officials say workers were paid thousands for overtime, they never work. "eyewitness news" reporter joe holden is live from center city with more on this, joe. >> good evening. controller's office launched this investigation months ago after overtime payments in the city's department soared and performance in that same office, dipped, in the end, it was the taxpayers that took the hit. >> it was this video investigators say blew lid off why tens of thousands of pieces of philadelphia city mall weren't processed. it has been described mail room mayhem. >> time sheets were a complete farce when we compared them to video surveillance. >> reporter: in other word ten workers in the mail center were often not at work, alleged in this report by city controller that the supervisor and other employees, build for $10,000 in fraudulent overtime and other times they were excessively late. investigators rigged a surveillance system and recorded video for eight weeks starting in december 2015. every move we're told was

documented. >> they were milking the system for cash they had in right too. >> reporter: it is your cash, taxpayers fund this operation that is talked away in the hall room near suburban station. we went looking for answers. do you have any comment about the. >> reporter: report we were told supervisor was not around but our message would be passed around. biggest hit in all this was to those waiting for mail from the city, it was found not enough people were working, their full shift, to process it. >> people were getting penalties for late notices, traffic court hearings and other court hearings, they were not even informed, they weren't getting their refund, they weren't getting their bills. >> reporter: we are told both supervisor and mail worker resigned when investigators began poking around. city is working to recover that lost money. city officials had to say the kenney administration has been credited by controller's office for improving controls in the mail center, and that includes installing a permanent surveillance system and appointing a new manager.

more details, alex. >> reporter: ukee, philadelphia transitioned from a primarily red voter base to blue in the 1960's and currently democrats out number republicans by over 600,000 registered voters. >> we have to make sure this election is not stolen from frustrates and it is not taken away from frustrates. >> reporter: as he has done before republican presidential candidate donald trump voiced his concern over election fraud pointing out philadelphia county in particular. >> we have to make sure that the people of philadelphia are protected, that the vote counts are 100 percent. >> it creates this sense that there is, that this is rigged, and it is not rigged. >> reporter: david thornberg is chairman for committee of 70 a watch dog group for philadelphia and pennsylvania elections. they are independent, and non-partisan. >> the election process is high liz imperfect, it is a human process, it doesn't always work very well but there is no demonstrated record of fraud at a scale that he is suggesting.

democratic nominee hillary clinton is basking in the grow of new polls showing her with the double digit lead overdone old trump. former vice-president al gore campaigned with clinton in miami, florida. gore discussed climate change and told young democrats to get out and vote for clinton. meanwhile wikileaks released more e-mails from clinton campaign chairman. they revealed clinton's campaign believed the controversy over clinton's use of the of the private e-mail server while secretary of state would blow over after one week even. the trump controversy is a big issue in the race for u.s. senate in pennsylvania, democratic candidate katie mcginty condemned trump during an event in philadelphia today. she called on her opponent incumbent republican senate patrick toomey to disa vow trump. >> senator toomey says well, send me to washington and i will stand up to donald trump. how about standing up to donald trump right here in pennsylvania, right here today.

>> that is right, this is a big proposal for them. health department says tobacco use kills more philadelphians then get this, homicide, aids, car accidents, diabetes, and illegal drugs, combined. smoking is worse then all of those. as a problem, it is especially bad in certain neighborhood. one retoured with the health commissioner who is proposing the new rule. >> this is a number one killer in philadelphia today. >> philadelphia health commissioner in kensington one of the many neighborhoods hurt by high rocking rate. >> philadelphia a has the high smoking rate of think big city in the country. we have about twice as many stores that sell tobacco products as other big cities and those stores concentrated in low income neighborhood like this. >> in a philadelphia health tenth wants to limit stores to selling tobacco products in poor neighborhoods, and, just 500 feet. >> and, right at eye level for a child, right here, within a couple hundred feet of the

school. >> reporter: doctor farly showed us a variety of neighborhood stores around second and ontario, what colorful tobacco advertising, close to several schools. >> the problem is young people get addicted when they are teenagers, and they are addict for life. so we want to prevent so many kid from getting addicted. >> i think it is something we can rally around. >> reporter: the reverend believes new regulations are needed because he said low income people are susceptible to smoking and tobacco advertising. >> to me it is a settle justice issue, an attack on low income people, in poor neighborhood, that is intentional by the tobacco industry. >> reporter: cbs-3 reached out to the national association of tobacco outlets which is, against these new regulations saying they will hurt law abiding retailers and stifle new economic development, in more than 3/4 of the city. now health department is going to have some hearings on these proposed new rules hoping to be in effect in the first of the year. >> we will see what happens.

