justin. >> reporter: jim and brooke, good morning, the soda taxis to raise millions for youth education and city programs. now this taxis set for january roll out but this case could change. that let's go to video about this lawsuit filed by the american beverage association, and other third parties. among their complaints that this so-called soda taxis essentially a double tax repeating a state sales tax already a fink to soda and sweet drinks. this suit argues this new city tax should require state permission but lawyers behind the suit says the sit difficult not to that. back in june city council passed a version of the mayor kenney's campaign promised sweet and beverage tax by january it will charge a 1.5 sent per ounce tax on sugary drinks sold in philadelphia. a tax on $1.44 tax on a 12-ounce can of soda.
