>> from the cbs broadcast center in philadelphia. this is cbs-3 "eyewitness news". we begin this news with breaking news, sources tell cbs-3 that no charges will be filed against lesean mccoy and three other men in connection to alleged bar fight that left two philadelphia police officers hurt on superbowl sunday. good afternoon, everyone, i'm jim donovan.

>> i'm rahel. expected to make the announcement 2:30 press cons fran, walt hunter live in the cbs-3 sat enter, to tell us more, walt? i'm brooke thomas. >> brooke, multiple sources now confirm, that the district attorney has decided, no charges will be filed against former eagle, lesean mccoy, or his three companions, in the february brawl. a brawl that left those two off duty philadelphia police officers hunter. >> the speculation on whether or not former eagle, lesean mccoy, or any of his three companions, would face criminal charges, for a brawl inside a center city club february 7th, that left two off duty philadelphia police officers hurt, one with a fractured skull, began, within hours of the incident. and has been escalating in the media for nearly two month. at one point, mccoy, and his attorneys, spoke in person with investigators, and afterward district attorney seth williams held a press conference saying woe not be

rushed into a decision. now, sources confirm to cbs-3 the district attorney is expected to announce that neither mccoy nor anyone else will be charged with any wrong-doing in the incident. mccoy's attorney, dennis kogan, and attorneys representing the two officers, say so far they've not received any official word about what the da's decision is. officially the district attorney isn't commenting on what the upcoming press conference this afternoon is about or if he's made a decision, john mcnesby, the president of the philadelphia fraternal order of police, publicly stated in the past, that if mccoy isn't charged he will request the state attorney general to take over the investigation. much more on this developing story, at the da's press conference a little later. live in the sat center, walt hunter, cbs-3, "eyewitness news". >> thanks, walt, look forward to. that will national transportation safety board meanwhile back on the scene of yesterday's deadly amtrak

crash. >> investigators are looking into whether the back hoe was clearing away debris from saturday night's storms, now, here's what we know so far. the data recorder and video taken from inside the train are at the ntsb lab in washington, d.c. one thing investigators will look at is how fast the train was going when it hit the back hoe. now, trains usually travel around 100 miles an hour on that stretch of track. meantime, autopsy result of the two amtrak workers are expected later today. 341 people were on board, including seven crew members. the conductor, and 36 passengers were hurt. "eyewitness news" reporter anita oh live in chester where a news conference has just wrapped up. anita, what's going on? >> reporter: well, brooke, chester's mayor and fire commissioner thanks first responders and then offered their prayers to the families of those victims killed in yesterday's crash. they're still at this time not releasing the names of those two men. but given the photos of the damage that we've seen of this crash, from inside the train

it, really is astounding that those 37 people who were hurt only suffered minor injuries, when we spoke to passengers, they describe a scene of utter chaos from shattered windows, to flying debris, and fire, now, there were almost 350 people on board that train at the time. that was traveling from new york city to savannah, georgia. when we still have very few answers about what exactly happened, why that back hoe was on the train, on the tracks at the time, and the biggest question now is why those workers would be on the tracks in amtrak dispatch is required to notify workers of when and where these trains are scheduled to pass. that's exactly what the ntsb is trying to figure out. investigators are on scene, they did recover video from the train, and also, the data event recorder, which should tell them exactly how fast the train was moving at the time. here's what mayor thaddeus kirkland and fire commissioner travis thomas had to say not too long ago. >> this is hard.

>> good stuff there, pat. leslie van arsdale is in houston with the wildcats. leslie has live report from the championship game, later today on cbs-3, "eyewitness news". the title game tips off at 9:19 p.m. it is hard to believe, but the wildcat aren't the only team getting ready for big game today. phils open the resealer season today in cincinnati. phillies wrapped up the exhibition schedule against philly future stars, over the weekend. first pitch of the 2016 regular season comes a little after 4:00 this afternoon against the reds. the phils home opener is a week from today, against the padres. meanwhile, a big day for ai, allen iverson is a member of the basketball hall of fame. honor announced within the hour on espn. iverson fan favorite during a decade with the sixers leading the team to the nba tight unless 2001, while winning the league mvp. he was an all-star 11 times in his career, and won the all-star mvp award twice.

yes, one spot where it was cold enough, to actually support couple of wimpy snowflake, light little coat nag lot of the ski resorts earlier this morning, meanwhile, next camera, up next here we go, outside we go to the live neighborhood network, middle township high school, live picture, bright, sunny right now, westerly breeze at 14 miles per hour, 63 degrees, too, so it is almost like a tail of two forecasts because depending where you sit on which side of this front, it really is a different story weather wise right now. rain coming through steadily i would say coming through in pockets with the heaviest obviously, you have got some scattered variety out, there this is all sort of going to sweep through to the south with time. we look at the system in its entire tie, once it passes by, residual clouds, should be in the clear by tomorrow, high pressure regains control. let's walk you through the pattern. really is pretty wild start to april. see that in the seven day, there are temperatures all over the place. and it becomes, comes of course, because of a couple of systems moving through, like i mention. so once the first system gets out of here, wind picks up,

dropping on the thermometer, at best tomorrow, mid four's, much more like mid february than anything, get the classic winds tunnel effect setting up between areas of pressure, keep sunshine wednesday, will remain little on the cool side. mid 50's at best, but at least not as harsh. another round of showers, rain, thunder storm very likely as well, by that point have chance to rebound again, into the 60s, although you can't get used to it. now, looking forward in the eyewitness weather future weather, basically talking about the northern branch of our area getting in on the action for the next couple of hours, even in the mountains at this point it is generally warm enough, for just rain. then it sort of sweeps, rotates through, so the rest of us get in on it specially toward the typical evening rush, heck some of the rain could really pounds down near the shore towns for the tail end of the rush. then we start to clear things out by later on through the overnight. but that's when the freeze warnings goes into effect essentially region wide the further north you go. you will see freeze, but there isn't a warning necessarily posted for you. but that means, you want to protect any sensitive

vegetation there is will be something that lingers into tomorrow morning, maybe you have got easter lillies, something like that signature out, bring them inside. don't let them suffer through this chill. 46 degrees, at best, as we said for tomorrow. with the breeze picking up it is not going to feel much like the 40's it, will feel a lot colder than, that but look at that, guys, a lot of roller coaster riding going on here for the next couple of days, such is spring, you know? >> right. >> it happens. >> buckle your seatbelt. >> bumpy forecast. >> thanks, katie. all right, a wayward bear cub rescued in southern poland. this little guy is about two month olds, found by rangers, alone and hungry, so they took him to the vet. the vets say the cub probably wouldn't have survived another day without his mother. now, they're not sure whether they will be able to release him back into the wild, but they say, they'll make sure he's safe where ever is ends up. >> jim, you can adopt him. >> no. >> i know we keep trying to give jim a pet. >> ya, i don't want a bear. >> we got close with a dog this morning, but --
