months go by before they can begin the process of justice. now there is a movement to finally change that. good evening everyone i'm's ukee washington. i'm jessica dean. new government report released to day shows pennsylvania is backlogged with untested rape kits, and more funding is needed to fix that problem. >> "eyewitness news" reporter joe holden is live outside police headquarters with what officials are proposing, joe. >> reporter: ukee and jessica, good evening. consider this police departments and labs, numbers show they are working as efficiently as possible, with what they are handed. now the state mandated just a year ago that all of that backlog of rape kits that they all be tested, how much money did they give these police departments and labs? zero. review of police departments across pennsylvania shows there are more than 3,000 untested rape kits. some have been collecting dust since the 90's. experts say it is untapped

evidence that could lead to arrests in some of the most disturbing violent cases in the the system. because of its size it is not advising philadelphia has the most by far. >> that kit contains valuable information that could not only bring the rapist to justice in that instant but can prevent future rapes as well. >> reporter: auditor general eugene depasquale ordered review after new legislation hit the books in pennsylvania. the lawmakers intent to clear hundreds of backlogged cases that have gone unsolved. in philadelphia, 1200 rape kits that are more than a year-old haven't been tested. but the new law fails in areas of funding. report shows that the state, doesn't allocate any money for department to test rape kits. >> among our recommendations the stake holders convene immediately to discuss what resources they need, particularly from the state, to be able to effectively communicate, how local law enforcement agencies are able

to handle rape kits and to pay for all of these kits to be tested. >> reporter: volume of cases is never ending at philadelphia's office of forensic sciences. director here told state auditors philadelphia police need more money for staff, but without more space, there is no where to place extra help. now an expert was slight liz more critical of pennsylvania lawmakers concerning that funding in the report, she was quoted assaying if testing rape kits is important to pennsylvania, they legislators, need to step up to the plate and pay for it. in fact, philadelphia did in fact go out and obtain a grant on its own and that will help them clear half of the kits that they have sitting on warehouse shelves. reporting from outside police headquarters, i'm joe holden cbs-3 "eyewitness news". carter was caught the in the cross fire of a gunfight, on the nine turn block of eighth street august 24th. today we have learn that the

but they will not be on the stage together. clinton took a break from the campaign trail today in preparation for that event, former president bill clinton and daughter chelsea stepped in for her making appearancing in florida and pennsylvania. scott pelley will have latest for you from the campaign trail on "cbs evening news" right after "eyewitness news" at 6:00. convicted former pennsylvania attorney general kathleen kane needs money. kane is asking a judge to order her estranged husband to pay her a million-dollar out of about 6 million that she says that she should receive in their divorce. kane says in court documents she's unemployed and needs to pay her attorneys. kane is awaiting sentencing october 24th and preparing to appeal her conviction. she resigned as attorney general in august. curtis thomas says more gun control measures are necessary in light of recent violence, including two, six years olds caught in the cross fire in philadelphia. >> we need to convene general assembly to act immediately

thousands will gather in philadelphia for annual walk to break the silence. >> health reporter stephanie stahl talks to a bucks county mom taking part. she has a very special story. >> she does, you guys. ovarian cancer usually strikes older woman but it can happen anytime this weekend the national ovarian cancer coalition, is having its annual walk, run, hear and in many other cities. aim to take 150 million steps across the country, in celebration and support, of people fighting ovarian cancer. >> that is great. perfect. >> reporter: forty-one year-old rachel frazier is making ribbons to raise awareness about ovarian cancer. cancer that she has had twice now that nearly took away her ability to have children. >> i always wanted to be a mom and, you know, i got the my life every day and reminder that, miracles to happen. >> reporter: first digged at 26, rachel endorsed and removal of one memory. and against all odd, she got

pregnant. and we first met her nine years ago. lily came two years later. >> that is just, the meaning of life right there. that is, a miracle, and, it is, everything that i could ever hope for. it was a tough battle, but i beat it, and i didn't think it would ever come back. >> reporter: but it did, two years ago, rachel had a second battle with ovarian cancer, followed by more surgery and chemo. >> it was an awful experience. i never had any symptoms at all, nothing. nothing. >> reporter: that is why it is called silent killer, symptoms of ovarian cancer can be vague, both times, rachel's cancer was found in routine gynecological appointments. now she's on a mission with tiehl ribbons and upcoming run/walk to break the silence coming up on september 10th.

we are protected as they get suck in the larger circulation off shore being pulled to the south and north wind keeping kind of keeping us protected tonight. you can see this front extending up through great lakes, sinking toward the area tomorrow bringing a greater chance for scattered showers and storms. helping pump in the heat. a that is front sinks to the south we will get that southeasterly flow. that brings the heat and humidity. we will be feeling that tomorrow, and then gannon friday, we will be firmly in the red here, right here through saturday, and then notice the front does make in roads here on sunday. jet stream buckles. we will get cooler, dryer air in place sunday into monday. and then it looks like it will heat up by middle of the next week. no sustain cool temperatures, on the way, but it will turn a little bit nicer early next week. still 89 right now in philadelphia. it is 90 in wilmington. warm, steamy afternoon. tomorrow afternoon even worse. heat advisory has been issued for our area there noon until 6:00 p.m. it may feel as hot as 102 at times, we will be close to
