he was with two other off-duty philadelphia police officers at recess lounge, 2:45 a.m. super bowl sunday where police report they and three men with mccoy, got into a violent dispute over ownership of a bottle of champagne. cell phone video captured men seen lobbing punches and throwing kicks. when asked about mccoy's role his lawyer responded. >> the one quote i have, on the public record is exactly that he did nothing wrong but i will not say anything more about it. >> reporter: now this investigation is been waiting for more than two weeks now. when asked when the timetable will be on this case officials say there will not be a timetable. erika, back over to you. justin, thank you. right now check out your screen and take a look at this women. she's wanted on an a all the charge for what she did inside that south philadelphia dunkin' donuts. on february 12th workers at 15th and washington say she threw the tip jar, threw some munchins and a display case.

back on "eyewitness news". we are looking at powerful tornadoes tearing through the south killing three people. one of them struck in the apartment complex in pens coal, florida. injured several people and damaged three buildings in the complex. one survivor explains what she would have done differently.

incredible damage here from the storm system that spawned tornadoes in the golf states. this morning at least three people are dead and many more are missing. as don champion reports, some neighborhoods are no longer recognizable. >> reporter: even into the overnight hours, the storms, showed little mercy on the gulf states. in pensacola, florida a reported tornado tossed around cars and damaged most of this neighborhood, kelly williamson admits she barely survived. >> it is all that matters but it felt like a big train running through my home. >> reporter: in many areas daylight will reveal true extent of the damage with power knock out, people used flashlights overnight to sift through debris. the storms gained strength all day on tuesday with at least 26 tornadoes reported in the south, one of them blew the

much heavier rain that builds in here. at the moment severe weather threat is definitely gone autopsy cross mid-atlantic here. we have got a moderate risk which is high across virginia and north carolina we obviously sit on the northern fringe of that and slight risk for our southern counties, delaware, southern most new jersey and otherwise just a general thunderstorm threat for rest of the region but with that said is there currently potential for severe weather going on right now with that line we just showed you, couple tornado warnings in effect. serious clash of the air masses in the the deep south. we too could even up not with tornadoes but potentially very heavy downpours, very strong wind as well as maybe even some small hail w that said primary time is p.m. today, afternoon into tonight and then by tomorrow lingering showers the win is still with us and even into friday but weekend looks a whole lot better at this point, meisha. >> it sure does, thank you so much, katie, good morning. this morning's commute isn't that much better right now.
