"eyewitness news" reporter joe holden is live at chester police department and joe, you spoke with this child's family. >> reporter: jessica and ukee, the family is very upset and as for police right now they have no suspects, they have no met i have, there is no indication why this happened, except for the fact that police say that it is a case of mistaken identity, one that nearly killed a five-year old boy. >> i can't figure it out. >> reporter: mark andrews junior is recovering in the hospital from a gunshot wound to his shoulder. chester police say somebody drove wye, and shot up his home. >> me and my kids hit the floor. wasn't nothing else we could do. >> reporter: chester police captain called it a scene from war. detectives say from as many as 30 shots were fired outside in the 400 block of winnington place on monday night. le to be a said she just came home from work and was cooking. mark was hit while he and his family crouched on the floor trying to take cover. >> he said mom, i'm shot. that is what he said, like, so

my kid, my solar, honor role students they don't hang out on the streets, they should in the be going through trauma like this. >> reporter: this isn't the first time shots have been fired here. she with her mother called on chester city officials to step up police presence. >> there should be more police down here. >> you have to start talking for your children's sake. he is five years old. i could been here planning his funeral. >> reporter: surgeons are trying to determine if the bullet lodged in little mark's shoulder can be removed. on video his family shared with us, mark tells his friend he is feeling better. >> i'm feeling better, guys. >> reporter: now police told us earlier today they would not be available at any point to take for on camera interviews. we are told that is because mayor thaddeus kirklandis out of town. now he is coincidently, a state representative, calls to his office for comment about all of this were not returned.

now, the little boy in this story obviously still is in the hospital, little mark is expected to be released tomorrow. reporting live outside chester police headquarters tonight i'm joe holden for cbs-3 50 witness news. >> joe, thank you. a pizza delivery man survives an execution style shooting while on the job in southwest philadelphia last night. police believed that to suspects initially gyred gafar sirha to rob him. they then ambushed the victim driving him a few blocks away and shot him in the back of the head. relative said he begged for his life. >> he said why, he said no. i'm convinced. i don't know anything. that is where they shot him. police describe the two a tackers as light skinned black men in hear 20's. the victim is in stable condition, at penn presbyterian hospital. now in campaign 2016,

tonight, we may have a clearer picture in the race for the white house. new jersey voters are casting their ballots and as we have learn that hillary clinton will have the delegates to be presumptive nominee setting up a potential clinton/trump showdown for the presidency. new jersey and five states are up for grabs tonight, pivotal night in the march for the democratic national convention right here in philadelphia and republican national convention in cleveland. "eyewitness news" reporter cleve bryan is in collinswood, new jersey to show you what is at stake tonight, cleve. >> reporter: good evening, ukee. the thunderstorms are gone and activity the is picking up here at collinswood grand ballroom, even though the news did come out that hillary clinton has enough delegates, lot of people still turning out, still hoping that their vote counts. >> i voted for bernie. i still got faith. >> reporter: to many voters new jersey primary lost luster with news arriving just before polls opened that democrat hillary clinton has enough delegates to beat rival bernie sanders for parties

presidential nomination. >> when you are in new jersey and you are voting june 7th, it seems as though it doesn't really count that much. >> my only hope is they will somehow work together because i like both of them to be honest and always a hard choice even though it wasn't that important at this point. >> reporter: even though new jersey primary has in bearing on republican donald trump's presumptive nomination his supporters still turnout. >> i voted for trump. >> i really don't like hillary at all. >> reporter: also at stake in new jersey the 12 congressional districts, here in the first district 25 year-old alex law is challenging incumbent democrat, donald norcross. throughout new jersey freeholder seats are up for grabs. >> get out to vote, exercise my right and i don't like what they do. >> reporter: to many right to vote matters just as much as the results. >> my first time voting, i am zero, i turned 20 yesterday, i still feel like i put my say in there and i hope it means something and i hope it is worth it. >> i was telling the ladies, that my mother used to work in

lot of attention during pope francis vice tonight september. original willly there were plans to consolidate the lower merion campus, selling or leasing unused buildings but those plans have been halted. now they hope to partner with the local catholic college, and build a new facility. >> philadelphia police need public's help identifying a pair of thieves prayed on the woman inside a check cashing store. this happened last friday at ace check cashing store on what hadworth avenue. one of the suspects snatched a envelope full of cash out of the six three-year old's hand. she fell, while trying to chase them. but they got away. if you recognize the suspects you are urged to contact the police. pennsylvania state police need your help finding a person they say fired a shot during a road rage incident on i-95 this morning. the officers say that this happened in the northbound lanes, near the girard point bridge, around 6:30 a.m. the suspect apparently fired one shot before speeding away in an older model black chevy

"eyewitness news" reporter trang do will have more on "eyewitness news" at 11:00. today in harrisburg pennsylvania lawmakers voted overwhelmingly to loosen the state's tightly controlled liquor system by letting groceries and other outlets sell take out wine. backers say if governor tom wolf signs the bill consumers could be purchasing wine in supermarkets within months. the legislature also formally approved the sale of beer at convenient stores. still to come on "eyewitness news" not your every day graduation ceremony, the reason this montgomery county commencement, was so unique. historic eastern state penitentiary is home to plenty of interesting event but what is going on inside these walls now is going to surprise you. vittoria woodill will explain, kate. showers and thunderstorms on the radar but most of them now pushing off shore and through tonight and rest of the week we will be clearing out, and cooling off, i'll tell you about a stretch of 70's and when we can expect another round of showers to

fletcher cox skipped few round have voluntary work outs and somehow that became a big deal to people. team started a three day mandatory mini cam top day. he shows up. somehow that is a big deal too. darren sproles, and cox both practicing with the bird, both guys skipped ot a's. cox is in the final year of the rookie contract that will pay him 7.9 million this season. he and bird are working on a new deal. he said he is exited to return to philadelphia. here's head coach doug pederson. >> it is a voluntary off season. it is his decision, any of the guys can stay away. you know, i don't get that. i will no look in the past. i'm looking forward. he is here today. he was here yesterday. i'm excited to have him. we will just build off off each day we have with him this week. >> sticking with the defense second year linebacker jordan hicks was at practice today but was limited nursing a leg injury. right now he is slated to be starting middle linebacker.

