justin. >> reporter: brooke and jim, good morning, today he is set the for a status hearing during which a judge will schedule his next trial date. >> he's responsible for so much, so much pain and suffering. >> reporter: mike mcilmail reacting to the tuesday release of monsignor william lynn from a wayne county area prison outside of scranton. lynn, first u.s. roman catholic church official convicted of covering up clergy sex abuse claims is now staying with family as he awaits another trial. that prison release video and new developments in lynn's case have been unbearable for mcilmail and his wife debbie. couple hold five five-year old partly responsible for a ledge molestation of their son, sean. >> my son was a abused because of his decisions. >> reporter: mcilmails believe sean was violated while a student at resurrection parish school at the hand of the father robert brennan a secret

sean kept for years. his parents say sean battled addiction but was able to file a police report but days before he was to testify before brennan, sean died of an overdose at age 26. brennan's name would be tied to other sex abuse allegations and investigations led to defense lawyers thomasbergstorm says lynn was not in charge of the priests. that was up to cardinal anthony bevilacqua who has since died. >> he knew what he was doing. i don't want to hear bevilacqua, krol, all up the line, you know, at some point these priests have to become moral human being. >> reporter: quick in 2012, lynn has served half of three to six year sentence with the child endangerment convictions twice overturn he was released on bail but d.a. seth williams various to retry lynn,bergstorm says his team is ready. >> for some reason, you know, he continues to want to beat
