followed. this is a vigil to honor those and lost their lives is set to get underway in an hour. i'm ukee washington. i'm jessica dean. we have team coverage for you including those stories of survival. we will start with "eyewitness news" reporter david spunt live at the crash site in port richmond, david? >> reporter: well, guess kate happened about 9:30 at night on may 12th, 2015, tonight behind me, just a few hundred feet behind me specifically, about few hundred people will gather to remember those injured and the eight people who lost their lives on amtrak train 188. amtrak train 188 was on its way from 30th street station to manhattan, just before 9:30, may 12th, 2015, when several cars derailed in port richmond. eight people died. over 200 injured. the scene, chaotic. as crews rushed into aid the wounded. former congressman patrick murphy was inside the cafe star and snapped these pictures on their phone. recorder data indicates

brandon bass tan was traveling at 102 miles an hour at a 50-mile an hour curve. he has not said anything publicly since the crash. following the derailment, members of the congress, called out amtrak for not installing something called positive train control. a gps technology that uses computers, to slow down trains when needed. other parts of the northeast corridor had this technology. the curve in port richmond did not. it has since been installed. the investigation is ongoing. several smaller reports from the national transportation safety board, were released over the last year but the final ntsb report is scheduled to be released next tuesday. jessica and ukee that will come in the form of a formal board meeting at 9:30 in washington d.c. at ntsb headquarters. that is where board releases their final recommendations as far as safety recommendations. they will talk about probable cause, in this case. is there a whole separate criminal side to the case which hasn't really come about yet. we just don't know. at this point there are no

criminal charges against the engineer at this point. reporting live from port richmond david spunt for cbs-3 "eyewitness news". >> survivors of the derailment are grateful, they made it out alive but for many life changed after the crash. "eyewitness news" reporter walt hunter is at city hall where survivors and families of those impact by the crash met with first responders, walt. >> reporter: well, ukee a year ago under the worst of all circumstances the survivors and first responders, met for the first time, at the scene of that terrible wreck. today, back together again, the survivors, first responders, and the families and victims of those who did not survive here at city hall for a solemn remembrance services. as first responders exchanged hugs, amtrak trash survivor bob hewitt helped by his family slowly painfully made his way to a remembrance services, closed to the press, inside the mayor's reception room. joining victims, families, and rescuers, whose lives were

forever changed in the wreck of amtrak train number 188. >> i woke up, laying on a pile of rocks, all of my clothes had been ripped off, i could not move my legs. i could not see out of my right eye. >> reporter: crews of engine company seven and ladder ten, first on the scene one year ago listening as the webster school choir sang over the rainbow. this ceremonial fire bell rung8 times, once for each victim. >> we are trying to get as many people as we could possibly off the track then because it was a hazardous situation with the wires down. >> i don't care if you see 500 people, you are always thinking about the one you didn't get to or one you could not save. >> reporter: also a dressing those at services amtrak president, joe boardman. >> the mood and emotions i think ran a wide range in the room, from forgiveness, to anger, to all of the things one would expect with this

kind of an accident. >> reporter: but while amtrak president's words were heard at the services the hewitts say they have yet to hear one year later any words of consolation or explanation from the railroad, about the deadly wreck that has scared their lives and the lives of so many others. >> it is outrageous, that no one has contacted to us say anything that they are sorry or that they are concerned. i mean this was something that never had to happen. >> reporter: so as they move painfully forward, the hewitt family does have one other hope, beyond healing. it is that they will meet, four philadelphia police officers seen in the picture that they have, office their they believed were carrying a stretch with mr. hewitt on it, office their they believe may well have helped save his life. that reunion is still to come. live from city hall, i'm walt hunter for cbs-3 "eyewitness news". philadelphia district attorney seth williams

addressed frustrations of survivors today over the investigation into the crash. >> i have had an assistant district attorney that has been assigned to this case and been work ago long with the ntsb, since that tragic day. and as soon as they have completed their very, very thorough investigation, if it ace pope eighth to hold someone criminally responsible, we will. >> the d.a. will be attending tonight's vigil in port richmond. there will be no charges filed against four wilmington police officers involved in the deadly shooting of a man who needed to use a wheelchair. thirty-one page d o.j. report concludes that the officers were justified in shooting, jeremy mcdole because they believed that deadly force was necessary, to protect themselves. cell phone video shows mcdole carrying a gun and reaching toward his waist when police opened fire. the report did conclude that the officers were not properly prepare for the situation and said one policeman exhibited extraordinarily poor police

work and should not be allowed to carry a gun in public. in campaign 2016 donald trump is giving a thumbs up to his visit to washington today to meet with key republican leaders. the presumptive republican nominee and house speaker paul ryan pledged to work together. they met this morning. trump tweeted he had a great day in d.a. and things are quote working out really well but ryan is still not ready tone doors trump. on the democratic side front runner hillary clinton met with 19, hiv aid activist in new york city today. they represent a coalition of more than 70 organizations that have asked the presidential candidates for help with continuing health crisis. clinton says that the u.s., must continue to lead a way in finding a cure for hiv aids a. a short time ago clinton's rival bernie sanders wrapped up a campaign rally in south dakota despite being behind in the delegate count, sanders says he is hoping for a contested democratic national convention here in philadelphia. earlier today sanders took sometime out to tour mount

rush more, south dakota votes june 7th with new jersey. with the reps race narrowed down to donald trump as a priest sative nominee concerns over disruptive convention protesters have shifted from cleveland to philadelphia. as "eyewitness news" reporter alexandria hoff tells us city official as dressed those concerns while launching the non-partisan, political fest. every fourth year our national convention serve as a celebration of the political process but really only for the select few invited inside. enter philadelphia's political fest, an all inclusive non-partisan event that will coincide with the dnc. first political fest was held during the rnc in 2,000 but idea was born in 1996 during the mlb all-star game when governor rendell said he realized that the people of philadelphia weren't able to get inside. >> major league baseball, wanted the people in the host cities to feel part of it.

so they created something called fan fest. >> reporter: fan fest political fest, same idea. from july 22nd to the 27th, seven locations will essentially be throwing a family friendly political victory party, based at the constitution center heading to the white house exhibit but city wide, as for potential convention protests. >> we will be ready. i consider my job and our job as a city to be the bones of getting things done. >> here in 2,000 with the republican convention we had numerous arrests, and protesters. you always worry about that. >> reporter: former governor rendell did earn some heat for those feeling bern after calling out sanders supporters on facebook this week for saying his supporters to have behave and not cause trouble. >> i think they will be protesters in cleveland but there will be protesters here. we should not be naive enough to think that there won't. there is nothing wrong with demonstrations at all. but i want everybody to be peaceful and respectful.
