it is 6:00 o'clock. nearly three weeks after the death of amy joyner francis, three of her fellow students are now, facing charges. tonight, we're learning what led to the decision to file charges and underlying circumstances. hello everyone i'm ukee washington. i'm jessica dean. "eyewitness news" reporter david spunt is in wilmington. what can you tell us tonight. >> reporter: jessica and ukee, we were wondering for weeks writ took authorities so long to actually charge these girls in this attack against amy joyner francis that killed her. we know amy joyner francis the 16 year-old student had a preexisting heart condition. she died from cardiac arrest but that would not have happened according to the attorney's general's office if she was not attacked. essentially, jessica and ukee the attack trying their heart condition and that is what killed her from that fightin side of the bathroom. now, two juveniles have been charged, they are 16 years old.

they are going to be charged as juveniles. we can mention one name six year-old trinity carr, now trinity carr is charged with negligent homicide. she was seen, on that videotape actually hitting amy joyner francis and amy joyner francis fell back, hit a sing, late are died after those injuries but the other two not naming because they are under age, they are charged with criminal conspiracy. now, according to authorities, they were inside the bathroom when this happened, they are lured her to the bathroom but didn't physically touch her. that is why they are in the charged with that negligent homicide. that is very latest from wilmington. jessica and ukee, obviously a big development, that is why nobody was charged, sooner because authorities all along said listen, people will be charged, there is a reason they are not charged. now we know that reason because they had to figure out exact charges. amy joyner francis the 16 year-old from howard high school had a prior priest existing heart condition, that is what led to her death. reporting live tonight, david spunto for cbs-3 "eyewitness

news". >> thank you for. that we will have more tonight. philadelphia streets commissioner donald carlton is under arrest tonight charged with assault. >> allegedly punched a man at a house party. "eyewitness news" reporter greg argos is live at police headquarters with more on this case, greg. >> reporter: good afternoon. mayor placing the commissioner on unpaid administrative leave, this is just after he was charged with simple assault. all of this began when the commissioner allegedly through flaw punches during a december . the man in charge of the department which maintains our city streets, now is in trouble over a fight from last december. philadelphia police confirming that they have arrested 45 year-old donald carlton. philadelphia's city streets commissioner, appointed by mayor kenney, according to police, carlton and a 50 year-old man started arguing during a december 6th, 2015 house party, on the 6,000 block of american street. carlton then allegedly punched

the victim multiple times, breaking a wrist and injuring a eye socket. district attorney filed charges of simple assault and reckless endangerment friday. after receiving the case in april. it is unclear why the philadelphia police department held on to the case for so long. monday no one answered the door at carlton's home but this white suv, a city municipal vehicle, sat outside. mayor's office says that while carlton is on unpaid administrative leave, deputy commissioner mike carroll will take over his duties. we are live at police headquarters i'm greg argos for cbs-3 "eyewitness news". greg, thank you. nearly week long manhunt for an escaped prisoner end on the sight of the new jersey highway. arthur buckel was taken into cuss todd ate gunpoint along the garden state parkway in ocean county this morning. now that is more than 50 miles away, from bay side state prison in camden county where he went missing last tuesday.

his capture happened just hours after police say he planned to turn himself in. but he allegedly walk off from a rest stop in laye township last night before state troopers showed up. now that he is off the streets, residents in that community are breathing a sigh of relief. >> it is scarring everybody. especially when they lock down the schools here. but they got him. they did a good job. >> we felt comfortable we could keep our town safe but certainly a nice feeling to have him off of the streets ape have that concern no longer an issue. >> reporter: buckel was transported to new jersey state the prison in trenton for a mental evaluation. he faces up to five additional years behind bars for the escape. a preliminary investigation into a deadly house fire in norristown over the weekend reveals that fire does not appear to be suspicious. investigators say that while the causes yet to be determined the fire appears to have started on a enclosed porch. fire fighters were called to the 800 block of dekalb street early saturday morning, three people died in the fire,
