cleve bryan spoke with the home owner today and joins us live with more on that, cleve. >> shooting involved troopers from the bridgeton station here and it is an active investigation with the new jersey state attorney general's office. so, when we spoke to the survivor of gerald sykes at advice of his attorney he could not talk about details about the case but he does tell us it was his mind that kept him going as his body was failing. >> had that been another half inch i wouldn't be here. >> reporter: gerald sykes has battled back from the brink of death just before midnight july 29th upper deerfield resident was shot in his home by state police who were at his house by mistake investigating a 911 hang up call. >> i'm doing pretty good. i'm alive. beginning to feel better. a lot of the pain subsiding now. >> reporter: authorities said that the night of the incident two troopers knocked on sykes front door and didn't get a response so they check around back. as they shined their flashlights in the glass doors there was an exchange of gunfire, trooper fired off

four times, sykes fired a shotgun once. one officer was grazed, sykes took two bullets to the chest and within to the groin. >> i had a collapsed lung, two fractured ribs, ripped die frame, destroyed spleen, perforated bowl. >> reporter: sykes said he lost annex stream amount of blood and could have gone into shock, margaret sykes at his husband's side believes his calm demeanor saved his life. >> because he is strong, his mind is strong and he can almost cope with anything. >> reporter: authorities say officers identified themselves, but sykes attorney says the elderly man thought they were intruders outside his house. he said shakes grabbed his shotgun for protection and fired a round after he was shot. authorities won't say who fired first. do you hold a grudge. >> no, not really. i always believe in the police and i still do. >> reporter: troopers who have not been identified were placed on administrative leave but one of them, the officer

that was the one that shot his gun has an attorney and said it is trooper's job to investigate every 911 call as a serious incident and when they encountered someone with the gun they cannot assume what their intentions are but he said that is just a hypothetical situation. not actually sure what happened. all that is still under investigation. live, cleve bryan, cbs-3 "eyewitness news". police executed a search warrant on a home long the 2100 block of north locust street in wilmington today. that home is connected to a person of interest, in a murder investigation. yesterday, police discovered body of the 21 year-old map precious hoskins in the trash can around that urn core. she was shot multiple times. police asked anybody with any information to come for. judge sentence and attorney who represented jerry sandusky in the child sex abuse trial. car roam goer will spend 19 years in prison for stealing

$800,000 from clients. he pleaded guilty in may. prosecutors say that he spent the money on casino gambling. the four three-year oldies awaiting sentence nothing a tax evasion case. philadelphia's district attorney is getting a lot of questions about who gave him gifts, and why. "eyewitness news" reporter joe holden has the list. >> reporter: good evening, there were plane trips, vacations, suits, watches, many gifts, the question though the people behind those gifts and what possible influence do they have over district attorney seth williams. a staggering gift giving controversy is hanging over the d.a., personal and professional tokens of appreciation from 2010 through 2015 that seth williams admitly failed to disclose. the documents filed this week with the ethic board tell the story. most expensive, this $45,000 new roof on the d.a.'s overbrook home, paid for by a new jersey contractor, who is said to be a friend. williams wasn't home when we

came knocking. >> i know him on a personal level. >> but neighbor patrick doherty wanted to talk with us about the questions, now swirling about the d.a. >> got a lot of stress. he has two daughters who are in private school, you know, he has a lot of work load and deal were being the district attorney in the fifth largest city. >> reporter: documents show vacations including one to pun to can a, airfare paid by friend, if adjudge gifted williams ticket to the phillies and trip to ac. >> trying to reach the judge is he around. >> reporter: the judge scott declaude ohio didn't get back to us. woman who answered said criticism was price williams and the price were paying for being life long friends. a spokesmen for williams campaign told us all of these gifts were from close family and friend. did he make mistake of not disclosing them and that is what that is at issue here. d.a. seth williams has not been around to answer to any of these questions. it is unclear when he will be back on the job. in center city, outside d.a.'s

office joe holden for cbs-3 "eyewitness news". in camden county two people were hurt after their car was struck earlier this afternoon. crash happened in haddon heights at clemens bridge road and east atlantic avenue. intersection was closed for a few hours while investigators combed that scene. two people were taken to cooper trauma center in camden. their conditions are not yet known. authorities say no crew members on that train were hurt. a bucks county woman has been accused of rigging horse races by introducing performance enhancing drugs. twenty-five year-old merion vega is facing charges. investigators say she gave drugs to horses while employed at parx casino and racing venue. vega is out on $20,000 bail and set to peer in court august 31st. bucks county district attorney david heckler says he is ready to call it a career. announced his retirement at a news conference in doylestown this afternoon. the 69 year-old what's electric to the office in 2009 after spending a decade as a

judge. his last day in bucks county's top prosecutor will be on september 2nd. >> i consider myself, very, very fortunate to have had this opportunity and i'd like to say to the people of bucks county that i believe i'm leaving you an office in great shape and that will continue to do the important job of representing you through the criminal courts of this commonwealth. >> heckler's successor will be up to the bucks county board of judges. after eight straight days of 90 degrees or hotter, we finally broke that streak today. meteorologist kate bilo is outside on the skies deck with a look ahead at the forecast, hi there kate. >> not a bad evening outside, for sure, definitely much more manageable then the heat wave we have been feeling. it is a hot, steamy summer night but as you mentioned the heat wave is finally coming to a close. our high today hit 88 degrees in philadelphia a, that makes it the first day below 90

