"eyewitness news" reporter jan carabao is live with more on what this ruling means, good morning, jan. >> good morning. this is not a done deal just yet, the state could still appeal and spokesperson for attorney general's office say d o.j. is reviewing decision. still opponents of the death penalty are celebrating this as a major victory. in a 148 page opinion delaware supreme court has ruled that the state's death penalty law unconstitutional. >> i'm excited. >> reporter: decision sally has been working to achieve for decade. she founded delaware citizens opposed to the death penalty

24 years ago. >> here we are we have to just keep hoping, working and keeping true to your belief. >> reporter: court ruled delaware's death penalty law, uncontusional after determining it was flawed in two ways, first it allowed a judge independently of the jury to sentence defendants to the death penalty. delaware was just one of the three states to allow that. delaware's law also didn't require juries to be unanimous when recommending the death penalty. supreme court ruled that these two items violate a person's sixth amendment rights. >> they have triumph that you should have a jury have of your peers. >> this is rare. >> reporter: public defenders, sam argued the case had a chance on take a step back or forward and they took a step forward. >> reporter: court said delaware's death penalty law isn't salvageable, legislature would have to pass an entirely new law, death penalty to be an option in the future. >> it is up to the state to decide how they want to proceed.

condition. new this morning philadelphia police say a shooting in cobbs creek overnight may have started with an argument over a card or dice game. >> police were called to the 100 block of north 54th street around 11:00 p.m. for reports of the gunshots. the investigators found blood and shell casings on the street and then they got a report that a 24 year-old man was dropped off at mercy hospital with gunshot wound to the face, arm, and the leg. police suspect there might be more than one shooter because they say that the shell casing were of two separate calibers. >> we are getting information from the officers that often individuals are out here gambling and playing cards. so motive for this shooting, may be related to a dice game or the card game. >> victim is at penn presbyterian medical center in stable condition, police have not released a suspect description just yet. a pit bullies killed by police after it attacked people in the cities point breeze neighborhood.

this happened around 8:00 last night near 16th and dickinson, officers were responding to calls of the dog attacking a woman. investigators say when they arrived the same dog was attacking a man and his dog. one office says he tried get the dog off the man and could not but shot and killed the pit bull month. man was treated for by the on her hands, and man treated at the scene. philadelphia's district attorney says he won't drop case against monsignor william lynn. >> former church official was grant aid new trial over accusations that he mishandled sex boost complaints. "eyewitness news" reporter justin finch joins us live from the cbs-3 news center, justin. >> monsignor is due you back in court tomorrow for status hearing before a soon to be scheduled trial. judge called for lynn's release yesterday on $250,000 bail after pennsylvania state supreme court granted monsignor lynn a new trial. from a distance a far look at lynn's prison release just outside scranton where he is living with loved ones for now ahead of his new trial.
