2006 secrecy clause in a civil lawsuit. >> bill cosby back in the spotlight today. happening this afternoon, federal court judge is set to way three separate issues, former temple employee and cost bee accuser andrea constant wants a judge to void a secrecy clause surrounding 2006 civil settle. the lawsuit against constant, her mother, her lawyer, alleges they violate that secrecy agreement by cooperating with officials who reopened her criminal complaint last year. constant's attorney says cosby is simply using the courtesies tell to try to intimidate witnesses. the judge is also hearing motions in constant's defamation suit against former montgomery county district attorney bruce castor, castor declined to arrest cosby in 2005 when constant alleged cosby allegedly assaulted her, now says she is enhance g her story while filing suit. >> now, cosby has denied any

wrong-doing, all along, the hearing happening today here in federal court is scheduled for 2:00. reporting live, in old city this morning, jan carabeo, cbs-3, "eyewitness news", jim, brooke, back into you. >> thanks, jan. one person is treated for smoke inhalation after fire rips through three homes in logan. fire broke out inside a row home at around 11:30 last night the 4500 block of marvine street. the flames spread to two surrounding homes before firefighters could get it under control. so far no word on the cause of the fire. new cbs news poll this morning shows nationally hillary clinton leading bernie sanders by 6% for the democratic nomination. >> the two presidential candidates are coming off a fiery debate ahead of new york's crucial primary. jamie yuck as with the recap. >> one of the most heated exchanges of the night came as bernie sanders and hillary clinton sparred over the issue of income inequality. >> i'm sure a lot of people are very surprised to learn

in the crash wednesday night that killed tommy dunbar at aramingo and lehigh avenues. dunbar, who was riding a scooter, was hit and dragged 200 feet. several protests shutdown streets for hours, in center city, near temple university. yesterday members of the philadelphia coalition for racial economic and legal justice called for an end to the police department's stop and frisk policy, and they want to hire minimum wage, $15 an hour. three protesters were arrested in old city, and near temple many others protested the university's plan to build a football stadium. they say the university has bigger issues to address. now a look at newspaper headlines from across our region. >> from the burlington county times, news when burlington county well known and respected farmers has died, anthony russo the third was killed yesterday struck by tractor on his family farm. russo's fruit and vegetable farm one of the most well known farm stands in the

county and across south jersey. the news journal of delaware reporting republican lawmakers are pushing a bill that requires state officials to notify the governor and secretary of the department of homeland security if refugees from a handful of countries come to delaware. now, these countries are on a list of though believed to be harboring terrorists. >> in the bucks county courier times, bucks county community college, student len pay 140 per credit next year, 5-dollar per credit hike approved yesterday, for full time student, increase of about $60 from the current school year, and that's a look at some of the newspaper headlines from around the delaware valley. now you have heard of a breathalyzer. what about a text-lizer. >> who can use it on your phone. >> tough start to the playoffs for the flyers. first they lose a game, then one of their key players. we'll let you know who could be side lined for awhile. plus: >> i don't like to be called a hero.

poconos, it will be a little bit cooler today, down the shore, we top mid 60s in the city, middle 50's down the shore because we will have little bit after east wind, so cool breeze, and it won't be too breezy but still, catching some of the cooler ocean air, bring it on the shore. but into the upcoming weekends looking down right beautiful, up to 67 degrees, and by tomorrow, up to 72, meisha, on sunday, beautiful conditions for all of your outdoor activities. you can get the run in, you don't really have an excuse. you got to get out there and do it. >> yes, lauren, air absolutely right, there is no excuse. we wake up, it is a friday morning, talking about 70s. a lot to be grateful for, absolutely. boulevard here, headlights moving in the southbound direction, before the schuylkill. you can see what you are working w let me back out of your way. i would say this is fairly typical for a friday. but i will say, what we've been seeing so far, there is a little bit more activity than what we would normally see on very early friday morning, with the accident, many of which have been cleared, construction as well. make note.

overall, boulevard, looking pretty good before the schuylkill. delaware county take a look at this, for those every you headed in the northbound direction in delaware county looking good. take this up to the airport, exactly you what looking at. if you are taking a flight today all well at the airport. mass transit looking good, as well. this is where we have been talking about construction on broad street. both directions between jnk boulevard and spring garden you have lost the right lane. see just all of the flashing lights. penndot is out there. been out there all morning long. so far i'll let you know it clears, make note there is will start to slow you down just little bit any time you lose a lane on busy broad street it will slow you down. kelly drive repaving between fountain green drive and sedgley drive, one lane still block, make note that far for those every you in and around this area, also some downed wires from earlier accident, in upper dublin. blair mill road closed between witmer road and welsh rd., you will have to use alternate. best bet, dresher road. use it, it will get slow specially the more volume levels that weep start to pick up in the 5:00 hour pushing towards the 6:00. overall, it is a friday

morning, brooke, we're in a good mood. >> thanks, meisha. first it was the breathalyzer. now new york lawmakers want to introduce another road safety device, the so-called textalyzer. it will be able to check if someone was on the phone or texting during a crash. use of this device falls under evans law named after 19 year old evan lieberman. he died in a head-on collision with a distracted driver back in 2011. if evan's law passes new york would be the first state to the use the technology. i'm curious how it works if you have like the phones hook up to your sound system in the car. the texting i definitely agree with, it drives me nuts when i am sitting there at red light and i look over and people are texting. put your phones down. you got to drive. >> absolutely. >> pay attention. >> the flyers lose tough game. and a key player. >> multiple reports say sean could be out for the rest of the series after hurting his shoulder last night. lesley van arsdall takes a look back at the flyers rough
