"eyewitness news" reporter trang do is live at 63rd and theodore street with breaking details on this, trang. >> reporter: you can see it is a active scene here with the crime scene unit in front of the victim's house. police are not the releasing the name but he is a 77 year-old man who lives here his entire life. neighbor called 911 around one there 30 monday morning after hearing commotion from the house. fire fighters came out, knocked on the door but saw nothing out of the ordinary. they left without going inside the house.

man's sons called police to do a well-being check on him after he didn't hear from him since friday. the office's arrived at 1:00 p.m. to find the man on the floor of his home with blunt force trauma to the head. detectives believe that the suspect broke in the back of the house, and beat this man, twice over the course of the weekend. >> there are many things, since friday night when he got beat up by kids in the neighborhood. he didn't go to the hospital. and it appears that sunday, early monday morning the kid again broke in the house and assaulted him and injured him and killed him. >> reporter: police say witnesses reported seeing three men leaving the front of the house, locking the door behind them. police are asking anyone with any information to contact them. but we are live from southwest philadelphia, i'm trang do for cbs-3 "eyewitness news". >> okay, thank you. another disturbing discovery in chester county a woman's body is found in the pond tied to a cinder block. chopper three was over the pond in east coventry. body was discover on the surface of the water around 11:00 o'clock this morning.

they say she was already dead when she was placed in the pond. >> no gunshot wounds. no blunt force trauma. no sign of strangulation. in other word there is no obvious signs of what the cause of death was here. >> authorities are hoping that jewelry and tattoos, could unravel the mystery of the victim's identity. well, a long forgotten painting is now at the center of the legal battle. >> a local man is taking on the federal government, to keep the possession of the piece of art that he painstakingly restored. "eyewitness news" reporter alexandria hoff has more on why the government wants this painting. >> i see a weary man, with a suit that doesn't fit but he is just loaded with dignity. >> reporter: with oil, on canvas, 1934 farmer represents the period in which it was painted. america's great depression and through eyes of one man the proud people, who remained resilient. >> it was completely black. it was shredded.

it had holes in it. >> reporter: matthew schwartz is a cherry hill based international fine arts dealer. he said 80 plus year-old piece had been discarded by a museum and wound up at a low end auction where he bought it and realized it was a work by john slaven. >> we spent several weeks restoring the painting to its original condition. >> reporter: he then listed it for sale for $8,500. shortly after posting the paint to go e bay, schwartz was issued a federal summons state ago this this painting was created through a new deal era arts program, a and therefore, claiming that 1934 farmers is property of the u.s. government. according to the summons federally funded art completed during the great depression has simply been on loan to government entities and non-profit but schwartz says if the piece had any prior worth to the government, they never showed it. >> this painting is me. this painting is mine. >> reporter: emotion has been filed in federal court in

bus, it has been done in canada and other countries as well but it has been staying away from the u.s. we are stepping into that area for the first time. >> reporter: doctor charles pollack is director of the institute of emerging health professions. he said the creation for education and cannabis research toys fill a gap in information available to both patients, and doctors, on medical marijuana. >> the scientific and clinical side, this is a concern that there is all this excitement and interest and all this hope and yet in many areas there is a real lack of what we would can be for typically sound scientific data. >> reporter: governor tom wolf signed pennsylvania's medical marijuana law back in april legalizing its use for 17 different medical ailments. both new jersey and delaware already have laws in place with other states, likely to follow, doctor pollack hopes that jefferson will lead the way, to a better informed medical community. >> we're looking at a best path forward given the now 24 out of the 50 states approved this plus district of columbia
