on board tried to pull in the riverton stop at broad and main streets. >> we have seen the car coming, i was sitting down in there. >> reporter: witnesses say train collided with a mercedes benz carrying two passengers and dragged it a few feet, trapping the elderly driver inside. >> she seemed disoriented, getting all around i was trying to calm him down to make sure he wouldn't go into shock or something like that. >> he thought he would be alive. they had to cut the top of his car off with the jaws of life and pulled him out. >> reporter: tracie brown was riding in the first train car, and tried to beat the train before it passed. >> it was just running through. >> reporter: impact also injured a 31 year-old man and a 22-year old woman riding on that train, and they are both treated and released from the lords medical center of burlington county, meantime, new jersey transit officials are still investigating, and say they will not release video from the train at this

cbs-3 "eyewitness news". frightening video from a convenient store in port richmond a clerk risked his life to try to stop a man from stealing cigarettes. watch surveillance video from the 7-eleven on aramingo avenue. clerk pick up a baseball bat to fight off robber late last night. they struggled over the bat before the robber grabbed it and started hitting the worker. all he got away with was two packs of cigarettes. clerk suffered some cuts on his head. a brazen thief is caught on camera stealing money right out of the women's pocket in west philadelphia it happened last month at laundromat on the 1300 block of north 52nd street. police want to necessity if you recognize the suspect, first you can see him, sitting on a railing inside of a store. then, as the victims back was turned he snuck up and snatched, $300 from her jacket pocket. she chased him but he got away. a delaware county man is lock up on child pornography charges, we just got this mug shot of 44 year-old john hers of landsdowne.

police say he confessed to down loading child pornography for ten years. detectives found thousands of videos and pictures on his computer including some children as young as four years old. hurst is due back in court next week. bucks county emergency officials give all clear after a chemical spill at the water treatment plant in tulleytown. chopper three over the scene on main street this morning. a 9,000-gallon tank was leaking chloride a chemical that helps pull water out of sludge. the authorities tell us that the leak is fully contained with no impact on the environment. earlier precautionary warning to close all windows and doors had now been lifted. in campaign 2016 a short time ago highest ranking republican in politics house speaker paul ryan announced he is not ready to support donald trump as g.o.p. nominee. cbs news correspondent craig boswell reports this ace monk laundry list the serious issues the front runner must resolve before the general

first and foremost to our north and western suburbs and take a look what is happening outside in bethlehem right now, not too bad outside if you don't mind it cloudy and cool. it is dry to do what you need to do without rain jacket, umbrella, the glushes, whole 9-. cars moving just fine on the road there in bethlehem. no problems outside, and again, i can take a day like today every once in a while but when nine in the row we start longing for some sunshine. it was not anywhere to be seen today. take a look at our live neighborhood network. we will go to a few spots, palmyra cove nature park in new jersey also looking ugly. the kutztown area middle school lots of cloud, 56. that is the story all day. there were a few times where i saw a suspicious brightening in the sky where maybe that sun was trying to peak out but it never really quite made it all the way. you can see that system that impacted us with the heavy rain down the shore is over new england but this is one to watch for tomorrow. it is starting to pivot back to the west and all this rain will lift to the north and get in here, especially through

dust according to a new study. the most of the untested kits are in the city of philadelphia. >> "eyewitness news" reportser alexandria hoff joins us with the reasons behind the backlog, alex. >> reporter: i spoke with philadelphia a police this afternoon they told me that these are all older cases, many stretching back in the early 1990's. of every 100 rape cases, 32 are reported to police, seven arrests will be made, and three will be referred to prosecutors, and the rapist in 98 of the 100 cases will walk free according to the rape national network. now, 1,850, that is the number of untested rape kits sitting in pennsylvania according to police data through the health department. 1,300 of those kits are here in philadelphia. >> there might be an individual raped or sexually assaulted has a rape kit conductor performed and does in the want to press charges.

>> reporter: this is the executive director with women organized against rape. she says that there is various reasons why a victim's kit may not have been tested. a police spokesperson says of the 1300 outstanding kits they all predate 2011 when the department began mandatory immediate testing of all kits adding that there is a plan in place to deal with arrest. >> anytime there is any movement in the direction of the transparency that ace i good thing. >> reporter: when it comes to kids and the swabs and samples that must be made. >> the anxiety is reliving the experience. >> reporter: the last thing advocates and investigators want is for victims to be discouraged by these numbers. >> we want people to really understand that the system is moving and to report any sexual assault, sexual violence that takes place. >> reporter: i do want to add compared with other areas in the country pennsylvania numbers are relatively low. in 2013, they reported that they had a backlog of over

12,000 kits. reporting live, i'm alexandria hoff for cbs-3 "eyewitness news". >> alex, thanks. win in court the for jerry sandusky and his fight for a new trial. judge agreed to hold a hearing later this month to get sandusky's lawyers a chance to prove prosecutors acted inappropriately, during sandusky's trial. that could ultimately lead to a new trial for sandusky who was quick of molesting ten boys. he is currently serving a 30 to 60 year sentence. smoke and flames in texas as fire engulfs a warehouse complex in houston. four alarm fire began this morning at a custom packaging and filling company. officials say that it really released hazardous materials in the air. hundreds of the students from the nearby elementary school were evacuated as a precaution. it took 200 fire fighters several hours to get that fire under control. there are no reports of any injuries. one year after hit and run crash nearly claimed her life a temple student, finally gets her chance to participate in not one but three graduation ceremonies. >> this is a picture of rachel
