philadelphia fop president john mcnesby is not mincing words when it documents getting justice for his officers. "eyewitness news" reporter walt hunter joining us now live in the cbs3 sat center with more on what mcnesby had to say. walt. >> erika, i talked to mcnesby this morning and the president of philadelphia's police union says 12 days is too long to wait. he wants the da to file charges now in attack that left two of his officers seriously injured. so far former eagle running back lesean mccoy and three others under investigation have not been charged with any wrongdoi wrongdoing. >> take a look at that video. do the right thing. arrest him and then let's move on. >> reporter: fraternal order of police president john mcnesby is demanding district attorney seth williams take immediate action filing criminal charges in the investigation into whether lemon mccoy and three companions beat two off duty police officers inside a private center city club. >> we're not asking for the

world here. we're just asking for these guys to be charged and let it go to jury. >> reporter: mcnesby is upset about not hearing any specifics from the da on whether charges in fact will be filed. >> just silence. absolute silence. you can hear crickets over at the da's office. you know, whether they're looking at more facts, you know, pulling more facts i don't know how much more facts. >> reporter: meanwhile he says his two officers badly injured await justice. >> this was all out beat down with serious bodily injury. if this isn't the definition of an aggravated assault i don't know what is. >> reporter: finally, mcnesby vows if charges aren't filed he's prepared to move beyond the district attorney's office to the state attorney general. >> we'll be knocking on catherine kane's door the attorney general and see if she would have interest in looking at this or going the other route on the private criminal complaint. >> reporter: now in response to mcnesby's comments district attorney seth williams tells somebody's three quote it is an

open investigation and my job is to get it right, not fast. the last thing philadelphians want is to rush a judgment ". meanwhile mccoy's attorney did not respond to a request for comment from cbs3, and as of now, no charges have been filed against mccoy or anyone else as the investigation continues. live in the sat center i'm walt hunter, cbs3 "eyewitness news". >> walt, thank you. a firefighter is injured battling flames at a repair shape in delaware. chopper three over the 300 block of bay west boulevard in new castle. the fire started shortly there 8:00 this morning and went two alarms before firefighters brought it under control. investigators say that barrels of unknown liquid were the source of that fire. the injured firefighters condition has not been released. a great shot right now of firefighter staring down the huge flames from a burning rv in chester county parking lot. pictures from nozzle nut photographer and video from

raffle m hunt showed the blaze crews faced last night at the crackle barrel in downingtown. they prevent the names from spreading to the cracker barrel or other vehicles. fortunately there were no injuries. so far no word on the cause. this multi vehicle accident in atco, new jersey, sent two people to cooper university hospital. both are listed in critical condition. chopper three captured that scene on the collision which took place just before 11 a.m. at the intersection of cooper folly road and the white horse pike. police are still investigating the cause of that crash. philadelphia police looking for your help this noon to solve a july row store heist. men caught on camera right here just before breaking into bar ski diamonds on sansom street around 3:30 this morning. once inside, the two took about $400,000 worth of jewelry from the glass cases and stuffed it into bags. they fled that store and were seen heading east on sansom

street. if you have any information about who those folks are you're asked to call philadelphia police. well, we're getting ready for the weekend and katie has good news about the weather but also mother nature throwing us a curve ball possibly. we'll check in with katie on that sky deck. don't like the sound of a curve ball, katie. >> never does sound good, does it erika. with that said we are watching the tail end of a peck pesky front boundary trying to cross through here. at the moment all we've got is a mix of clouds little bit bit sunshine filtered through here on the sky deck. we start things by taking out to corm scan three. take look here. some of the purple trying to creep ever closer now i got to put it out the bark a far worse than the bite on this one. i do think you could see a stray snow or maybe sleet shower of some kind here midday. the bulk of the moisture is across the pa state border and up toward upstate new york. you see that darker shaved purple. so that's what we're dealing with. it's not going to be a big deal. but it's something worth mentioning. currently in the mid or lower 30s in most locations around the region right now.

we got to talk about this weekend. we flirt with 60 tomorrow. still mid 50s on sunday but let me quickly get to that little curve ball we had mentioned. all right. look at the time stamp sunday night a little disturbance wants to nudge in here guys primarily a rain producer for philadelphia. it is still a chance i got to put that out, too. the further north you travel the more likely it is the lehigh valley and poconos that you might end up with a little bit of snow and then quickly see that zip out of here for the early part of monday morning rush. so as we move forward that's the curve ball. but we're tracking a big storm into next week and we will absolutely track that situation for you later in the show. erika, send it in to you. >> katie, thank you. the body of justice antonin scalia is lying in repose in the great hall of the united states supreme court. cbs news correspondent is at the court where many are coming to pay their respects to man known as the conservative warrior. >> reporter: sun had just started peeking above the supreme court when a group of

inter denominational pastors leaned to pray for the great justice scalia. >> we came out this morning to be here to witness his last visit. >> scalia's casket arrived for the final visit following close behind were his children and his former law clerks serving as honorary paul bearer once inside the current members of the court joined the familiar until a short service led by scalia's son father paul scalia. >> the father and the son and the holy spirit. >> after the ceremony, the public was allowed in to view the body emily witherspoon was the first person in line. high school junior from north carolina says she respected scalia. >> he's definitely someone who really stands up for what he believes in, and sticks with what he think social security right for our country. >> reporter: president and mrs. obama are expected to arrive to the court sometime today to pay their final respects. but they will not be attending the funeral tomorrow. the white house is sending vice-president biden to represent the administration

