norristown. good morning. >> that hear is set for 9:30. cosby is expected to show. the question is will his accuser be here as well. we last saw cosby in court for pretrial hearing in february. cosby, a 7-year-old has been working to get his criminal case thrown out since charmed in december. on monday the state supreme court refused lawyer's 11 hour appeal to delay today's hearing and he returns as court determines if prosecutors have enough evidence for trial. speculation is building that cosby accuser andrea constan can be called as prosecution witness. back in 2006 she had her civil suit settled for undisclosed amount by way of cosby's own testimony which lawyers say he gave with assurance it would be sealed never revealed. former montco da bruce castor

admitting to make that so-called deal and then a federal judge later unsealed that testimony prompting current da kevin steel to pursue this criminal case arguing that that deal was not bipding to his office. cosby's unsealed account details that he has given women drugs before for several in the past. constan ales that happened to her in 2004 when she was temple basketball staffer and cosby a mentor. cosby says their encounter was consensual. now more than 50 women lodged misconduct complaints against cosby prompting his wife camille to also be deposed. that was recently disclosed as well. we can also tell you too that cosby is facing charges of aggravated indecent assault and if convicted could face ten years in prison. we're live norristown justin finch cbs3 eyewitness news. jim, brook back to you. >> stay with eyewitness news as

for his funeral. someone opened fire on a tow truck in philly hurting driver and passenger. now police want to know who did. it investigators say bullets came from both sides in the nice town, tioga section. the driver is in critical condition. the passenger is in stable. >> a judge clears baltimore police officer edward nero of assault, reckless endangerment and misconduct in the assault of freddie gray. nero played little nrol gray's arrest and was not responsible for the failure to buckle him into the police van. nero's father says this news is long overdue and the son is carrying this burden for a while. >> it was beyond words. it was extraordinary moment long overdue. year of heartache with my son and now that the verdict has gone the way we all hoped it would we're ecstatic. >> gray died april 2015 after suffering spinal cord injuries

i think we're all so over it. taking a look at the birds eye view of the vine. this is moving in the westbound direction on to schuylkill. you see what it looks like her here. schuylkill is looking good and so actually is the vine as we push towards this 6:00 hour. this is kind of holding steady. this is what we've seen for a little bit now and holding right there which is great news. and got this penndot camera loop around. 422 taillights moving in eastbound direction approaching trooper you see both directions heating up. primarily in eastbound direction 422 and ben franklin bridge you're looking at if coming from jersey to center city looking okay. it is looking a little foggy out there and also looking wet and dalp. i experienced that even on my way n be careful out. there we'll have pooling in some areas. also tacony palmyra bridge opens 6 a.m. so in 12 minutes or so. make note if you have to take the tacony palmyra. summer son byberry road evans street and construction pa turnpike both directions route