>> thanks, stephanie. everyone is breathing easier in paulsboro, gloucester county after a train derailed in their town this morning's derailment happened not far from the 2012 paulsboro train derailment and chemical spill. officials say this morning the train was carrying lube oil when it came off track. the four cars derailed at an interchange directly between paulsboro high school and boys and girls club teen center. mayor far i stevenson left to evaluate the scene first hand. >> i think everybody's adrenaline in paulsboro go up when we hear train wreck and news helicopters are flying over. >> it happened again that is first thing it happened again. what are we up against? what fell, what spilled. >> reporter: there was in leak and local officials were told tanker cars derailed while backing over a spread apart section of the track. a man who lost part of the finger and suffered other injuries in the deadly hoboken train crash, plans to sue. lawyers for the plaintiff announce that plan lawsuit begins new jersey trans to it day. the 66 year-old was a passenger in the front of the

car of the train that crash in hoboken terminal september 29th. he suffered a broken nose and cuts on his head and face. police are trying to find two unknown juvenile suspects broke in the philadelphia academy charter school. police released video taken october 9th that shows a male and tea mail gaining entry to the school in the 11,000 block of roosevelt boulevard. they escaped with several items from classrooms, new police did not say what they were. if you have seen these suspects police ask you to give them a call. ronald mcdonald is taking a low profile for a while. >> we will tell you why you won't see the fun loving mascot around as much. also a head delaware county residents can breathe easier as a certain black bear won't be around to scare them anymore. president obama want to send humans to the red land net just 14 years, is a mission to mars really possible? we will talk with a world famous astronomer from philadelphia's franklin institute to get the answers, kate. another crisp, calm day, another chilly night, another

a black bear, that charged a motorcycle officer in suburban philadelphia last month, and caused two schools, to go on lock down has been trapped in ridley creek park. after luring the bear with sweets like syrup and doughnuts park officials, subdued animal and relocated him to state game land in dauphin county. bear made enthusiasms last month after it charged radnor police lieutenant christopher flannigan. decision to remove the bear was done for the animal's own safety. mcdonald's says its mascot ronald mcdonald is keeping a low profile. company is cautious in the wake of the creepy clown sightings and clown threats which have been posted on line. mcdonald's did not provide specifics about when ronald mcdonald will come out. president obama wants america to take the giant leap to mars. >> as our greg argos tells us from the einstein health care

we head in the next couple of days. cold front will sneak through, on thursday though, and then knock the temperatures right back down to these cool, october feels like temperatures. mid 60's it is where we were today and friday and saturday and into sunday as well n the meantime a brief little warm up. it is a cool 62 in philadelphia. 511 in millville. fifty-eight in atlantic city. sixty-one in reading. overnight, it will be chilly again, but much, less chilly, then last night, we were in the 30's last night in reading, allentown, pocono dropped below freezing. mid 30's in the poconos. but 40's, in our north and western suburbs, overnight lows in the 50's, in south jersey. so not as bad for sure, still need jacket tomorrow morning, and doesn't have to be as heavy and won't see the frost on the grass like we did this morning. 70 degrees, around here tomorrow, with a mix of sun and cloud. it is a nice day. warmer air is starting to move from the south and west as we await the arrival of this front. eye little bit more humid. the thursday morning we will have some fog and more moisture in the air. in the afternoon we have a

chance for a stray shower here and there not a big deal. mainly off to the north and west. the once that front sweeps through, we're seeing a little bit of a nice cool canadian high build right back in and temperature back in the 60's as we head into your friday and they will stay there, through the weekend. so the past couple of weekend have not been great. dit clear out this past sunday but this weekend, it is your october fall weekend. make the most of it. let time it out overnight tonight no problems, a few clouds, that is the case as we head into tomorrow morning. more cloud cover the past few days but still a mostly sun i wednesday. into thursday though we will start to see the front approach from the west. it does not after lot with it. a couple of showers well off to the west thursday morgue and then from allentown up through the poconos a shower or two, thinks around two or 3:00 o'clock thursday afternoon. that clears out quickly. and then we're back to cool, dry air, as we head toward your weekend. overnight partly cloudy, cool, not quite as cold, 49 degrees. and we will have 69 tomorrow. mostly sunny and seasonal. and you're witness weather seven day forecast shows that brief, moderate warm up
