breaking news overnight protests turning violent in charlotte, north carolina after an officer involved shooting. had led up to the the shooting and the way police responded. a fight, breaks out, in school, involving a student, and a teacher. and it is all caught on camera. only one of the people is in trouble, so far, we will tell you who. >> unaudible. >> a community meeting gets heated over fate of a church, planned developers have for the building and reason neighbors are not on board. good morning, it is wednesday, september 21st i'm jim donovan. i'm brook thomas. all that plus surprising update to the hit/run we told but yesterday but first, a check of the forecast with justin in for katie, and your

calling for calm after the fatal police shooting after a black man spark violent protests overnight. rel testifies of the keith scott said he was shot reading a book inside his koran tuesday but police maintained that he had a gun. demonstrators need down with their hand up along this charlotte roadway overnight steps from officers in riot gear. that moment of peace, was brief. police fired tear gas disperse the crowd while some protesters kicked those can stars back. others took turning hurling water bottles roxanne damaging squad cars. twelve officers were injured during last night's protest, one was hit in the face with the rock. we are told seven officers have pneumonia taken to the hospital this morning. authorities say that they are interviewing witnesses as part of their investigation. >> protest came after hours after that fatal officer involve shooting. what led up to the shooting, do we know. >> reporter: chaos erupted hours after keith scott was shot and killed by police at

an apartment complex yesterday afternoon. officers were there looking for a suspect with an outstanding warrant when they encountered the four three-year old getting out of his car. he was not the man they were looking for. officer involved has been identified as brently vincent, an african-american on the force, since 2014, authorities say that he has been placed on administrative leave. back to you. thanks, hena, we appreciate the report. in other news a 16 year-old student is facing charge these morning after trading punches with his teacher. the whole thing was captured on cell phone video inside lincoln high school in northeast philadelphia authorities say that the 16 year-old who is throwing the first punch but video shows both student and teacher taking part. police charged the teen with aggravated assault. teacher has this is been charged. school superintendent doctor william hite told cbs-3 that the incident is under investigation. a philadelphia police officer is off the job after investigators say he tried to

mail trucks. officers william brandish junior is accused of trying to send a package with marijuana inside. he used someone else account at a local company to do that. the package was returned as undeliverable and another company at the another employee at the company received it. brandish is a 14 year veteran of the department and has been suspended for 30 days with the intent to difficulties his. two philadelphia police officers are suing lesean mccoy and owners of the the club, because they say that they were hurt in the bar fight with the former eagle there. according to the civil suit lesean mccoy and his two friend punched and kick officers roland butler and darnell jesse. this is video video inside recess lounge in olde city. authorities say that the fight, started over a bottle of champagne and ended with the officers in the hospital. >> our investigation confirmed that our clients were attacked, beaten, and sustained serious permanent

bodily injury as a result of the assault and our investigation has confirmed that the individuals who attacked our clients are lesean mccoy and the additional defendants. >> neither lawyer for lesean mccoy or recess lounge commented the lawsuit. we have an update to what police called a hit and run yesterday morning. police say person who was hit was actually a robbery suspect. it happened, at bustleton and bleigh avenues in rhawnhurst and they say an officer tells us that the driver told them that the man walk up, and robbed him at gunpoint while at the bank atm. the driver later hit the robber with his car. investigators say bank surveillance cameras confirmed story and driver is not facing charges. >> interesting turn off events. relieve the at the pump could be on the way for drivers in our area after a pipeline leak caused a price spike. crews have been trying to fix damaged colonial pipeline which supplies gas from texas, to the east coast, and a bypassed pipeline is almost

finished and gas is expected to start flowing at a normal rate today. triple a says leak has caused gas price toes rise in south jersey, for example gas prices are seven cents higher then a month ago. right now gallon of regular is averaging 2.34 in pennsylvania, 1.19 in new jersey and 2.19 in delaware. emotions running high as fishtown neighbors argue about the fate of the shuttered church. >> unaudible. >> nearly 300 people filled the basement of the holy name church to discuss future of saint laurentius church. developer want to preserve it and convert tonight to 23, one bedroom apartments. but people argued the plan would put a strain on parking and the sewer system. the supporters say apartments are the only viable option to save the 135 year-old church. >> i just don't see how it could be better to have apartment there we need

