courtroom. >> emerge is i crews jump into action after a roller coaster gets stuck. but we begin with a disturbing crime in a new jersey neighborhood. good evening everyone. i'm jessica dean. >> and i'm nicole brewer. a man is behind bars accused of beating a two-year-old boy to death. david spunt is live with the 911 call made by this child's mother. >> it is a sad story even though the 24-year-old suspect is behind bars tonight, the investigation continues. >> he's not responding. >> reporter: a frantic mother said her son was badly beaten and no longer breathing. >> is his chest rising and falling. >> no. it's not doing anything. >> reporter: police officers were called to this home

saturday night around 11:30. the toddler was rushed to the hospital where he was pro nensed dead after midnight. >> reporter: authorities are not naming the little boy or his mother but say her boyfriend, 24-year-old zachary killed the boy. he was there when the mother called 911. he even talked to a dispatcher who instructed him to give the little boy cpr. >> reporter: zachary is facing a first degree murder charge. >> when a life ends prematurely is sad, but to find out the way it did, that's bottom of the barrel. it's gut wrenching. put things in perspective for you. >> reporter: zachary will face a judge here tomorrow in camden county. reporting live at the pennsauken

police department, david spunt, cbs3 eyewitness news. >> jerry sandusky will be back in court too many for day three of a hearing where he's seeking a new trial. his attorneys are expecting to question the prosecutor who helped convict him in 2012. testimony today focused on only one issue, whether the state in 2012 knew who victim number 2 was. that's the attorney who represented victim number 5 said there was a remote possibility that sandusky could be released from prison if he awaits a new trial. >> i can say this categorically on behalf of all of those victims, some of whom i got to know and one man who i got to know and respect as my client. they would be devastated to see jerry sandusky released from

jail, somehow walking the streets again when he did these horrible deeds, had a fair trial, was convicted. >> sandusky was convicted in june 2012 of sexually abusing 10 different boys between 1994 and 2008. philadelphia police are serving for two masked suspects who burst into a hunting park home overnight and fatally shot a father of six. the man died at the scene. his 40-year-old girlfriend is now hospitalized in critical condition. six children were also in the home at the time. none of them were physically injured but police say one of the children witnessed the shooting. >> his 13-year-old son was in the room when his father got killed. i believe it was five additional children were in another room. >> reporter: police say the suspects left behind a sawed-off shotgun and some ammunition in an alley. last week we told you about

a home invasion that left an 81-year-old victim injured. this week they have surveillance of the video of a vehicle tied to the robbery. a reward of up to $20,000 is available to anyone who provides information that leads to an arrest. >> the man charged with murder in the shooting death of a burlington county man was arrested today. police say 26-year-old samuel james was taken into custody around 4:00 this afternoon after being on the run since saturday. his bail was set at $1 million. james will have his first court appearance tomorrow. a man stabbed inside a bar has died of his injuries. he was stabbed early saturday morning inside blue martini in old city. authorities say he was stabbed in the neck after an argument started between the group of people he was with and the group at another table. no arrests have been made and

the investigation continues. work crews are racing against the clock to rid a south jersey high school of asbestos. workers installing a new heating and air conditioning system discovered the asbestos, a known carcinogen. it appears to be contained to the wing of the school that includes the cafeteria and the band room. the district says the removal is going on time and it does have a plan b if all the work is not completed by september 6th when school starts. >> we've discussed split sessions, flg some students in the morning and some in the afternoon. we don't think it will come to that. >> the school system says it will not open the school until it is sure it is gone and going forward there is no health risk for staff. it will be 30 more days before delaware township comes to a decision about a proposed

pipeline. sunoco wants to build the pipeline to transport liquid fuels. the pipeline will cross the entire length of the state. pennsylvania now ranks fifth among the states with the most reported cases of the zika virus. according to the centers for disease control, 69 cases have been reported in pennsylvania, 66 have been reported in new jersey, only 10 have been reported in delaware. all of these cases are travel related. new york has the most reported cases with 579. >> cleanup continues in louisiana as thousands of residents began dragging furniture, appliances out of flood-ravaged homes. the number of damaged homes jumped to 60,000, meaning that very few places went untouched. 80% of louisiana residents don't have flood insurance, so more than 106,000 people have

