stop momentum for moderate republican date. clinton focused on the issues during the fundraiser. >> it is not just who wins this election, it is actually bigger than that. we need to demonstrate that we have a hopeful, positive, unifying vision. >> clinton also visited her san francisco campaign office. coming up in ten minutes one of the most closely watched races in the country is here in pennsylvania, and i'll sit down with u.s. senate candidates pat toomey to talk about the presidential nominees and more. in other news a new jersey judge rules prosecutors should investigate governor chris christie in the bridge gate scandal. governor has been investigated multiple times in bridge gate, no charges filed. cleve bryan joins us live from the state house in trenton to explain how this complaint is different from the other investigations, cleve.

>> you are right, there has been a federal investigation, as state investigation that any potential role that the governor christie had in that george washington bridge scandallal, yet a municipal judge moving a criminal complaint forward. question is will it really go anywhere. >> it is embarrassing. >> reporter: democrats waiting for more after a new jersey judge issued a criminal summons against governor chris christie on thursday, saying there is probable cause in a private citizen, bill brennan official misconduct complaint. >> he doesn't think the rules a prize and time they realize rules apply to everybody. >> reporter: brennan say christie failed to stop intonate as they carried out a political plot december 2013, jammed traffic in fort lee, new jersey to punish mayor for not endorsing christie's reelection. some appointees are now being prosecuted in federal court. >> testimony at trial and then this corroborates the work of the committee and suspicions that many have had all along that the governor's office was not operating in the public interest, but operating more for the political benefit of

the governor's reelection campaign. >> reporter: christie has said he knew nothing about the lane closures on the george washington bridge, it is his office who responded sale they would immediately appeal and said thinks a dishonorable complaint filed by a known complaintant, and political activist with the history of abusing the judicial system. bergen county's octobering prosecutor will decide if christie should be indicted. former federal prosecutor, linda hoffman says she has her doubts. >> it is, in my experience of over 30 years, and criminal justice system and working in law enforcement, high liz unusual to see, a matter like that proceed forward and result in an indictment, particularly where law enforcement the has already indulin investigated this matter. >> reporter: today, state lawmakers in the democratic party said that they will have a hearing next month, to try to get a confirmation for the acting bergen county prosecutor who will deidentify at some point whether or not to have an indictment for

governor christie. live from trenton, cleve bryan, cbs-3 "eyewitness news". despite a yes vote last week from new jersey lawmakers governor christie has not signed the gas tax bill, that will fund road projects. today democratic leaders talk about how the new transportation trust fund will provide property tax relief by doubling money by local level road projects, however, none of that work can start until the governor signs the bill. >> he did a press conference with me and speaker announcing we had a deal, or an agreement. well, what we agreed to is what we put on his desk so we would expect him to sign it good governor has less than 40 days to act. a wilmington fire fighter injured in the deadly house fire last month has been downgraded to critical condition. fire fighters hope, was injured when a floor collapsed inside a burning row home september 24th. two other fire fighters died and another fire fighter was injured. hope's condition was downgraded to critical today

at crozer-chester medical center. twenty-seven year-old beatrice ruiz is charged with arson and murder in that fire. today ntsb investigators issued their preliminary report on last month's new jersey transit train crash. train failed to stop and then hit a wall at hoboken terminal, the impact, killed a would hand standing on the platform and injured more than 100 others. accord took that report neither engineer nor conductor of the train noticed anything unusual before the crash, it could take a year for investigators to release their final report. authorities are trying to figure out why a trash can exploded in barnegat township ocean county. rubber can blew up curb side between 81 and village drive and 82 win ward drive. in one was injured and the investigation continues. you may recall, in july, an american flag, given to the family of the fallen vietnam war hero was stolen from a wildwood home, one week later it was return. today that same flag was flown outside city hall here in

philadelphia "eyewitness news" reporter alexandria hoff explains the very special reason why. >> reporter: select few american war heroes have earned their place outside of philadelphia's city hall. on this day, one more, join the ranks. if this flag looks at all familiar it is because it was stolen from a flagpole in wildwood, on none other than independent day. >> we both broke down, i'll admit it, we broke down in tears. >> reporter: this wasn't a typical flag but it was military issued given to the family of patrick cork ran died while serving off the coast of vietnam 47 years ago. he was 19. one week after the flag was stolen, it was returned, anonymously. >> i sincerely thank you for making a right out of a wrong. >> reporter: following its return philadelphia officials requested the honor of flying the flag, which they did, but the story does not end there patrick corkran and his ship mates were killed in june 1969

when a carrier ship collided with the u.s.s. frank evans. the water where men died was just outside of the designated combat zone, so while patrick's name was added to the philadelphia war memorial. >> the vietnam veterans memorial in washington, still does not recognize philadelphia's own patrick corkran and his 73 ship mates. >> reporter: philadelphia city council has passed a resolution urging legislators in washington to add their names. >> it is an honor he deserves, so long as there are 73 others. >> reporter: one step closer to closure that was prompted by an unlikely person. >> would i love to know took the flag, and they would come, see us, because we are so grateful, honestly. >> reporter: flag was taken down mid afternoon and will be held at city hall for safe keeping until the family can pick it up. it will fly once again in wildwood on memorial day and on each memorial day that follows. reporting from city hall, alexandria hoff for cbs-3

we brought you first part of my conversations with the pennsylvania u.s. senate candidates and here again is a look at their biographies. challenger katie mcginty was most recently governor wolf's chief of staff and she served as pennsylvania's secretary of environmental protection in the rendell administration. and, is chair of the white house council on environmental quality during the clinton administration. and toomey was first elect

to the u.s. senate in 2010, he served three terms in the house of representatives, and then he previously worked in the financial services sector. we will begin the second part of our coverage, talking about the presidential nominees. while hillary clinton enjoy fullbacking of democratic candidates, including senate candidate kate i mcginty some republicans are choosing not to support donald trump. senator toomey will not vote for clinton and has so far refused to endorse the republican nominee. back in may i believe you wrote the op-ed and said there could come a point where differences are so great as to be irreconcilable. >> here's where we are at. i have been very critical of donald trump, when i have felt it appropriate. i have criticized publicly the things that he has said, things he has done, policy positions he has taken and appalling comments he has made about women that i find very offensive and objectionable. i have spoken out.

