will face those charges, of aggravated indecent assault. through a crush of media, comedian bill cosby arrives at the montgomery county courthouse tuesday morning and with the help of two assistants enters a building for his hearing. cosby's attorney brian mcmonigal argued that the 78 year-old comedian cannot be prosecuted for an allege sexual assault in 2005 based on a verbal agreement between then montgomery county district attorney bruce castor and cosby's legal team. >> do you think castor took to the stand for more than six hours and explained how his office, thoroughly investigated the claims. formal temple employee andrea constand said cosby drugged and sexually a assaulted her at his cheltenham home in 2005. castor says there was not enough evidence to present a winning case and therefore, quote i made the decision that mr. cosby would not be prosecuted, no matter what, so that he could not take the fifth amendment as a matter on have law.

we can get latest anytime at cbs philly.com. mother and her two young children are hit by a car and left to die in south philadelphia. now police are searching for that driver who left a clue at the scene. the the family was hurt while trying to cross broad street near dickinson, "eyewitness news" reporter diana rocco joins us from hahnemann hospital in center city where all three victims were taken, diana? >> reporter: jessica, tonight that mother is in critical but stable condition, here, her two children are also, here, and they suffered injuries but they are expected to survive. meanwhile, police are now looking for a female driver of a 1998 to 2,000 model red honda accord that left the scene, leaving behind, a side mirror. tonight police are looking for a hit/run driver that struck a 30 year-old mother and her two children crossing a south philadelphia a street tuesday, just before 1:00 o'clock. it happened at corner of dickinson and broad streets, the driver's side mirror still

lying in the street. >> the car came down the street, you know, boom, when i heard boom i seen woman go down but little girl was on the hood. >> i actually heard young girl screaming, crying, and i saw the the mom, she was laying on the ground unconscious and i saw them holding the the baby and it was just like pretty disturbing. >> reporter: it appears that the female driver was in the 1998 to 2,000 model red honda accord. police say she struck mother, her six year-old and six month-old in the carrier strapped to the mother a's chest. the six year-old hit the hood and fell to the ground breaking her leg, and the baby suffered only bumps and bruises while police say their mother was left lying in the street unconscious. all taken to hahnemann hospital, police are now looking for the the driver of that red honda accord, and hoping surveillance video will lead them to her. >> we are very hopeful that video was recovered of the incident and that will be analyzed by the police department, hopefully leading

to an arrest. >> reporter: so while this has been a traumatic ordeal for this family all three family members are expect to survive. at last check we're told that mother has regained consciousness but she is disoriented. again police are now looking for 1998 to 2,000 model red honda accord and last seen, leaving the the scene there, they are looking for a female driver and asking anyone with any information to call police. live from center city outside hahnemann hospital i'm diana rocco for cbs-3 "eyewitness news". a flood watch is in effect for parts of the area for tomorrow but on the flip side we could see record warmth. the warm weather is already swinging our way, if you will, we will see mild temperatures nice enough to hit the playground in center city. this is the system that is on its way here, blizzard-like conditions over midwest will calm down a bit before they get here. lets get a first look at the forecast with meteorologist kate bilo on the sky deck. i'm not scared, kate. >> don't be scared about this one but might want to be

scared driving through these big puddles on the roadways tomorrow. we are talking about the the risk for flooding but this storm is all rain for us, snow staying way off to the north possibly over northern maine and eastern canada and that is bit. it is strange to be talking about a flood watch on what is a beautiful tuesday evening in philadelphia i'm's looking at a gorgeous sunset. it has been a fabulous start to february. but change is on the way. the here's a quick look at storm scan three. you can see storm over center of the country, heavier snow in the great lakes region but not much going on for us and certainly this storm will get here during the day tomorrow. it is pulling up moisture from the south and that will cross the region tomorrow afternoon. the nice mild day we are still at 51 in philadelphia. forty-nine in wilmington. 46 degrees in millville. forty-four in allentown. flood watch in effect for the area as we head through wednesday and into thursday and we do expect rain heavier at times about a half inch to an inch record temperatures that will lead to the risk for flooding when you couple with the snow melt. is not sure that wasn't