since august 9th, that kind of puts in perspective how long we have been suffering in the 90's, and we even got to 98 degrees briefly last week but today 88, meaning that heat wavecom to a close, temperatures are sitting at their daytime highs and still steamy. eighty-eight in the city. eighty-seven in wilmington. eighty-six in millville. eighty-seven in reading. got news is what we were talking about is the humidity and how much worse it felt then what the thermometer indicated. it is 88 and feels like 89. not too bad at all. lower 90's in south jersey and central delaware. mostly dry this evening, just a a few clouds, there is a i breeze picking up which feels nice but in the lehigh valley or poconos you can see scattered showers and storms, drifting south and east, most of us staying dry but there could be a pop up shower or storm for areas far to the north and west. unfortunately humidity will continue to climb and we will have a better chance for storms coming up this coming weekend, i will have your weekend outlook and news about a really beautiful stretch of

>> reporter: urban ax is first and only indoor ax throwing league in the country. he fell in love with the sport a few years ago when he moved to toronto and wanted to bring it back to the states for others to enjoy. >> people can come with their friend, book a private event, throw with a group of two, or 24 and experience the fun of indoor ax throwing. >> reporter: folks at urban ax says it doesn't matter if you chop down trees or never pick up an ax, there is something for people of all skill levels. >> some people you know, not surprisingly are intimidated by the idea but once they come in here and try it and see how safe, supervised it is, they think it is fun. i mean people love it. >> reporter: rules are surprisingly simple. >> it is a game played in pairs, you play against another player, and basically do three rounds of five throws each. >> reporter: urban ax a byob is set to officially open in mid-september. justin udo for kyw news radio for cbs-3 "eyewitness news". how about that.

those guys have done a great job. >> reporter: we have some breaking news at this moment, according to a report, u.s. olympic swimmers ryan lochte and james feigen have been indicted by authorities in rio on charges of false reporting of a crime. now lochte and three of his teammates say they were robbed at gunpoint during a night out in rio. but newly released video shows that claim, may be questionable. police say lochte and his teammates lied to cover up their own act of vandalism and confrontation with security guards. they say that this tape shows no violence against the athletes. lochte has return to the u.s. while two teammates have confirmed to police that no robbery or violence occurred that night. moving on now, let talk about some baseball, final game of the chase utley home coming. phillies/dodgers get underway in 45 minutes. utley, he was zero for five last night but the dodgers win the game anyway. phillies are trying to avoid being swept at the bank through two games, they have

warmth we have had the past couple weeks it is a nice night to be out. not too bad tonight and weekend looks okay as well but nice weather will arrive next week. temperatures right about where they should be for august as we head in the weekend. slightly above but next week we may have a few days below average which will feel fantastic. we will take you outside, look at our go pro camera at cbs broadcast center looking out over our beautiful view of the philadelphia a sky line. that view never gets old, it is gorgeous right now, sunnies shining, dew points in the 60's, not a dry evening out there but we have hat worse then this so nobody is complaining and we have got temperatures in the upper 80's right now. here's a live look, which does show a couple pop up showers and storms drift ago long pennsylvania/new york state border. mostly not making tonight our region but in the far north and western suburbs in the the lehigh valley, poconos pop up shower or storm cannot be ruled out tonight. as we widen out over eastern

half of the country in general not much going on, we have showers ape storms over portions of the deep south and next front thinks one that is system that will impact us over weekend and will approach on sunday and will eventually knock down temperatures next week. august so far though we have not had many down temperatures, temperature is 4.4 above average on the month, precipitation about an inch below average. it has been hot, dry, our high temperature is 98 degrees. low temperature is 66. might there be a night we could go lower then that? there could be. it remains to be seen. future weather shows again maybe a stray shower or storm off to the north ape west here tonight. tomorrow starts sunshine most of tomorrow is dry there could be a stray shower or storm that tries to form along the coast in the afternoon. mostly not seeing anything at all. saturday same story just scatter, spotty thunderstorms awaiting the arrival of the front as i mentioned and here it is as we widen out on sunday you can see that front approaching sunday afternoon. this is 3:00 p.m. mostly off to the west.

you can salvage most of the week toned get outside whether at the pool, down the shore or just out doing some yard work. we're talking upper 80's. sunshine each day. not too bad at all. this front will come through late sunday evening into sunday night. locally heavy thunderstorms and cooler, dryer air will sweep in behind that front and watch what happens to the humidity levels. tomorrow feels on the border of not bad and steamy. a lot like today. saturday steams up more. sunday we are right back to oppressive humidity but then that front comes through and we will cut it way down. we will clear it out on monday. it will feel awesome. we're talking about dew points in the 40's near 50 degrees next week which is a major change from where we have been. this is isolated shower to the north and west tonight, otherwise partly cloudy at 72. mostly sunny, hot, generally dry, 90 in the city. mostly sunny down the shore. can't rule out that stray thunderstorm. one or two spots again tomorrow have afternoon much like this evening. and you're witness weather seven day forecast still warm, steamy friday, saturday and