a tourist helicopter crashes into the water near hawaii's pearl harbor visitor center. eyewitness captured that terrifying moment on cell phone video yesterday. bystanders helped rescue a 16-year-old passenger trapped underwater. he's in critical condition. four others were able to get out on their own. eyewitnesses say that helicopter appeared to just fall right out of the sky. >> just plopped in the water and started rolling over and the blades stopped immediately. and at that point i just cut the video and ran over to help. >> i can't believe this just happened. it was crazy. you go on vacation you never think you'll see something like

that. >> yeah. faa and ntsb representatives are headed to that crash sight today to begin peacing together what exactly went wrong. american war plane strike isis training cam in that libya killing dozens of people. correspondent explains why the us targeted that location. >> reporter: video broadcast on libyan news channel claims to show the aftermath of overnight air strikes in the libyan city. u.s. defense officials tell cbs news the strikes likely killed a top isis terrorist. senior isis leader is wanted in connection to a march assault tunisia at the museum that killed 22 people. and another attack in june when gunmen stormed tunisian beach popular with western tourists killing 38. tunisia's interior ministry released this photo at the time of massacre. u.s. air strikes come as the white house and western allies struggle to contain isis.

just this week president obama said america would go after islamic seat fighters in libya wherever there is a clear targ target. >> the terrorists group has used brutal tactics to make their presence known in libya carrying out several gruesome be headin headings. this one last february allegedly shows militants killing christians on beach near tripo tripoli. cbs3 "eyewitness news". you may notice the name monty williams trending on twitter. the former sixer player is now coaching in oklahoma city. unfortunately, his wife and mother of his five children was recently killed when a wrong way driver hit her car head on. yesterday williams stood in front of thousands of friends and family members and delivered an incredible message of love and faith. the most moving part of his message was directed towards the family of the wrong way driver. >> everybody is praying for me and my family which is right but

let us not forget there were two people in this situation and that family needs prayer as we well. and we have no ill will toward that family. in my house, we have a sign that says as for me and my house we will serve the reporter. we cannot serve the lord if we don't have a heart of forgiveness. that family didn't wake up wan wanting to hurt my wife. life is hard. it is very hard and that was tough but we hold no ill will towards the donaldson family. >> wow! plea three of his children were injured in that accident. but they survived. the wrong way driver was going 90 miles an hour the speed limit was 40. still ahead this noon, feeling sleepy what's that risk if you don't get enough sleep and how our states rate when it comes to getting our rest. >> katie. i probably bring that average

if you get halfway through your day and you notice your nodding off you're not getting enough sleep but you're not only risking that tired feeling it could also affect your health. study by the centers for disease control says more than a third of americans don't get enough sleep. lack of sleep can put you at greater risk for obesity, diabetes, heart disease, mental illness and a number of other conditions. in pennsylvania, new jersey and delaware, we're a little above the average with about 38% of people not getting enough sleep which is seven hours or more in katie i hate to think how little sleep you're getting with not one but two little babies at home. >> it's not much. >> seven hours every two nights maybe?

>> i feel like i'm lucky to get six these days. if i'm lucky. >> five or six hours. it's tricky. >> overnight feedings and all. >> absolutely. i'm looking forward to the forecast. curve ball coming our way. >> it's looking good. saturday still looks pretty phenomenal absolutely. we'll flirt with 60 degrees. it looks pretty awesome and a great excuse to get outside while you can. if you got a little cabin fever maybe especially from last weekend being so frigid, now is the time to take advantage and i say that also because down the pike we've had changes on the way. we showed that you little disturbance that might be coming in here sunday night into mond monday. however, the rumors are still true that this tuesday-wednesday system east coast storm we've been looking ahead to is very likely at this point. let's go outside. we'll show you what's up and first are for most on storm scan3 to bring it back to what we had talk about earlier in the show primarily the disturbance to we're tracking is off to the north but we're right on the tail end, and it looks like some of you might end up just seeing a quick shower of some snow or sleet not a huge deal but enough

that i mention it. but with that said, looking at the wider picture the bigger picture in fact generally high pressure on your side here. and through the course of the weekend that will generally also keep us, you know, hook up with some decent weather until that little disturbance decides to come in on sunday night leading into monday. now, next midweek we're talking tuesday to wednesday. we're actually going see this east coast storm start to take shape here down through the deep south and then ride up the coastline. track is always critical on this kind of a setup and if it decides it wanting to a little further inland, little further to the west in other words it will draw more warmth in on the side that we sit. that would mean more potential for rain. if it decides it wants to zip out closer towards the shore more of an easterly track with that count clockwise spin you'll start drawing in more cold air and also bring in more potential for some snow. that is still a big question mark. what we do know, however, is the timing hasn't changed much. still looks like it will be a

p.m. tuesday through most of wednesday storm system. at this point i do feel pretty confident that we can say there will be primarily rain with this but there is still the possibility that maybe we start with a little snow and end with a little bit of snow. that's where the question mark remains because the track again is going to be very very critical. gusty winds to go with it. maybe we even have to deal with tide tidal flooding much speaking of tides awfully low right now this guy is all the way out you can barely see him out beach patrol headquarters in margate. current temperature readings mid low 30s around the border we should easily get up into the low 40s. which we could crack out of the 30s yesterday. so we're at least going to get you milder here today. but it is february after all. right. we expect it to be a little on the chilly side. with that said we'll break those expectations come saturday flirting with 60 under the sunshine. sunday night leading into monday we start to see that next little disturbance. blip on the radar zip on through here and then tuesday p.m. into wednesday east coast storm is