can turnaround. >> we all came the year we came, you know, i believe it was eight years that the sixers missed the playoffs. so, we understand, turning the corner, the city gave us an opportunity to do that and we were excite that had they did and we turned things around and we had a unique player named allen iverson and he helped out a lot. >> yes. >> all right. so, ukee, how was it. >> it was beautiful out there. these guys are so fired up, about what is coming with bobby jones and world b free, bobby jones went to the aba before coming to the nba and played with the sixers, at championship team. world b free. >> yes. >> world b never saw a shot he didn't like. that is my man. great golf out there. >> that looks like you out there on the golf course. >> a lot of the great senior players are in town and cricket club is a a fantastic ship. i was riding around, warm today, skies were great.

as i came back to the city, kate bilo things started to get dark. >> you are like, well... >> what happened. >> yes, for golfers when you are talking about thunderstorms. >> that is right you don't want to be out there with a big metal rod never a good thing with lightening and thunder. showers and storms are out of here right now. that is great news and good news over the next couple of days, golf weather, looks fantastic. tomorrow midday is one day that i think you have to watch out for for rest of the workweek, right around lunch hour and then things clear out in the afternoon. we will get to that in a moment. lets look at storm scan three, you can see showers and storms that moved through the area have now cleared the coast for the most part, the delaware beaches, still getting some showers at the moment but those are moving on out as well and any shower behind this, there are a few showers and thunderstorms firing up offer chester and berks county those have since deteriorated as well. maybe a stray sprinkle off to the north, a few overly high valley but that is it. zooming in on the shore still a few showers from stone

harbor, wildwood, cape may, heading in the delaware beaches but these are quickly clearing the coast and everything will be nice and comfortable tonight. take a look at these photos, stepping out for just a moment our friend in stone harbor sent this and look at that line of cloud you can see that line of storms pushing in blue skies to the east, take a look at how dark that is to the west, beautiful photo and then this as well showing storm pushing in over stone harbor, new jersey. they have cleared out but so far we have a trace of rain today and that means take a a look, eight out of the last ten tuesdays have had rain. tuesday have in the been so great overpass couple months. hopefully we can break that trend moving in the summer but trace reported so far at the airport today. heading through overnight hours wind will be generally light. 7:00 a.m. even though we have sunshine watch midday by 11 or 2:00 this line of showers pushes through, maybe rumble or thunder or two and watch what happens when they move out by afternoon we will clear skies but brisk northwesterly

wind will pick up, wind around 20 miles an hour with gusts as high as 25 or 30 miles an hour, windy, cooler afternoon, even as sun peaks out and does stay breezy right through day thursday with wind at 15 to 20 y afternoon w that being said we will clear it out, breezy beautiful day with very, very low humidity as we tap in the cool canadian air. let's talk about tropics. we have had tropical storm colin now a post tropical storm. this is most active start to the atlantic hurricane season since 2012. so far through today we have had three named storms, one out alice was a hurricane. average through july 9th we had one named and zero hurricanes before july 9th. most acknowledge i have parties late august into september. early start does not technically mean an active season. remember last year we got off to a fast start as well. we had tropical storm in may but then everything fizzled and below average season. 2012, however, active start and active finish as well.

there is a chance that this could mean things will get more active as we head in the months of august and september. generally speaking in the early season most storms form where colin did in the eastern gulf of mexico what we call home grown systems. moving through florida or along the coast of texas. later you you start seeing them forms with waves off africa. overnight tonight back to home base, sure early and then partly cloudy. 60 degrees. tomorrow breezy and cooler. a few showers possible especially around midday, high of 73 degrees. noticeable will cool down tomorrow. thursday and friday looking beautiful, can't beat that weather, 70's with sunshine. back to the lower 80's this weekend. a couple showers. it will get windy sunday into machine but no major heat waves on the way and in big way on the way either next few days so that is good news. >> senior pga guys will have a great week. >> yes. >> thanks, kate. new at 6:00 o'clock, boy, five sets of twins graduate from a local high school.

to a famed jail. >> "eyewitness news" reporter vittoria woodill is live from eastern state penitentiary to explain this unique event, vittoria. >> that is right, i know it doesn't look like much behind me because a portion of the event is happening inside of the eastern state penitentiary. there are bringing yoga to the baseball diamond of the penitentiary where at one time, served as a work out area for america's most dangerous criminals, but here's what is interesting not only are they opening up the conversation of yoga in prison but you they are trying to open up the mind, body and spirits of inmates in prison. check this out. go behind the walls of the eastern state penitentiary and you usually find haunted spirits. >> add some new treat. >> reporter: tonight you'll fine peace in your mine, body and spirit, to a free ohio class as part of the search light series. >> we wanted to bring someone into talk about the mind, body connection of why people in prison so often get a lot of the yoga.