registered for fema assistance. president obama is scheduled to visit the area tomorrow. hillary clinton says she will wait to visit the flood zone in louisiana. she said she will go in when the presence of a political campaign does not disrupt the response. meanwhile donald trump is accused of back-pedalling on his plans for illegal immigration. >> reporter: donald trump rallied a crowd in ak ron, ohio. >> i want every parent and child in this society, including so importantly every african-american and hispanic citizen, to be able to live in a safe, thriving and prosperous community. >> reporter: trump's appeal to hispanic voters was also apparent when he called for a firm but fair policy to address an estimated 11 million undocumented immigrants. but the gop presidential nominee

ryan lochte's false claim in rio. cbs sports is reporting that he lost about $1 million in endorsement deals today. we spoke with a local public relations expert he said companies will not want lochte associate with their brand. >> ryan lochte threw out all that good will and trust in just a few minutes and maybe even worse by lying afterwards. >> speedo says the money will be donated to children in brazil. >> an olympic swimmer return toss show off her brand new gold medal. >> eyewitness news catches up with cierra runge.

. new details surrounding the overdose death of prince. investigators say some of the pills found in the singer's minnesota estate were counterfeit and falsely labelled. but officials say at least one of those pills tested positive for fentanyl. it's still unclear how prince obtained the drugs. the final report on a deadly alligator attack at disney world has been released and it contains some disturbing new details. florida's fish and wildlife commission said little could be done to prevent what happened. the gator bit the boy in the head. according to a report the child's father reached into the animal's mouth trying to free him. it also says a man alerted staff to gators about 45 minutes prior

to the attack. disney has added measures in an effort to secure the beach. >> thrill seekers at hershey park got a scare today. 27 passengers were on the sidewinder roller coaster when it became stuck. all of the riders were safely removed after about 30 minutes. the park is still trying to determine what caused that ride to stop. the ride was closed after the incident and there is no word on when it will reopen. demolition work is under way in north philadelphia between 7th and 9th streets. the demolition work is being performed during the overnight hours and is expected to be done by the weekend. the bridge will be replaced with a new bridge by the end of the year. >> shoppers at a local akmy are noticing a big change, wine is now for sale at the store. it now has more than 80 wine varieties available for

purchase. six additional acme locations in pap will begin selling wine in the coming days. >> a local olympic gold medal winning swimmer dove back into her roots today. >> she returned to the chester county ymca where she first learned to swim as a four-year-old little girl. >> i was glued to the tv when swimming came on. >> it was at that moment when she asked for swim lessons. >> i just kept going and hitting each rung of the levels and ultimately got to the olympics was my end goal. >> reporter: 16 years later in rio, she not only reached her goal, she crushed it. winning a gold medal as part of the freestyle relay team. >> to see what she worked for

can see that arc of clouds here off the coast, showers over nova scotia. that's the front that came through us yesterday. high pressure is in control and it's going to be steering our forecast over the next several days. so with high pressure overhead with a clear sky, light wind, temperatures love to drop quickly and that's what we're seeing tonight, we're already down to 51. 51 in point pock know. it's going to be chilly up there. 71 in philadelphia, it's 63 degrees in reading. nice and cool and pleasant and we're on our way to the 50s. 61 here in philadelphia, which is going to be the coolest night in quite some time. keep in mind last week and the week before we had overnight lows in the upper 70s. now we're talking about 61. big change. 59 is what you'll wake up to in

wilmington. pleasantly warm afternoon after that cool, crisp start to the day. the high moves east and that gets us to more of a southwest flow wednesday and we'll add a couple of degrees to the thermometer there. winds come out of the south and west again and you'll start to feel that uptick in humidity. the front actually crosses the area friday and that coincides with our best chance for a few scattered storms. the rest of the week is dry but you have to water those plants mother nature is not going to help you out. tomorrow feels awesome, very, very low humidity, almost fall-like. wednesday still pleasant. it does climb quickly friday, it steams up but we'll cut it back down for the upcoming weekend. even though the weather here is quiet, the tropics are heating up. we've got three areas of activity to watch. fiona going to get absorbed by the front here and should not make its way any closer.

it's called invest 99. this is one that parts of the united states need to keep an eye on. some of the models want to take it toward florida, toward the bahamas late this week and into the early part of next week so we've got to watch that one and we now have tropical wave number 7. this one likely to become gaston but it looks like it will re-curve out to sea. i'll let you know if anything looks imminent for our area, right now it's active but nothing for us. tomorrow looks great, low humidity, sunny at 82 degrees. wednesday sunny and beautiful starting the morning in the low 60s again. thursday at 87, friday is your one chance for a thunderstorm but then we knock it back nor the weekend. the weekend looks great. this is going to be a good one. we do have the chance for a couple of showers early next week. but all in all that 7-day forecast. >> you can't do better than
