father was arraigned today, alex? >> reporter: well, this is just a terrible story all around, and while the district attorney says that this death was indeed unintentional he stop short of calling it an accident because he says weapon was left within reach, of the little will boy who loved guns. alongside mourn full family nicholas wyllie entered a bucks county courtroom this a tearful state, beginning of the case with no winning side, according to district attorney matthew weintraub. >> in this instance the defendant, wyllie did not intentionally kill little two career old benjamin, we believe and we will prove that he is nevertheless criminally responsible for his two-year old sop's death. >> reporter: september 12th state troop's arrived to the milford township home that wyllie haired with his grandparents and two-year old son benjamin. wyllie told police that while watching tr he heard a loud bang from his bedroom and found his son with a gunshot

wound. wyllie told police that he had recently purchased a smith and wesson 45 caliber hand gun this little benjamin he grabbed it and ultimately caused to kill himself. >> reporter: according to court documents family members and boys mother who does not live at the location had warned wyllie about leaving weapons out, adding that the two-year old loved guns and had practiced using them with toy versions. a family member told police that a lot of those toy guns looked real. >> is there anything you want to say. >> reporter: wyllie has been charged with with involuntary manslaughter, reckless endangerment and endangering the welfare of the child. >> the defendant will be serving a life sentence, regardless of what happens to him criminally, and that is the terrible tragedy here. >> reporter: wyllie has been told to turn over any remaining weapons he may have, he has been released on $50,000 uncured bail. reporting live from bucks countial sand that hoff for cbs-3 "eyewitness news" good will alex, thank you.

new jersey authorities continue continue on investigate the driver who hit and killed a pedestrian, before slamming into the side of the rick tim's home. deadly crash happened around 8:00 last night on hamilton township. family members tell "eyewitness news" that five three-year old daniel quinnlen had gone outside and put out the trash. forty year-old driver was taken to the hospital, with minor injuries, we will hear more from the victim's family and police on the investigation coming up on "eyewitness news" at 6:00. forty days now until election day, and we're seeing just how important pennsylvania really is in the presidential race. another high profile surrogate is in philadelphia, stumping for democratic nominee hillary clinton. generate economic development in the city. kate bilo is joining us now. kate, you were talking earlier, i feel like we had four days of heat inner one day. by the time we got in it was rainy, sunny, rainy, sunny again. >> and transitioning from nice weather to not so nice weather and today was that transition period where sun was saying i want to stick around and everyone saying sorry. >> struggle is real. >> it is. we started off with good amount of sunshine we had breaks of blue skies. it was pouring coming into work but off in the distance the city sky line was blue. it depended where were you today. today as we head through evening clouds thickening across the region and get used to them because we will not see much of the sun through the end of the week, and even in the weekend. we will take you out to bethlehem our camera mounted atop hotel bethlehem looking live along main street where it is glummy, about an hour ago road were pretty wet there. now it looks like they have dried out. this is what we will be seeing through next couple of days. we are talking about spurts of

rain on and off. not a total wash out for two straight days but we will see spurts of steady rain at any time so just be prepared for it. look at how glummy looking live from the palmyra cove nature park across river to the sky line where you can barely discern outline of the buildings there you can see here in the distance it is pretty glummy, foggy, low clouds in place this afternoon and cool thanks to the clouds, but only 64 degrees right there. right now 67 at the airport. seventy in wilmington. sixty-eight in millville. sixty-eight in allentown. mount pocono, only in the the 50's, this evening. so storm scan three is showing rain lifting in from south to north. it looks as though i-95 corridor around baltimore and d.c. will be the hardest hit from this system. it will stay off to our south and west but these kind of storms are notoriously tricky where heaviest rain will occur. we're not out of the woods as far as heavy rain. it is very close. if those heavier downpours shift we could be looking at threat for some poor drainage flooding or ponding on the roads with any of these rain

showers that come through tonight and into tomorrow. and as part of the system i have been telling but days upon days you can see the swirl here from that cut off low just sitting and spinning pulling in tropical moisture from the south, conveyor wealth of moisture and that is producing rain over our area and down to our south as well. timing this out on future weather this will take news to saturday, watch how much rain we're talking. heaviest stuff off to the south and west and just keeps coming and coming through tonight and tomorrow especially baltimore and d.c. but we will get on the privilege liz with scattered showers at anytime through the day thursday, 11:00 o'clock thursday still raining, especially to the south and west, friday morning may be some of our steady yes, sir rain here in philadelphia at 10:00 o'clock friday morning. friday afternoon still raining, finally by the weekend we will start to see things taper down, this is saturday still cloudy, still some scattered showers but we are not seeing that heavy rain especially to the south and west like what we will be seeing thursday and friday. take a look at these rain amounts though over d.c. and baltimore some indication that

>> reporter: video taken moments shows a distraught woman whose identified as man's sister. >> unaudible. >> reporter: she says she called police for help and told them her brother was mentally ill and unarmed. officers confirmed they received that information, and when they arrived at the scene, they say that the man was acting erratically and refusing commands. >> still non-compliant and won't get his hand out of the pocket, walking all over the lot. >> reporter: this video shows the moment, before the the shooting. >> at one point the male rapidly drew an object from his front pants pocket, placed both hand together on it and extended it rapidly towards the officer, taking what appears to be a shooting stance. >> reporter: one officers discharged a tasers while simultaneously another opened fire. police have not said what the object the man pulled out was but they now know it was not a gun. >> they didn't say anything. he didn't hear no rights. he was a black man. he oughtcally had no rights.

washington. i'm jessica dean. our joe holden was only reported that confronted vince fenerty about the allegations yesterday and he joins us now with new developments from center city philadelphia. joe. but jessica parking authority behind me is where vince fenerty worked for last 30 years, and just within the last hour we were told he handed in his letter of resignation, essentially, taking a fire from the board. they were expected to terminate him, in the morning. in the meantime, there is a call for inquiry, a probe into how the parking authority does business. twenty-four hours after the philadelphia parking authority was further rock by scandal, city council members are demanding a thorough review of the agency's operations. >> my concern is that it appears to be a very poorly run, poorly managed organization. >> reporter: councilman david oh says city controller and attorney general should initiate audits, late wednesday an attorney general spokesmen told me that they are looking into that.