ivory fused to endorse him because of the many concerns i have about him. >> i have been disturbed that senator toomey won't be direct with the voters of pennsylvania. he actually is the only person running for united states senate in the entire country, who has not announced a position in support of or against donald trump. that just seems incredible to me. >> if were you elect and secretary clinton becomes president, would you feel comfortable voting against something she supported if you didn't believe in it. >> my only test is going to be is it good or bad for the people of pennsylvania. >> reporter: here in philadelphia, there is one specific issue that the candidates have debated. the city status as a sanctuary city. mayor jim kenney reinstated policy when he took office. it means local law enforcement it does not cooperate with federal immigration officials except when the individual has been accepted of the first or second degree violent felony. do you support philadelphia

being a sanctuary city. >> what ivory petely been clear about, again is any criminal whether they are documented or not documented need to be behind bars. all law enforcement, local, state, federal need to be working together toward the end of insuring our safety. and third, unlike senator toomey i will fight to make sure resources are there to achieve those important objectives. >> reporter: earlier this summer senator toomey introduced a bill that would withhold some congressional funding from sanctuary cities. the bill failed to advance but toomey vowed to reintroduce it. >> i will force another vote on this. it is very bad policy and very dangerous for citizens of philadelphia and surrounding area for philadelphia to be a sanctuary city. >> toomey and mcginty go head to head for the first time in their first debate monday night at 7:00. we will have full coverage and reaction on "eyewitness news" at 11:00. a controversial sign at a famous philadelphia cheese stake shop is no longer up.

for past ten years sign stating this is america when ordering please speak english, hung in the window at geno's steaks. today sign was no longer there. owner joey vento placed it there in 2006 but his son geno who took over the business decided it was time to take it down. they release had this statement, it says while geno continued to honor his father's traditions of good quality food, cleanliness and giving back to the community he decided after ten years it is time to move on. it is not about a sign. it is about what you company and what your mark in life is. and geno wants to change that mark in life. and, it is a big night at franklin institute. >> meteorologist lauren casey joining us live and a lot of things going on there tonight. >> reporter: so many things going on, and the main thing is robots, robot revolution is a new exhibit that just opened, this past weekend, and educators invited tonight a thousand from across the

delaware valley and includes teachers and principals of kindergarten up through 12th grade to an idea for the field trip and they are checking out robots. some robots deal card, some play games, and one scaling the wall over there. very cool things going on here tonight at the franklin institute. we are getting a preview of the drone zone which is part of the robot revolution. we will see drones going up and in the public that is opened to the public as part of this exhibiting forward. we also have a team here from cbs-3 talking to the teachers about, of course, our einstein science center for them, a big story for that and our cbs-3 weather watcher program. we were love to have some schools join in and give us their weather watcher report but watching the weather today we are watching a couple rain drops passing through. we had a cold front traversing the area earlier with shower activity but very light in intensity. we didn't see hardly any accumulation, no accumulation amounts over a tenth of an

inch of rainfall across the delaware val which this particular cold front. as we head into tonight we will clear on out. we will take a look at your forecast right now as we head into tonight we will be looking good and already seeing clearing skies right now, cross portions of the shore, cape may county courthouse getting a live look on our neighborhood network. still some clouds but clearing skies as well. we will continue to see clearing across the area, cooling as well, temperatures dropping off, we are in the middle 60's right now in philadelphia, down in the middle 50's in the poconos, already with that cooler and dryer air building in from the northwest. when we wake up tomorrow morning, it will be chilly, need that winter coat, 30's in the poconos. same case in the lehigh valley to near 40 degrees in berks county across the i-95 corridor waking up to temperatures in the 40's with a little bit of the breeze and will have you feeling chillier. the skies are clearing out after some fog this morning, cloud throughout the day, a couple showers but that cold front making its way up in new england, clearing skies on the back side and overnight

tonight, no problems weather-wise but a big problem weather-wise for folks in bermuda, dealing with nicole and major hurricane earlier this morning. eye wall passed very close in proximity to that island. wind gust of 122 miles an hour with the passage of nicole. that will continue to move north and east. they are still dealing with the same tropical storm force wind, on bermuda that will let up, fortunately as we head in the night tonight and they will be able to assess damage that did occur with this very strong hurricane but for us, just quiet conditions, becoming mostly clear, chilly breeze down to 49 degrees. the beautiful day in store for our friday, sunshine, high temperatures in the middle 60's. we have a nice, crisp after a muggy day to day as we head in the next several days. we have susan g komen walk for the cure and conditions will be very nice as we head in the next couple of days, lot of sunshine in store, no rain, to worry about but you might have a coat starting out on saturday morning down to

dell kay issue bubbling in the washington d.c. area for years. the name of their pro football team that starts with the r, end with an s and many native americans find it offensive including one philadelphia eagle. starting guard alan barber is native american and called the team in washington the pigskins. he won't use the r word. we talk about the situation today in the locker room. >> i mean i find it where, you know, i see where people could find it offensive, you nose, but i just never really put much thought into it, but you could look at it where it is offensive and take it same way as african americans look at
