day, opening arguments started around 8:30 this morning when prosecutors and the defense laid out their case, and for prosecutors, it is simple, this is a case about kane's desire for revenge. pennsylvania attorney general, kathleen kane arrived with family at montgomery county courthouse for the first day of testimony in her perjury obstruction trial. the prosecution started opening arguments with a quote that they say comes from kane herself: revenge is a dish best served cold, said prosecutor michelle henry. her word, defendant's word, that is what this case is all about. the prosecution says that kane was spent honorary avenge leaking secret grand jury information in order to embarras a rival and then lied to cover it up saying that she didn't know it was forbidden to release such information even though she had signed a oath bit just days after she took office. it is opening arguments, the defense countered saying kane made a honest mistakes and mistakes are not criminal. defense went on to say the alleged feud between kane and

former state prosecutor is manufacture. defense attorneys said that he left ten minutes after she arrived, it just does not make sense that she would risk her reputation and her career. meantime inside the courtroom kane often spoke to her attorneys, her family sat directly behind and across the aisle interested members of the public. "eyewitness news" spoke to several of the attorney general's supporters. >> i'm here as an interested taxpayer. i'm here as somebody who has always supported the ideals of kathleen stood for, and i'm very curious to see the case, that the state has against her. >> reporter: commonwealth's first witness was montgomery county detective paul bradberry, he spent hours on the stand and presented document showing that kane signed notarized oaths to keep grand jury information gathered before she took office a secret. now, six men and six women will determine kane's fate. on the stand before the court adjourned was bruce beamer, a one time first deputy for kathleen kane, former top aids are expect to testify against

kane and it is unclear whether she will take the stand herself. this trial, is expect to take one week. we will continue to update you but for now live from norristown, jan carabao for cbs-3 "eyewitness news". convicted felon joey merlino's detention hearing has been rescheduled for friday at the request of merlino's attorneys. there has been no reason given for the request. federal authorities arrested merlino last week for his alleged role in an organized crime ring. merlino was released from federal prison in 201 after almost 12 years in federal prison on a racketeering conviction. federal appeals court delivers a major blow to new jersey struggling casino industry. the panel has reject state's bid to legalized sports bet nothing casinos and race tracks. they ruled new jersey's law which was passed in 2014 violates a 1992 federal law. four major professional sports leagues and ncaa sued the state over its sports betting legal says attempt. they claim would it damage the

integrity of their games and lead to game fixing. in other news delta airlines continues to try to reset its operation after a global computer outage that led to traveler chaos. so far delta has cancelled about 530 flights. the airline has been working to get crews and airplanes positioned in the right spots to resume business as usual. but delta says some systems are still operating slowly, as for what triggered this mess, delta says a power control module at its tech center malfunctioned causing a surge and then loss of power. airline says power was restored quickly but that some systems didn't switch over to backups as design. search crews have finally recovered black box the from the el faro, the freighter/ship sank near bow ham owes when shot in hurricane joaquin's category four wind. the recent recovery may give them insight into exactly what went wrong in those final moments. all 33 crew members on board died in the wreckage.

police are searching for the thief who stole a hospital computer, a crime caught on camera. this is surveillance video from methodist hospital on south broad street. it is from 6:00 p.m. on july 28th. a man is seen walking with an hd desk top computer, monitor, keyboard and a mouse. he got a way through the broad street doors. it is not clear if sensitive information was compromised. if you recognize anything about that suspect, please call police. take a look, also caught on camera, four suspects smashed their way in canal's liquor store in berlin boro last night. they used a big rock to the shatter front glass door window on route 73 and jumped right through it. once inside police say suspects ransacked the cash registers and wine cellar office. we are told there was no money in the registers but if you recognize the suspect please call the police. chopper three over the 4700 block of melrose street, moments after the porch roof collapsed on three homes here. this is in the frankford section of the city.

one person dead. that fire is 6 percent contained. and back here at home, we are dealing with, some high temperatures as well, nothing like that, thank god. >> nothing wild fire-related but we are talking about intense heat and humidity returning. if you thought last week maybe we're done with it, you were wrong. we were all wrong, it is not going to feel great by the end of the week, in fact, dangerous heat is on the way. temperatures not as high as they were in late july when we had a few days around 95, 97. humidity though will be the problem, this time around. one place you can beat the heat down the shore still very humid down the shore but temperature wise, of course, heat index wise it will not feel quite as bad. today has been a great beach day. we have had increasing cloudiness in the western suburbs but eastern suburbs have been looking pretty fantastic and feeling great outside right now. we have got temperatures in the 80's, lots of sunshine and people outside the beach in ocean city and margate where it is looking like blue sky afternoon.

a special project to give the homeless in texas their own space to call home is starting to take shape. >> grace campus in lubbock is looking to replace all of these tents with brand new tiny homes. volunteers are using donated supplies to build the small spaces. one has already been completed so far, organizers say tiny homes will be able to provide residents a sense of security. >> they will be able to lock the door, they don't to have worry about their belongings, and i would imagine, probably sleep better at night knowing that the door is locked and be in will walk in on them. >> each house is about 10 feet tall by 12 feet wide and big enough for two residents but doesn't have any plumbing or internet access but shelter resident would have to use the

controversy in rio a russian swimmer nabbed the silver in last night's 100-meter breast stroke. >> a swimmer with a history of doping. recent decision to put the swimmer back on the roster caused boos from the crowd and a grudge match with an american. >> she swam in lane number five right next to her american rival lily king. and by the time they touched the wall, the russian had served a 16 month suspension for doping, won a silver medal. coming in second, to the 19 year-old american, the grudge match between the two began over the weekend when they engaged in a fierce finger shake off, lily king said you are shaking your finger for number one and you have been caught for drug cheating. i'm just not a fan.

can see what is heading our way. we have got clouds building in to the south and west this afternoon. not a big deal. been dry for majority of the area today but that will all change as the heat and humidity start to ramp up later in the week, so will our threat for thunderstorm, pretty much every day in the afternoon and evening hours. they are driven by what we call, diurinal driven thunderstorms and driven by the heating of the day, hottest most humid part of the day is late afternoon and early evening. when you destabilize atmosphere is when they like to form. tomorrow your heat index value around 2:00 look at these numbers. it will feel close to one hundred degrees. even tomorrow afternoon. thursday gets even worse, look at this, entire area thursday afternoon may feel like the triple digits and then again that is dangerous heat and sustained for three or four or maybe five days. i think you wake up tomorrow to cloud cover, maybe a couple stray showers in the morning. more sunshine in the afternoon. showers and storms off to the north and then thursday brings better chance for
