urged to make a decision for themselves after weighing the pros and cons. a delaware woman takes a creative approach to searching for a kidney and it may save her father's live. melissa miller's father william born with one kidney and began to fail him six years ago. when melissa learned she cannot donate one of her own she decided to right a message on her car. hoping strangers would reach o out. >> i'm just at the point i'm ready to give up. my daughter just keeps coming up with these things, you know, in keeps me going.

high today in philadelphia 40 degrees. that actually came at midnight our afternoon high was only 35 after a high yesterday of sky. big transition getting live look at center city philadelphia. clear skies and cold temperatures. nice calm winds getting a brake break from the bluster row condition. temperatures feeling winter li like. 21 right now in atlantic city. we're in the teens in allentown. 12 degrees on mount pocono. wind speeds relaxed across the area now reporting calm winds on the most of our reporting sights after a blustery start to the day with winds gusting up to 37 miles per hour at the highe highest. 39 miles per hour in lancaster and gusting to 31 in philadelphia. and overnight tonight, we'll keep the wind speeds on the lighter side. cold down to 25 degrees under increasing clouds. as we head into the day tomorrow, not as cold. 44 degrees but those winds will kickback up once again by midday and then as we head into the second half of the afternoon and evening, rain showers transitioning over to some snow showers and yeah we've had nada

so far this season but normal today date we should have about 5.6-inches of snow that should have fallen. as far as averages are concerned in philadelphia but quiet right now. up wind is our weather maker this is an alberta clipper system pulls out of the province of alberta canada usually known for rather snowy or not so snowy conditions because the air is rather dry with this system. so it will make a quick move in, quick move out a fast moving system and put down little bit of snow. future weather showing us cloud deck increasing into the day tomorrow. snow showers starting to build west of the city as we head into the afternoon. evening hours snow showers moving through. and then as we head into the second half of evening quickly clearing on out. as far as accumulations, could see up to an inch or two up towards the poconos lehigh valley maybe half an inch to an inch maybe a dusting a little bit closer to the city many this is just one particular model other model not giving us any type of accumulation in the city but if we see anything it will be very very little. your day planner tomorrow we see
