bill cosby and his defense teams are heading back to court this morning. they hope the the judge will drop sexual assault charges against the philadelphia born comedian. "eyewitness news" reporter justin finch joins us at montgomery county courthouse where that judge is supposed to make a decision later today, big day, good morning. >> reporter: that is right that judge is set to decide if this case begins cosby can move forward or not. now site ago this verballal deal, cosby's defense teams says this case should be thrown out. however, the prosecution a say that deal has no weight. lets go to video to cosby a arriving to court yesterday with a assistant at his site with the clammer of media and onlookers tuesday. inside four montgomery county d.a. bruce castor was on the witness stand for some six hours explaining a so-called verbal deal he made with cosby's former defense team in 2005. now castor says in exchange for cosby's deposition testimony, in the andrea constand civil suit castor would not press charge's

allowing constand to proceed with that civil suit. last summer a federal judge unvealed portions of that deposition in which cosby details giving woman drugs for sexual encounters. that revamped the montco investigation in the the constand case and cosby's criminal charges were file. now former temple university staffer andrea constand accused cosby of drugging and sexually assaulting her and at his cheltenham home in 2004. they did settle out of court. castor revealed did he not think constand could make a strong case. having made cast in that year between the a counter and alerting authorities and that constand reached out to the civil lawyer before police. looking live at this norristown courtroom that again, will be filled with press and onlookers outside, castor is expected again to retake the the stand and cots bye again, faces charges of aggravated indecent assault which carries a a ten year prison sentence and also a
