courtroom, audible gasps as they declared anthony wright, not guilty. wright's family as they left the courtroom, could not contain their grief. >> thank you. >> reporter: hugs, cheers, tears, for their son, father and brother, anthony wright. >> it has been a long time. it has been a long time. >> reporter: wright spent past 25 years behind bars, for the 1991 rape and murder of 77 year-old louise tally, on this block in nicetown. a signed confession and witness testimony convicted him in 1993. he claimed that the confession was coerced and in 203, dna evidence link another man to the crime and wright's conviction was overturn. but the d.a.'s office retried the case. >> they seem to want to disregard the scientific evidence. >> reporter: his attorneys for the for years and after two week trial, the jury found wright not guilty on all

>> chere greg, live, thanks very much. a pennsauken man is arraigned on first degree murder charge in the death of his girlfriend's two-year old son. twenty-four year-old zachary tricoche appeared in court in camden earlier today. he is charged with beating jameil baskerville, junior to death. officers were called to the 5900 block of mansion boulevard late saturday, baskerville later died at cooperville university hospital. we will have a full report on "eyewitness news" at 6:00 o'clock. reputed philadelphia mob boss joey merlino pleaded not guilty to racketeering charges in new york federal court today. the 54 year-old is accused of taking part in the health care fraud scheme. merlino was one of the four dozen a alleged members of the east coast crime syndicate who were arrested and charged earlier this month. local leaders and law enforcement from all across the country were in new york today to say good bye to former philadelphia police commissioner john timmeney. the 68 year-old timmeney passed away last week after

battling lung cancer. a funeral mass was held at st. patrick's cathedral in manhattan. timmeney was laid to rest in west chester county in new york. in addition to philadelphia, john timmeney served as first deputy commissioner with the nypd and as miami's chief of police. the in the presidential race the campaign trail is running through our area again today, wright now donald trump's running mate is rallies supporters in bucks county. the 16 year-old boy arrived at the hospital two weeks ago complaining of a headache. doctors who are trained to look for that sort of ameba went into action and lowered the boy's body temperature reduced a coma and gave him a drug not readily available the at most hospitals. doctors had no idea, when he would wake up or what kind of outcome they would achieve. >> decided to get some help and... >> since then he has done tremendously well. we are very optimistic. he is walking. he is speaking. >> incredible. ameba that affect that teen has a 97 percent fatality rate making him one of only a few survivors of that type of infection. well, uber is getting self drivers vehicles on the fast

it is just not fair. >> a family's heart break after their sonnies murdered in spring garden over the weekend, just steps, from his mother's home. he was shot in broad daylight saturday and his killer remain at large tonight. "eyewitness news" continues at 5:30, good evening, i'm jessica dean. i'm ukee washington. twenty-five year-old leonard boyar the third worked in the commissioner's office. "eyewitness news" reporter rahel solomon at police headquarters with more from his heart broken family and steps investigators are taking to find one suspects, rahel, good evening. >> reporter: good evening, ukee. police sources tell me for some reason they believe that this victim was in fact the target but this afternoon both

his family and detectives say that they don't know why. for the family of 25 year-old leonard boyar, the third, saturday was supposed to be like any other weekend. it wasn't anyone's birthday, no specific reason to gather other than just to be around one another. >> just a normal saturday coming down, bringing the baby, laugh, joke do what we do. we had no plans. unaudible. >> reporter: at 5:00 that afternoon the family heard shots. police say as boyar was walking to his mother as door on the 600 block of north 12th street, two men fired 13 times hitting boyar twice in the head and once in the back. by 8:30 that evening he had died at hahnemann. >> no one has the right to take him from frustrates or from his daughter. what do we tell his daughter when she's asking for her dad? what do we tell her. >> reporter: boyar work in the cities commissioner office training election board officials and out in the

now. it will continue at a later date with attorneys for former penn state assistant football coach saying they want to call more witnesses. "eyewitness news" reporter greg argos is in center county with the latest from court. >> reporter: this three day appeals hearing just wrapped up here in center county but this case is far from over. jerry sandusky's defense team says that they hope to call even more witnesses to the stand, at a later date. >> any comment. >> unaudible. >> reporter: whole story will be told. >> maybe some day, who necessary. >> reporter: at least part of the jerry sandusky's story told over the course of the three case, in a hearing that could eventually lead to a new trial or even release of the convicted child sex offender. >> we still are working on it. we are putting things together. certain legal arguments to make. >> reporter: this multi day hearing which focused on alleged problems during the initial 2012 trial will continue at a later undetermined date. sandusky's attorney al lindsey says he hopes to call two additional witnesses including one of the sandusky's victims

to the stand. at issue here did the seven two-year old receive a fair trial? >> we believe that the case against mr. sandusky originally was very flawed. >> reporter: tuesday lindsey focused on alleged grand jury leaks calling both prosecutors from the original trial frank fina and joseph mcgettigan to testify. both said they were concerned how a local reporter received what should have been sealed testimony. fina says attorney general's office, even opened up an internal investigation in the matter. >> we took these things very seriously. we would conduct, we would take various measures to try to keep the process as appropriate, secret. >> if we can establish there were leaks made by government agents it could result in the dismissal of the case. >> reporter: the appeals process will continue as both sides have stashingly different opinions on the potential outcome. >> it is all complex and hard for the cases go through, this one will in my opinion has no

merit and will be unsuccessful >> it is going better then we plan and we think we will be successful ultimately. >> reporter: there is no set date for the next step in the appeals process. in the meantime jerry sandusky himself headed back to prison. reporting here from center county i'm greg argos for cbs-3 "eyewitness news". roadside bomb killed an american solder assisting nato forces in afghanistan today. a second american service member and six afghan soldiers were also injured. it happened in afghanistan's helmond province just one day after 100 u.s. troops were deployed there to help push back the taliban. officials say that the militant effectively controlled 80 percent of that area, none of the american soldiers have been identified. police pursuit in north caroline and heed with a 29 year-old hearing impaired man being shot and killed by a trooper. north carolina officials say police tried to stop the vehicle for speed ago long an interstate. pursuit ended about 5 miles

new information tonight in the murder of a toddler, prosecutors in south jersey say that this man killed a two-year old after getting into a tight with the boy's mother over groceries. the suspect is now behind bars after a court appearance. good evening i'm ukee washington. i'm jessica dean. we are hearing tonight from the family of that toddler, they are just beginning to deal with this loss.
