ones still manage g to enjoy some time off here in the days ahead, going to have some nice looking beach weather, but that surf is still awfully rough. take it very carefully and stay on dry land. notice, it is still very dry on the land areas here, in the delaware valley, pretty much clear sky out there, we've got high pressure on our side at least initially to bring us nice comfort. dew point levels very low. so for all of those of you laying out the school outfit, getting your hair ready to go, look like good hair day, breeze granted but with nice low humidity to go along with it. taking a look at the area temperatures, temperatures anywhere from the low to 60s to the low 70s many locations, but comfortably cool outside. seventy-three in the city though. that's just feels good. sunny shall breezy by 9:00 a.m. it does stay sunny for the rest of the day, as well, expect to top off around 87 degrees, that's above average by handful of degrees for the day of the year. and actually we will heat up more than there is i'll tell you just how high we get later

new schedules that will be affected today. >> bill cosby heads back to court this morning where he could get a trial date for this sex assault case. the 79 year old is accused of drugging and assaulting a wambach in 2004. "eyewitness news" reporter justin finch live outside the montgomery county courthouse with the latest, good morning, justin. >> reporter: jim, brooke, good morning, what will be admissible at bill cosby's pending trial, here at the montgomery county courthouse, by day's end bill cosby and legal team could walk out with trial date as well as a strategy. now, cosby's team want to potentially damaging evidence thrown out. one, civil deposition, with cosby talking about his accuser, andrea constand, giving her pills and alcohol before what he calls a concentual sexual encounter at his chelten area home back in 2004. there is also that 2005 taped phonecall between cosby and and constand's mother in which also recount the same events.

now, in 2004, constand, then temple university staffer, says cosby whom she thought of as a mentor, drugged and assaulted her, the now constand, cosby, settled her 2006 civil suit for undisclosed amount, current montgo d.a. says a so-called deal between cosby's lawyer and da bruce castor no not prosecute cosby in criminal court for that deposition is no longer binding. >> it was intoxicate to go her that show was unable to consent. those are the charges. >> after this so-called incident the complainant continued, the complaint and the accepted a dinner invitation from mr. cosby, returned to mr. cosby's home, and ultimately, after returning to canada, the complaintand the asked for tickets to a concert that he was performing at, went to the concert, and presented him with a gift. >> but insiders say that

several other accusers have come forward with stories like constand can potentially strengthen the case here. missing from court today will be lawyer monique presley made several media appearances on cosby's behalf. it is already replaced the la based law firm that has been handling defamation suits against him. live outside the montgomery county courthouse, justin finch, cbs-3, "eyewitness news", brooke, jim, back into you. >> thank you, justin. police are investigating a fatal shooting in the mt. airy section of philadelphia. police tell us a 29 year old man was shot in the back of the head inside home on the 8300 block every williams avenue. officials say family and neighbors heard an argument last night in the basement before shots rang out. the victim was rush to the hospital where he later died. new this morning, philadelphia police are checking surveillance video as they try to solve a soothing in lawncrest. just before 1:00 this morning, police say, someone shot a man on the 500 block of rosa lee street. investigators believe an argument led to this shooting,

as well, and several men fled after the gunfire. the man is in stable condition with a gunshot wounds to the head. , the leg, excuse me. >> internal affairs investigating shooting at home of off duty police office nerve northeast philadelphia this happened just after 6:30 last night, the 2700 block every taunton street. police say the office duty officer fired his personal weapon during altercation with a family member. that will person is in stable condition this morning. in other news, police officer and a driver are recovering after this crash, chopper three, over the scene, at the intersection of woodhaven and thorton roads in northeast philadelphia. this happened a little bit before 7:00 last night. police say a k9 unit and a white car collided, and the officer and the other driver were taken to the hospital, but are expected to be fine. the police dog was also checked out, in a nearby vet's office. >> well the search continues for oregon man, police say, went missing during the made in america concert over the weekend. philadelphia police say nelson armstrong was separated from

his friends sunday at around 11:30 in the evening. armstrong is described as five-ten, 165 pounds, with brownish curly hair. anyone with information is asked to call police. hermine continues to churn offer the atlantic coast, but really put a dent in a lot of labor day plans down the jersey shore. in brigantine dangerous rip currents kept swimmers out of the ocean, but the weather was nice enough yesterday to keep people on the board, those who stayed say they were grateful hermine didn't cause any major problems. >> seems like a lot of the people didn't come down due to the weather. we've been staying with the whole beach to ourselves. >> we decided to just go and see what was going to happen. i'm glad we did. >> despite the traffic on the board, business owners say sales from this labor day weekends were cut in half on the normal holiday weekend. >> and while hermine did pacca major punch for much of our area, some south jersey beaches are feeling the storm's effect. chopper three was right here over north wildwood. errosion left behind cliffs on the beach that were several fight high in some spots.

lifetime ban from all oregon state parks. >> an unusual discovery at home day care in connecticut. west haven police called out more than 600 marijuana plants growing behind the property. the estimated street value more than $1 million. a few days earlier, state inspectors say they were asked to see what was behind a wooden fence on the property, and were allegedly told they couldn't. that's when they called police, and the discovery certainly surprised the neighbors. >> we did see a big fence being made. but then again, it was kind of odd. but i mean people do weird things so it really doesn't raise any suspicions at all. >> west haven mr. is are continuing their investigation, the state has suspended the day care owner's license. >> i think that's a good idea. >> turning now to the weather, katie, hermine is still off shore? >> yes still out there for yet another day, we have to deal with the coastal impact. thankfully, the coastal impact are starting to lessen little bit. no flood advisories, watches

or warnings, all since expired, although there is still off shore waters a tropical storm warning remains in effect even though at this point hermine is post tropical cyclone, can't go by the categorization, just focus on the impact. outside, show you what's happening on storm scan, nice wide zoom, yes, still pretty obvious. you have got this circulation going on, miles off shore, thankfully, at least for our area coastline, but it is clipping portions of massachusetts, connecticut, even extreme most long island there. again there is will sit and meander for another day or two before it finally gets pushed away. meantime high pressure basically the story east of the mississippi. ends up with high pressure, pretty nice conditions, but, as high pressure builds, we will start to see more after return flow around it, and we ends one more of southerly wind flow, more humidity as a result, higher temperatures. there is a frontal boundery scheduled across through. it is technically a cold front, but does absolutely nothing to actually cool us down. see that in the seven day.

regardless we take you out to the wind speeds. just showed you picture video of the fire taking place in rhode island. winds speeds are still in the recall out there. sustained winds up to 60 miles per hour in atlantic city, generally, a northerly-north to northwest wind flow, but around that circulation, you are getting more that far water getting shove or shore out toward nantucket, winds speeds upward of 20 piles per hour with higher gusts, of course. so the beach hazards continue for us, dangerous rip currents every area shore point and delaware beach, please, do keep that in mind. meanwhile, many of you don't have the luxury of going to the shore anyway. back to work, back to school, and outside a pretty dark campus at pleasantville valley high school at broad heads ville. nice clear sky across the area. few clouds closer to the coast. sun will shine, up to 87 degrees, despite northwest wind flow, still heating up there above average with the high by the way, drop down to just 70 tonight.