showing up we will look at it as it modified it. rain amount might be slightly less and that may mitigate the threat for flooding in a bit. i'll have more details inside in a few minutes. new back inside to you. chaka fattah junior, son of the congressman chaka fattah is sentenced to five years in federal prison. he was also ordered to pay 1.1 million-dollar in restitution. the as kyw news radio reporter steve towa tells us the sentencing follows fattah's junior convictions in november at his bank and tax fraud trial. >> reporter: federal judge told the defendant he had opportunities and advantages that most young people only dream about but yet he cheated the school district of philadelphia, banks and the the irs. the three three-year old son of the long time congressman told the judge quote i didn't know anything i did was a violation of the law, assistant u.s. attorney paul gray asked the judge to sentence fattah junior at higher end of the guideline range. >> serious crimes committed with a sense of arrogance and

jury's verdict has donna way with the charade that mr. fattah was a legitimate businessman. >> reporter: at the trial, jurors had to decide between competing portraits of fattah junior. prosecutors called fattah junior a cheat and dead beat. fattah who represented himself at trial even though he is not an attorney called himself a legitimate businessman and entrepreneur. after listening to both side, judge harvey bartle then sentenced fattah junior to five years in prison. defendant made a motion to voluntarily surrender, the judge denieded and ordered marshals to take him in custody. the outside the courthouse his father 11 term congressman chaka fattah who faces corruption in may promises a vigorous a appeal. >> we will have a chance to analyze appropriately whether this was a fair set of charges, whether the investigation was handled properly. >> reporter: judge ordered fattah junior to pay 1.1 million-dollar in restitution. steve towa for kyw news radio for cbs-3 "eyewitness news".

a report of a missing gun prompts a lock down at kensington high school in philadelphia a school police officer reported a gun was missing with his car. however that officer was unsure when it went missing. the school was locked down, at the precaution but lock down was lifted after the building was searched. the the 2016 presidential race now turns from way to new hampshire. nearly all candidates are scheduled to be campaigning in the the state the today ahead of next weeks primary. cbs news correspondent danielle nottingham tells us ted cruz and hillary clinton supporters are feeling good after last night's win in iowa. >> reporter: ted cruz greeted an enthusiastic crowd in new hampshire where he is looking for a second win. >> it will be decide by grass roots, decided by men and women here in this room. >> reporter: cruz's camp wants to rally a as much ground support in new hampshire as they hold off in iowa. >> were you surprised you won

people analyzed the risks and benefits of seafood when it comes to fighting alzheimer's disease. lots of people are eating more seafood because of its health benefits but seafood also contains mercury which has neurotoxins. a first of its kind study weighed benefits of seafood against harms of mercury among a group of 286 elderly people. they kept food diaries and agreed for their brains to be examined after their death. >> all participants in the study were evaluated on a annual basis. >> reporter: those who ate seafood once a week or more had higher levels of mercury in the brain but lower rates of alzheimer's disease for those with the genetic risk for dementia. >> the increased level of seafood consumption, did increase, brain levels of mercury, but that the the mercury didn't appear to have an impact on brain health. >> reporter: it is estimated between 30 percent of the population has alzheimer's genetic risk but researchers say, even people that do not

>> reporter: at 90 years old not much surprises katherine walsh these days. well, except her own actual surprise party. how surprised are you. >> i'm very surprised. i didn't expect all this. >> reporter: catherine has faithfully worked at this west hampton applebees for the last 13 years and she has become something of a star around here this sexist practically reserved for her regulars. >> she remembers you, she remembers what you like and she is just a very pleasant waitress and that is what you want when you get out somewhere. >> reporter: catherine's manager tells me that part of what makes her so specialist her work ethic and it is something that you cannot be taught, something that age. >> we are a group that operate restaurants in 27 states across the country. we have 40,000 employees, and she's the oldest. >> she's a regular and we cannot get her to stop

chestnut hill. nice day today before the the rain tomorrow. today was kind of a nice break between system. and, rain tomorrow. things look great. we will still be near 50, kerrigan house, beautiful mostly sunny day, and plenty of melting going on and lynn sent thus photo from cherry hill, showing her snow is almost gone, if you remember lynn's pictures from last week. she had quite a bit of snow now just a few lingering piles but of course that is all, soak go into the ground and tomorrow's rain will lead to the risk for some flooding. the lets talk more bit. we will take a peak what is happening on storm scan three, thinks a nasty system producing heavier snow over michigan, wisconsin, back in minnesota at the the moment. that snow will miss us to the north. it will not be an issue for us. this is all rain. temperatures way too warm to bring us any snow. in fact we may be talking about record high temperature. it depend on the clouds and rain how quickly it gets in, will temperatures be able to rise up to these record levels. i do think we will be very close if not in record territory heading in to the