new jersey is facing new federal terrorism charges. fbi agents also recovered and released portions of ahmad kahn rahami's journal. they say that he wrote quote that the sounds of the bombs will be heard in the streets. death to your oppression. rahami is charged were four count including use of a weapon of mass destruction. the suspect's father says he warn the fbi about his son in 2014. >> i told the tbi years ago. >> and what did you tell him. >> unaudible. >> rahami's wife is said to be overseas and said to be cooperating with authorities. rahami is being held on more than five million-dollar bail. this morning, there is a new controversy surrounding donald trump over the trump foundation. the washington post reports that donald j trump foundation used more than $250,000 to

settle lawsuits against its business interests. it is known as self dealing, and could be illegal. his campaign manager is town playing those concerns, saying she's not worried about the report. trump will be campaigning, in chester, delaware county tomorrow. on the democratic site, clinton is taking a break from campaigning to get ready for her debate against trump next monday. that is unnerving to some of her donors as polls show support for her and trump is tightening. her campaign manager says in a new memo clinton is likely to have an easier time getting the 270 electoral votes she needs to win then donald trump. time right now is 4:43, justin, fall is coming, but thankfully, summer is not ready to let me go. >> bye-bye. >> i'm depressed. this is a sad day but you are right, we have a few more days here with temperatures, in the 80's and overall, still the next week or so we will be

dealing with warmer days but there are some signs of true, fall weather, finally making a return to the forecast and people have been waiting for it. today different story. still warm, muggy south of the city, we have temperatures in the 70's, millville, atlantic city, 72, dover, same deal. north and west we are cooler, dryer up here, as dew point temperatures are dropping, so dry air pushing from the north so humidity will get better and drop throughout the day but still muggy in philadelphia dew point temperatures running high yesterday morning. sixty-eight. it does feel steamy. you should tropical in the 60's and 50's over next few days. still stubborn low pressure system over carolinas, rain having a hard time moving north. everybody stays dry even south jersey but lingering cloud cover, central, southern delaware, extreme southern new jersey, we should see increasing sunshine from philadelphia north and west as high pressure moves back in. that will protect us from big storms from developing. we are moving back in the try pattern. there that is remnant low pressure system just spinning

off the coast of the carolina for next couple days and will take a while. it will be a cold front that moves it out to the weekend. we're staying try, in the upcoming weekend. today it is warm, temperatures surging well in the mid 80's even up in the lehigh valley, still cooler south jersey because of the clouds. then tonight noticeably cooler we are seeing widespread 50's returning to the forecast for lows. tomorrow another warm day back in the mid 80's. the increasing sunshine, net isably less humid this afternoon at 86 for the high tonight, 65 for city, cooler in the suburbs. is there that warm stretch through friday we are changing up saturday, highs on sunday, chilling, only 70. that is below average. then lower in the 40's in the suburbs early next week. >> wow, 40's. >> yes. impressive, and depressing for so many people. >> happy wednesday to you. so we're talking about this construction yesterday morning. it got really busy. we were seeing significant slow downs yesterday. ninety-five north between ridley park and 420.

humidity dropping. it could turnout to be a nice day further north and west you are from the city we will get more sun just like yesterday but it will be a warm day. we have temperatures still feeling like summer going well above average in the 80's once again. we are dry, still left over clouds, mid to high level clouds from the city northward. clouds thicken up further south. don't expect to see a whole lot of sun heading to the new jersey shore or southern delaware today. fog, it could be an issue throughout the next few hours we are seeing fog across burlington county right now, other than that most reporting stations are reporting good visibility. temperatures still mild, lower 60's in the the lehigh valley to 70 around philadelphia and areas to the south and east. still muggy but that humidity starts to drop hour by hour. skies are mostly sunny, upper, 86 degrees for the high. then tonight a few clouds, hield 65 in the city. cooler in the suburbs. we will keep it warm through friday and then we will bring backupper 70's saturday and gets chilly, saturday, monday
